Purpose of the Job: Reporting to the Manager: ER and Capacity Building, the successful incumbent will be responsible to conduct internal prosecutions against employees who have committed misconduct or are incapacitated due to poor performance or ill-health.

- Initiate misconduct cases in formal disciplinary hearings;
- Initiate incapacity hearings.
- Preserve the integrity of documentation and/ or information to be used as evidence.
- Prepare disciplinary hearing plan for submission to management.
- Analyze available evidence and draw up misconduct charges for approval by line management.
- Liaise with HRBP’s and Line Managers to approve charges.
- Consult and prepare witnesses for formal disciplinary hearings.
- Ensure proper preparation for disciplinary hearings.
- Lead employer evidence and cross examine employee witnesses;
- Draw-up and Present closing arguments and aggravating factors
- When necessary, lead employer evidence at CCMA.
Reporting
- Report on hearings after finalization.
- Report on statistics monthly, quarterly and annually.
- Report on wasteful and fruitless expenditure.

Qualifications and Experience:
- Bachelor’s Degree or Advanced Diploma @ NQF Level 7 in Employee Relations/Human Resources related qualification.
- Relevant 5 – 7 years’ experience in practical experience in internal disciplinary hearings prosecutions of which 2 years must have been on a supervisory level or area of expertise.
- Excellent knowledge of Labour Law and Law of evidence.
- Driver’s license.

Remuneration
Total cost to company applicable to this position is minimum R668 907.00 per annum, negotiable.
NB: "RAF offers Total Employment Cost packages with no additional contributions from the Employer, successful candidates are required to structure their packages in a manner that will suit their needs".
