NATIONAL CREDIT REGULATOR (NCR)
 
The National Credit Regulator (NCR) was established as the regulator under the National Credit Act 34 of 2005 (the Act) and is responsible for the regulation of the South African credit industry. It is tasked with carrying out education, research, policy development, registration of industry participants, i.e. credit providers, credit bureaux, alternative dispute resolution agents, payment distribution agents and debt counsellors, investigation of complaints, and enforcement of the Act.
The Act requires the NCR to promote the development of an accessible credit market, particularly to address the needs of historically disadvantaged persons, low income persons, and remote, isolated or low density communities.

AUDIT AND RISK MANAGEMENT COMMITTEE MEMBER X 1
 
Background:
The National Credit Regulator (NCR) Audit and Risk Management Committee (ARMC) is an advisory committee established in terms of section 77 of the Public Finance Management Act 1 of 1999(PFMA) and regulation 3.1 of the National Treasury regulations to discharge an independent advisory role to the NCR Accounting Authority by providing oversight to the NCR’s risk management, financial reporting, ICT governance, combined assurance, internal controls systems and processes and ensuring that the NCR complies with related laws and regulations.
 
Remuneration:
• Appointed candidates will be remunerated for related activities agreed upon and at a rate approved by the NCR.
 
Duration:
• The term of office of the ARMC member shall be a period of three (3) years.
• The ARMC will meet at least four (4) times per annum.
 
Requirements:
• A relevant degree and postgraduate qualification in Accounting/Auditing/Risk and must be a member in good standing with their professional bodies.
• A minimum of ten (10) years’ working experience in auditing, risk, or accounting.
• Must possess a minimum of five (5) years’ experience serving as a board member or in an audit committee within the public sector or regulatory environment.
• Advanced qualification and certification in finance and accounting will be an added advantage (e.g., CA(SA), etc)
• Candidates should demonstrate proven experience of participating in governance structures as well as the ability to dedicate time to the activities of the NCR ARMC.

Responsibilities: 
• Provide oversight responsibilities and advice to the NCR Accounting Authority regarding, amongst others the efficiency of the NCR’s internal controls, the financial reporting, risk management and governance procedures. 
• Obtain reasonable assurance with regards to the adequacy and effectiveness of the controls responding to risks within the NCR’s governance, operations and information systems. 
• Consider, review and recommend to the NCR Accounting Authority the necessary documents for approval. 
• Review the findings of internal and external auditors and monitor the audit action plans. 
• Regular review and approval of the NCR’s risk register. 
• Review and provide advice on the NCR’s systems, policies and procedures. 
• Drive ethical behaviour. 
• Monitor, review and advise the Accounting Authority on matters set out in the NCR ARMC Charter. 
• Perform ad hoc activities as and when requested by the NCR Accounting Authority.

JUNIOR LEGAL ADVISOR: DEBT COUNSELLING 
Paterson Grade: C-Upper
Salary ranges from R 253 900– R 482 400 maximum
 
Requirements:
• The successful candidate must hold a relevant four-year Legal degree, admission as an Attorney or Advocate and a minimum of 5 years relevant working experience in a financial, regulatory or legal environment.
• A minimum of 3 years’ debt counselling process experience.
 
Duties:
• Provide administrative and legal support to the debt counselling department and industry.
• Provide support to the legal advisor of the department on DC legal related projects.
• Draft legal documents for the review by the legal advisor of the DC department.
• Participate in the departmental investigation and enforcement mandate and procedures.
• Present the department at the National Consumer Tribunal on DC related matters.
• Conduct research on legal matters impacting debt counselling provisions to ensure an improved regulatory dispensation.
• Monitor trends and practices in the debt counselling industry and recommend intervening strategies where necessary to be undertaken.
• Conduct training/information sharing sessions with internal and external stakeholders on related matters.
• Provide support and/or resolve complex debt counselling queries within the debt counselling department.
• Provide support to draft debt counselling guidelines, circulars, and explanatory notes as and when required.
• Provide secretariat duties to the Credit Industry Forum subcommittees headed by the NCR as and when required.
• Conduct and maintain effective stakeholder engagement.

DEBT COUNSELLING MONITORING OFFICER

Requirements:
• The successful candidate must hold a relevant three (3) year Diploma/Degree in legal, compliance, finance, credit management or equivalent with a minimum of 3 years working experience in the financial, legal, compliance, credit or regulatory environment.
• Debt Counselling training course certificate will be an added advantage.
• A minimum of 1-year debt counselling process experience.
• A valid code B driver’s licence and own reliable vehicle.
 
Duties:
• Conduct compliance monitoring and investigations of debt counsellors in line with the National Credit Act (NCA) and the conditions of registration.
• Analyse and interpret documents and/or information received during compliance monitoring to ensure accurate interpretation of the provisions and regulations of the NCA.
• Draft reports with detailed findings within the applicable departmental procedure timelines.
• Identify areas of non-compliance and recommend corrective action.
• Draft related enforcement action documents to address non-compliance identified.
• Follow up on corrective/ enforcement action taken as well as implementation of corrective measures.
• Co-ordinate and/or participate in industry committees dealing with debt counselling related matters.
• Monitor trends in the debt counselling industry and recommend intervening strategies where necessary.
• Draft relevant communiqué to the debt counselling industry as and when required.
• Engage on issues raised by registrants from the compliance monitoring activities and operational queries raised.
• Conduct stakeholder engagements such as webinars, periodic meetings, and others.
