Main Purpose

DUTIES AND RESPONSIBILITIES
 
IMPLEMENTATION OF THE STRATEGY
  • Drafting and/or vetting of Commercial Contracts.
  • Peer reviewing of contracts
  • Provide legal advice (oral and written legal opinions) to internal Business Units on a range of legal questions.
  • Manage litigation matters on behalf of the SABC and provide timeous reports to Legal Services and Business Units.
  • Develop, assist, provide advice, educate and protect SABC IP rights, strategies and policies.
  • Develop and assist in the management and implementation of the SABC’s intellectual property rights, strategies and policies;
  • Represent the SABC at Arbitration proceedings at the CCMA on behalf of the SABC
 
BUSINESS OPERATIONAL EFFICIENCY
  • Manage litigation matters
  • Contribute to the reduction of legal costs.
  • Conduct comparative research and market intelligence on royalties’ payable by and to the SABC as well as rights fees for the acquisition and exploitation of IP.
  • Research and inform the relevant divisions and management of all changes in the laws affecting SABC’s intellectual property assets or the acquisition and exploitation thereof.
  • Conduct benchmarking on best related practice in IP Management.
  • Management of identified legal IP projects for the organization.
  • Providing expert advice, guidance, opinions and support on IP issues affecting the organization.
  • Apply, interpret and advise on all relevant legislation.
  • Provide accurate monthly reports for the Department and give regular feedback to client.
  • Drafting and/or vetting contracts and policy documents
  • Peer reviewing contracts to ensure compliance and proper legal risk management.

GOVERNANCE, RISK AND COMPLIANCE
  • Identify and manage possible risk areas for the business and propose corrective measures for implementation.
  • Advise Business on proper compliance on the relevant Governance prescripts.
  • Management of legal compliance with all laws affecting SABC’s intellectual property rights including third party rights.
  • Identification of possible risk areas for the business and propose corrective measures for implementation.
  • Manage the development and implementation of Standard Operating Procedures (SOP).
  • Advise the Business Unit on the protection of organisational integrity and prevention of financial loss, including irregular, fruitless and wasteful expenditure.
  • Monitor and report on compliance in line with OHS requirements.
  • Manage and oversee the internal risk and provide mitigation plan.

INHERENT/MINIMUM REQUIREMENTS
QUALIFICATIONS
  • Bachelor’s Degree in Law (NQF7)
  • Preference will be given to candidates who are admitted as either an Attorney or Advocates of the High Court of South Africa.
 
EXPERIENCE
  • Minimum: 2 years of Articles work experience as a Candidate Attorney; or 1 year post Pupilage experience as a Junior Advocate

MAIN PURPOSE OF POSITION

KEY ACCOUNTABILITIES:
