Role Mandate
To manage Employee Relations/IR related matters, deliver and lead expert guidance and advice on relevant legislation, policies, practices and processes to enable provision of sound ER/IR solutions across the company. Provide high-level employee relations services through management of processes and production of service flows to achieve efficiency, quality goals, manage disputes, stakeholder engagement, encourage harmonious working environment, ensure compliance in relation to labour legislation. 
 
Key Accountabilities
  • Formulate employee relations (ER) strategy, in line with the business strategy
  • Ensure execution of employee relations strategy across the group and align with Group ER standards
  • Provide expert and specialist advice to business on HC and ER legal, regulatory compliance and company’s HC and ER policies and procedures
  • Develop standardised policies, processes, frameworks, guidelines and tools to manage ER issues in line with SAFCOL Group company policies
  • Promote Code of Conduct, design, manage processes and practices that support commitment to operate with integrity & ethically
  • Manage Employment Equity programme and Implement employee relations best practice across the company
  • Compile IR reports, including Board submissions as and when required and prepare divisional risk registers and identify ensure mitigation of all risks
  • Provide ER Specialist expertise within the company in support of divisional head
  • Provide expertise during investigations; preparing of witness/es and collect evidence, in preparation for internal disciplinary and CCMA processes and related hearings (Labour Court)
  • Manage disciplinary processes and grievance processes and represent the company at CCMA, Labour Court or similar dispute matters
  • Compile communication, draft agreements, CCMA presentation, documents in preparation for IR matters to any external parties, such as trade unions or attorneys, as and when required
  • Conduct research to ensure SAFCOL’s ER is in line with best practice and relevant labour legislation
  • Provide high quality employee relations advice and services to SAFCOL Group, which results in improved employee relations and other human resource management policies and practice
  • Manage and facilitate consultations with organised labour and management regarding Employment Equity targets
  • Organise, facilitate and ensure comprehensive and continuous training and upskilling of line management on ER/IR, including investigations and chairing of hearings/grievances and other dispute resolution platforms
  • Lead and resolve complex or critical ER issues in a timely and effective manner across the organisation and with relevant external stakeholders
  • Continuously provide support and advice on ER/IR activities including handling disciplinary cases, CCMA representation, consulting management on best practices and ER/IR business solutions
 
Minimum Requirements
  • Grade 12
  • Bachelor of Law Degree NQF Level 7
  • Must be an Admitted attorney or Advocate specialising labour law
  • Post Graduate Diploma in Alternative Dispute Resolution NQF Level 8 will be added advantage
  • Masters of law in Labour Law (LLM) NQF Level 9 will be added advantage
  • 8 Years’ experience in employee/ industrial relations of which 5 years should be as a specialist or in a managerial role within the field of employee/industrial relations management function in a highly unionised environment
  • Practical and sound knowledge in all areas of ER value chain
  • Previous experience in dispute resolution including conciliation mediation, arbitration, negotiation and labour court
  • Previous experience and involvement in wage negotiations/consultations with Union/s at Group level and bargaining council
  • Sound knowledge of legislation, including LRA, BCEA, EE, UIA, SDA, COIDA, OSHA MPRDA
  • Valid driver’s license
