EXECUTIVE MANAGER: PROVINCIAL INVESTIGATIONS AND INTEGRATION (COASTAL)

Location: Head Office, Pretoria
ALL- INCLUSIVE SALARY PACKAGE RANGE: R1, 304 436.00 to R1, 979 127.00 PER ANNUM
Requirements: A degree or equivalent qualification in any of the following fields: Law i.e. LLB or B Proc/Auditing/ Accounting/ Forensic Investigations/ Criminology/ Policing/Public Administration. A minimum of 10 years’ related experience of which 5 years should be at Senior Management Level. Experience in service delivery environment is a prerequisite. Independent, impartial and objective with initiative, strong leadership qualities and the willingness to travel extensively • Investigation or research background. A valid driver’s license is required.

Manage and adapt to change and diversity, and innovative, mentor employees. Advice and influence decisions and policies. Research and report writing skills. In depth knowledge and understanding of the Legal Framework including knowledge of the Public Protector Act, Constitution of the Republic of South Africa and other enabling legislation, the Public Administration, Local Government, and Public Finance: In depth knowledge of Finance and procurement, HR matters; Effective investigation and interview techniques and protocols in public administration; Reporting procedures; Project Management; Legal interpretation and research methodology; Ombudsmanship. Knowledge of forensic investigations and/or auditing.
Competencies: Ability to timeously resolve queries and finalise investigations, and make recommendations to effectively address maladministration and correct service delivery failure • Legal research and interpretation • Production of high quality reports • Must have strong ability to initiate hearings, gather information and facts • The position requires individuals who are objective, impartial and initiative. Must be able to deal with complaints, resolve, rectify, make presentations and generally act without fear, favour or prejudice.
Key Performance Areas (KPA’s): Strategic and operational management, Investigations and Reporting processes, content management, Branch reporting to the Chief Operations Officer(COO), Budget planning and management.
Duties and Responsibilities: To manage the Branch: Provincial investigations and Integration - Coastal. Development and implementation of the Branch Strategy Plan. Assist the Public Protector in coordinating and processing the investigations activities and functions of Coastal Provincial Offices and centralising enquiries from the Coastal Provincial Offices. To ensure that the Operational Plan of the Branch is aligned with the overall strategy plan of the PPSA. To manage the human resources and finances of the Branch: Provincial Investigations - Coastal. To identify, establish and maintain effective and collaborative working relationships and networks with Chapter 9 and other relevant stakeholders. To advise on, guide and monitor more complex and sensitive cases in the Provinces. To screen draft investigation reports and project plans for submission to the Public Protector. Oversee the secretarial and support duties to the Think Tank Committee. To collate and interpret operational and statistical reports and advise the Executive Authority accordingly. Responsible for files, office furniture, and other state assets under the control of the Branch: Provincial Investigations - Coastal. Collate and analyse monthly statistics on performance and case load from the Coastal Provincial Offices and make recommendations to the Public Protector and Chief Operations Officer. Develop, maintain and monitor effective communication between the Coastal Provincial Offices and the National Office. The management and, coordination of integrated service delivery in Coastal Provinces. Ensure integration and consolidation of performance of Coastal Provincial Investigations. Ensure the implementation and coordinate transparent systems of Financial, Risk management and internal controls in Coastal Provincial Offices. Oversee the consolidation, analysing of quarterly performance reports of Coastal Provinces. To perform ad hoc tasks and to serve in committees as and when required. Oversee the conducting of quality assurance in respect of Coastal Provincial Investigations.

Note: All appointments will be done in terms of the Public Protector Act and a 12 month probation period which may be extended to 18 months will be applicable. SENIOR MANAGER: LEGAL SERVICES

All –Inclusive Package: R1, 073 187.00 - R1, 264 176.00 per Annum
Requirements: An appropriate LLB degree or four year law degree at National Qualification Framework (NQF) Level 8 as recognised by South African Qualifications Authority (SAQA). A relevant postgraduate legal qualification at NQF Level 9 will be an added advantage. Admission as an Attorney/Advocate to the High Court of South Africa with High Court right of appearance. A minimum of 8 years post qualification experience of which 5 years should been at middle management in the legal field. Extensive experience in providing professional, credible, accessible and quality-assured legal services. At least 5 years relevant and practical experience in Administrative Law, Public and Constitutional Law, Law of Contract, Procurement laws, policies and prescripts, Labour Law, disciplinary and labour relations matters, including dealing with CCMA and Labour Court cases, Civil Litigation in the High Court and the Magistrates’ Court. Drafting of contracts and contract management. Drafting of court papers, legal research, providing legal opinions and advice. Consultation with witnesses, Supervision of legal and administrative staff. Knowledge and understanding of Public Protector Act, PFMA and all relevant legislation and regulations that govern the Public Administration. Financial management and budgeting skills are essential. A valid driver’s license.

Client orientation and customer focus, Results-driven. An ability to manage tight deadlines. An ability to think independently and drive projects. Ability to research and write legal opinions and give advice to internal and external stakeholders. Ability to draft affidavits and legal documents. An ability to drive litigation and manage the legal process. Candidates will be subjected to a competency assessment.
Duties: Render professional, accessible, credible and quality assured legal services to the Public Protector South Africa (PPSA). Manage litigation on behalf PPSA from inception, including the preparation of court documents. Represent PPSA on all legal matters. Ensure legal compliance of contracts, Memoranda of Understanding and Memoranda of Agreement and Service Level Agreements (SLAs). Reviewing, vetting and quality assure investigation reports. Ensure legal compliance of the PPSA. Review and/or provide legal opinions, advice, contracts, and service level agreements. Ensure quality control and compliance with policies, procedures, regulations and standards. Deal with the legal aspects of disciplinary inquiries, labour disputes and litigation in labour related matters. Facilitate legal services between PPSA and any legal entity. Review and/or provide legal opinions and advise specifically relating to the investigations for which the PPSA is responsible and provide on-going support during investigations. Provide input/recommendations based on research findings and draft legislation. Provide legal counsel in litigation matters. Direct and manage administrative appeals. Represent the PPSA in various forums. Manage operational plans for the unit in line with the strategic plan of Public Protector South Africa.
