NATIONAL CREDIT REGULATOR (NCR)
The National Credit Regulator (NCR) was established as the regulator under the National Credit Act 34 of 2005 (the Act) and is responsible for the regulation of the South African credit industry. It is tasked with carrying out education, research, policy development, registration of industry participants, i.e. credit providers, credit bureaux, alternative dispute resolution agents, payment distribution agents and debt counsellors, investigation of complaints, and enforcement of the Act.
The Act requires the NCR to promote the development of an accessible credit market, particularly to address the needs of historically disadvantaged persons, low income persons, and remote, isolated or low density communities.
The NCR invites applications from suitable candidates for the following position:
SUPERVISOR: COMPLAINTS
Paterson Grade: D-Lower
Salary ranges from R405 200 – R769 900 maximum
Requirements:
The successful candidate must hold a relevant diploma/degree in legal, business management or equivalent qualification, coupled with 3 years ‘relevant experience in financial, regulatory or legal environment.
A minimum of 2 years relevant experience in supervisory role.
Admission as an attorney will be an added advantage.
Duties:
Overseeing the operational functions of the Complaints Department and also provide leadership and guidance to the team
Implementation of the operational plan of the department
In line with the Act, review and close complaints files recommended for closure by Complaints Officers / Legal Advisors.
Assist with the development and implementation of departmental policies and procedures
Monitoring of complaints and making sure the team adheres to internal policies and procedures.
Effectively handle all complex complaints / enquiries referred by NCR’s management.
Provide support to the manager.
Ensure effective implementation of the complaints management systems.
Monitoring of trends in the credit industry and providing recommendations on interventions to be undertaken by the department.
Staff, risks, and performance management.
Compilation of reports and relationship/stakeholder management.
Providing continuous support and training to internal and external stakeholders on the Act and related legislation.
Knowledge:
National Credit Act and debt counselling provisions.
Complaints handling processes.

LEGAL ADVISOR – COMPLAINTS

Requirements:
The successful candidate must hold a relevant Legal Degree (BProc and/or LLB) and a minimum of 2 years post admission experience as an Attorney or Advocate working in a litigation environment.
A minimum of 1 year experience within a Regulatory Environment will be an added advantage.
Duties:
Effectively dealing with general and debt counselling complaints in accordance with the National Credit Act.
Assessing investigation reports and advising on enforcement action to be taken.
Preparing and presenting cases at the tribunal and/ courts.
Provision of legal advice on specific issues related to the National Credit Act and other related legislation.
Carrying out external communications and presentations related to the National Credit Act.
Attending meetings with external parties on behalf of the department.
Drafting agreements, memoranda and legal briefs on behalf of the department and the NCR as and when required.
Research into issues and topics relevant to the NCR within the credit market.
Providing training to internal staff on the National Credit Act, court decisions and related pieces of legislation.

CREDIT BUREAU COMPLIANCE OFFICER
Paterson Grade: D- Lower
Salary ranges from R405 200 – R769 900 maximum
Requirements:
The successful candidate must hold a Diploma or an equivalent qualification with a minimum of 3 years relevant experience. A good knowledge and understanding of the National Credit Act, and experience in the credit bureau industry will be an advantage.
Duties:
Monitor compliance with legislation to ensure the protection of consumer credit information.
Responsible for co-ordinating, planning and conducting/compliance on-site/desktop visits in terms of risk based supervision approach.
Report on the findings and recommend corrective actions where feasible e.g. statutory reporting review, briefs for forensic investigations.
Monitoring and managing issues related to bureau general NCA compliance and adhoc information requirements.
Enhancing and maintaining the compliance framework for credit bureau, undertaking periodic and specific initiative to drive compliance, for example developing and issuing guidelines on the relevant matters.
Liaising at multiple hierarchical and organisational levels, executive to operational.
Manage and co-ordinate projects in the department in relation to compliance.
Facilitating meetings, hosting workshops, negotiating solutions and issuing of correspondence.
Knowledge:
National Credit Act and other relevant legislation.
Compliance Regulatory framework.

Requirements:
The successful candidate must hold an LLB Degree and be an admitted attorney
Civil litigation experience within a legal practice is required.
A minimum of 1 year experience within a Regulatory Environment is an added advantage.
5 years post admission litigation experience.
Experience in a regulatory agency, the credit industry or working at a law firm/bar council will serve as an added advantage.
Duties:
The successful candidate will deal with litigation matters, which will include complex and contentious matters, on behalf of the department from the National Consumer Tribunal, High Court, SCA and Constitutional Court.
Drafting of pleadings and litigation of matters at the National Consumer Tribunal.
Assessing investigation reports and advising on enforcement action.
Preparing and presenting cases at tribunals and/or courts.
Liaising with internal and external stakeholders.
Conducting research on issues within the credit industry
Technical Skills:
Knowledge of the National Credit Act and civil court procedures.
At least 5 years’ litigation experience.
Understanding of the South African consumer credit market.

Requirements:
The successful candidate will hold a 3-year Legal Degree and/or an Investigations related degree with at least 4 years working experience. Credit Industry experience will be an added advantage
A valid code B driver’s license with own vehicle is essential as well as the willingness to travel.
Duties:
Conducting investigations and monitoring of compliance with the National Credit Act and other relevant legislation.
Drafting investigation mandates and reports.
Questioning witnesses and conducting research.
Providing information in order to obtain search warrants.
Keeping up to date with the latest relevant decisions of tribunal and courts.
