Purpose of the Job: is to supervise the assessment and finalization for bill of costs.
Key Performance Areas
- Efficient and Effective Management of validation of costs
- Compile schedule for court attendance/block settlement/submission of files by Panel Attorneys
- Compile schedule for block settlement with Plaintiffs’ Attorneys
- Develop plan for efficient running of team
- Manage distribution of work to subordinates
- Allocate of bill of costs to subordinates
- Booking over of files to legal cost officers
- Evaluate bill of cost as assessed/offered.
Perform authorization of bills
- Approve or reject bills in terms of delegation of authority
- Manage instruction to Panel Attorneys and Cost, Consultants to oppose taxations
- Re-open files to facilitate payment of legal cost
- Prepare the source documents authorized to be forwarded to finance for payment
Perform supervisory responsibilities
- Attend to queries from both internal and external stakeholder
- Manage stakeholders’ relationships
- Provide guidance in respect of review proceedings
- Attend court on taxation and review proceedings
- Provide advice and guidance to Claims sections, Attorney and Cost Consultants
- Monitor and manage compliance with court tariffs.
- Manage referrals to Recourse and Recoveries
- Monitor and manage compliance with RAF tariffs
Collate and compile statistics
- Keep daily stats of activities on work allocated and work to be assessed
- Submit daily and monthly stats as required by Management
- Keep record of statistics
- Manage team performance
- Conduct performance analysis of the team
- Compile and maintain statistics on departmental activities for management reporting
- Compile monthly reports
Ensure adherence to human resource, financial and administrative policies, and procedure in the department
- Conclude performance agreement and conduct assessments with direct reports
- Ensure that all staff in the department have performance agreements and assessments
- Oversee fairness and consistency in performance assessments
- Monitor submission of leave forms and implement measures to minimize staff absenteeism
- Monitor adherence to all administrative and financial policies and take corrective steps in cases of non-compliance
- Co-ordinate inputs into and prepare the departmental staff training requirements
- Discipline staff
Perform advisory function
- Attend to queries from stakeholders pertaining to bills settled and accounts outstanding
- Provide advice to claims section, attorneys, and costs consultants
Qualifications and Experience
- Appropriate B Degree in LAW at NQF Level 7 or equivalent
- Relevant 4 years’ experience in the Claims environment of which 1 year must have been on a supervisory level/ area of expertise

Remuneration
Total cost to company applicable to this position is minimum R502 953.00 per annum, negotiable.

- Conduct research that will provide information in preparation of all matters for trial.
- Consult with client departments/ representatives, and witnesses for instructions and documentation for cases to be presented in Court.
- Draft pleadings to provide clear motivation/ justification on a particular position pertaining to the case.
Mediation Process
- All required steps regarding the mediation process, as governed by the amendment to the rules of court, to be taken.
Represent the Road Accident Fund on all Third Party Claims Related Litigation Matters
- Attend to Court appearances in all allocated third-party litigation matters.
- Ensure file administration from opening to the conclusion of a legal case including adherence to trial dates.
- Handle appearances at courts, tribunals, mediation hearings and enquiries.

Reporting

Qualifications and Experience
- Four (4) year Degree in Law or equivalent.
- Admission as an Attorney of the High Court.
- Relevant 2 – 3 years legal experience post-graduation or admission of which 2 years must have been on area of expertise (personal injury litigation).

Purpose of the Job: To provide claims handling to ensure prompt and fair settlement of claims.
Key Performance Areas
Estimate value of loss in terms of DOA.
- Review documentation or determine further documentation needed.
- Scrutinize all claims documentation (e.g. Pay slips etc.).
- Determine and estimate quantum of claims.
Quantify benefits and prepare offer.
- If no expert is required, calculate the value of benefits
- Loss of support/earnings calculation on advice of the Assessor and/or Senior Assessor
- Provide details of income and fringe benefits in major sectors.
- Determine contingency deductions to be applied.
- Interpretation on the cap limit under the Amendment Act.
- Assess the funeral account and award benefit in terms of ARAF Act.
- Communicating and explaining offers to claimants.
- Attending to queries with claimants.
- Knowledge of rules of collateral and accelerated benefits.
- Factor in contingencies, also consider merits allocated.
- Prepare offer as approved by the assessor or senior assessor.
- Consider any prior payments/interim payments/WCC/Social grants/EIL under the advisement or approval of the assessor or senior assessor.

- If accepted, request payment.
- If not accepted, revise the offer.

Remuneration
