- LL.B. degree or appropriate equivalent post-graduate qualification in law.\
- Must be admitted to practice as either an attorney or advocate of the High Court of South Africa.
- Participation in attainment of the National Treasury: Local Government: MFMA: Municipal Regulations on Minimum Competency levels or reasonable progress towards the attainment of these minimum competencies (an advantage).
- A minimum of five years’ relevant middle-management experience.
- Proven extensive experience in the practice of law, either as a member of the Bar or as an attorney, or as a legal advisor in a municipal or public sector environment (an advantage).
Key attributes and competencies:
- Candidates must demonstrate the appropriate skills, including research and analytical ability, drafting of opinions and contracts, knowledge of the litigation process, including in labour forums, excellent written and oral communication skills, a sound academic knowledge of municipal and administrative law, proven leadership and management experience.
- Candidates will, in addition, be required to demonstrate a practical understanding of the constitutional, legislative and policy framework governing the local sphere of government and, in particular, the responsibilities of a senior manager in terms of the Municipal Systems Act (Act 32 of 2000) and the Municipal Finance Management Act (Act 56 of 2003).
- National Treasury minimum competency.
Job purpose:
- Fulfilling the role of Director of the Legal Services Sub-Directorate, reporting to and accountable to the Chief Operating Officer in terms of the legislative and policy framework of the Municipality.
- Providing strategic legal advice and guidance to the Executive Mayor and City Manager and providing general legal services to the administration.
- Ensuring compliance by the Municipality with the constitutional, legislative and policy framework of local government.
- Conducting legal research, analysing facts and the law, and providing oral and written opinions.
- Reviewing, negotiating and managing contracts and agreements, and drafting contracts (and amendments thereto) and municipal by-laws.
- Procuring goods and professional and other services, as may be required from time to time in terms of the regulatory framework of the Supply Chain Management Policy, and managing the relationships with professional service providers.
- Establishing and maintaining a comprehensive set of management and financial systems and controls within the Sub-Directorate and maintaining regular reporting standards in terms of the requirements of the MFMA and municipal accounting standards.
- Managing the human resources of the Sub-Directorate in a highly unionised environment, to contribute to labour peace and minimise disputes.
As part of the selection process, candidates may be tested on any requirement, skill or competency, which will include pre-employment screening, medical examination, security vetting and psychometric assessment.
