NATIONAL ENERGY REGULATOR (NERSA)
The National Energy Regulator of South Africa (NERSA) is a regulatory authority established as a juristic person in terms of section 3 of the National Energy Regulator Act, 2004 (Act No. 40 of 2004). NERSA’s mandate is to regulate the electricity, pipedgas and petroleum pipeline industries in terms of the Electricity Regulation Act, 2006 (Act No. 4 of 2006), Gas Act, 2001 (Act No. 48 of 2001) and Petroleum Pipelines Act, 2003 (Act No. 60 of 2003). The structure of the Energy Regulator consists of nine members, five of whom are part time and four are full time, including the Chief Executive Officer (CEO).
The Energy Regulator is supported by a secretariat under the direction of the CEO. NERSA wishes to recruit personnel with appropriate competencies in the following area:
Ethics and Compliance Officer
Department: Regulator Support Unit
Package: R740 220.00 – R1 015 042.00 per annum (CTC)

Requirements: * A Bachelor’s Degree in Law Admitted Attorney * A certified ethics officer will be an added advantage * Minimum Five (5) years’ experience in a legal environment.
The candidate must be competent in the following: * Excellent Written and Verbal Communication Skills * Computer Literacy Skills * Excellent Listening Skills * Excellent Presentation and Report-Writing Skills * Problem Solving Skills * Leadership Skills.
Purpose: Reporting to the Senior Manager: Regulator Support Unit, the incumbent is expected to serves as NERSA's internal control point for ethics and improprieties, allegations, complaints, and conflicts of interest and provides corporate leadership and advice on corporate governance issues.
Key responsibilities: The successful incumbent will: * Apply knowledge and analyse and assess moral issues, ethical dilemmas and requirements for ethical decisions * Monitor and report progress with advancing ethical culture with regard to maturity level * Provide a neutral and objective space for employees to voice potential unethical behaviour, processes and practices * Develop and disseminate business ethics statements, policies and supporting forms /acknowledgements and keep a declaration register of interests of employees, management and Regulator Members * Provide an internal review of other business policies to ensure business consistency and integration with the business ethics philosophies * Provide leadership and expert advice to make sure of the development, explanation and execution of ethics and the observance of the policies and programs of NERSA * Oversee the development and implementation of business ethics and conflict of interest training and conduct ethical decision-making training for senior management on ethics issues and the avoidance of conflicts of interest * Promptly conduct investigations pursuant to complaints and allegations of ethical wrongdoing or conflicts of interest within the organization * Answer ethical questions raised by staff or management and Regulator Members * Develop the code of ethics for employees, management and Energy Regulator and make modifications as needed * Screen all complaints on ethics pertaining to staff, management and Regulator Members and advise accordingly * Monitor compliance by staff, suppliers, vendors, and purchasers with ethical rules and laws * Prepare and present a compliance report to the Audit and Risk Committee on a quarterly basis * Advise on new legislation, policies, regulations and where necessary offer training to management and staff * Develop the Resolution Register of all decisions of the Energy Regulator, Subcommittees and Committees of the Energy Regulator * Monitor the implementation of all Energy Regulator decisions and its Subcommittees and Committees and present regular reports to the CEO and Energy Regulator.
