Purpose of the job
To provide legal advice on management of all legal matters subject to litigation in the organisation to ensure that the interest of the organisation is protected in all litigation matters.
To safeguard ICASA’s reputation by guaranteeing that the company strictly follows legislative guidelines and adheres to prescribed rules for management of litigation and give legal advice to Council about all issues relevant to litigations involving ICASA.
Key Outputs: The successful candidate will report to the Chief Executive Officer and their responsibilities include: ● Litigation Management - Prepare litigation strategy on new litigation matters; Provide guidance to Council on litigation matters where necessary; Ensure proper management of litigation matters; Ensure proper management of external attorneys and counsel/s; Prepare litigation reports for Council and relevant Committees (incl EXCO, OPCO, AREDC etc.) on active matters. ● Quality assurance of draft and final Regulations, regulatory notices and other documents prior publication in Government Gazette - Review and proof read Regulations, Explanatory Memorandums, Findings documents, Discussion Documents etc. timeously upon finalisation of appropriate input from internal and external stakeholders and post approval by Council to ensure that documents published in Government Gazettes are of the requisite standard and quality; Identify regulatory gaps and prepare recommendations for Council consideration as appropriate on the development of regulations to address such gaps; vet notices to be published in the Government Gazette in order to minimize ICASA’s risk from an administrative law point of view ● Maintain and manage Regulations Register - Compile and maintain an up to date register of regulations promulgated by ICASA in terms of its statutory mandate across all regulatory functional areas; Engage with all key internal stakeholders to identify Regulations that are due for review and ensure that appropriate steps are taken for such review to be undertaken; Engage with all key internal stakeholders to identify outdated Regulations and or Regulations that are no longer relevant or are due for repeal and ensure that appropriate steps are taken for such repeal to be undertaken; Prepare and table to Council and relevant Committees (incl EXCO, OPCO, AREDC etc.) the Regulation Register, and progress on review on a quarterly basis.
Qualifications and Experience: ● Honours / 4 year degree in Law (NQF L8) ● Admitted Attorney or Advocate ● Minimum 4 years experience in legal field ● Minimum 2 years’ post admission experience ● Understanding and knowledge of litigation and associated pieces of legislation such as Magistrates’ Court Act, Superior Courts Act and Rules, PAIA, POPI, PAJA, ECA, ICASA Act, etc.

Purpose of the job
To analyze accounting data, determining economic, statistical, and financial metrics as well as applying that understanding when performing variance and trend analysis in order to drive process improvement and implement corrective regulatory actions.
Key Outputs: • The successful candidate will report to the Senior Manager: Market Regulation and responsibilities will include: • Develop core financial analysis and cost modelling systems to ascertain financial performance of regulated entities • Conduct development of forward-looking financial forecasts, preparation and presentation of accurate summary of expenses (e.g direct costs, indirect costs, CAPEX, OPEX) and research effective cost/price control standards applicable to network industries • Develop and perform reporting of accounting metrics that ensure financial performance, e.g. viability of different products/services in the regulatory portfolio • Develop, review and implement guidelines for the separation of accounts for regulated business as per the legislative requirements • Provide support/assistance in the review of costs, revenues, forecasts • Assist in identifying changes to be inputted into the forecasts based on actual results with details of or reference to under- or over-performance • Implement financial regulatory strategies to achieve desired business performance and regulatory compliance in support of promoting competition and fair prices • Improve regulatory efficiency and control environment, through management and assignment of cost evaluation processes and recommending corrective regulatory action • To assist the Manager: Cost Modelling in developing a consistent regulatory agenda to promote competition and enhanced economic efficiency of the ICT Sector • Participate in projects, where required, in line with the Strategic Plan and Business Plan • Prepare concise summary reports on, or action-oriented commentary and analysis on presented regulatory financials to designated management and non-financial audience •Drive recommendations for regulatory decision making to meet organizational objectives through the provisions of insightful financial analysis, interpretations, predictions, support, tools and recommendations; and clearly communicate results and recommendations to ensure clarity and optimal decision making • Present business plan and research matters to Council and EXCO as required • Liaise with internal and external stakeholders involved in the public policy and regulatory process and maintain compliance in all regulatory aspects • Draft positions papers and represent the Authority in international and regional fora and meetings on financially related research matters • Provide plain language advice on financial issues to non-financial audiences.
Qualifications and Experience • Minimum 3-year Bachelor’s degree (NQF Level 7) in Accounting / Cost Accounting / Economics / Finance / Business Management or equivalent; but a post-graduate Honours, MBA or relevant specialised Master’s degree or professional qualification like CA(SA) or CIMA CGMA is preferred • 5-7 years relevant working experience in a corporate finance or tariff modeling environment • Working knowledge of cost accounting principles and determination of cost of capital (WACC) • Working knowledge of industry data collection and collation techniques • Proven experience of developing and implementation of projects and processes • Proven track record on conducting research and drafting research reports • Proven analytical skills • Ability to engage with stakeholders at all levels.

Purpose of the job
To lead the review and competition assessment of markets in the ICT sector and take a lead in conducting economic research, economic analysis of license applications.

Purpose of the job
To lead the competition assessment of markets using sound economic law principles in the ICT sector and take a lead investigation of cases regarding possible contraventions of the Act and Regulations.

Purpose of the job
To ensure effective management of the licensing of spectrum for broadcasting and radio communications and advise on regulatory and technical matters.
Key Outputs: The successful candidate will report to the Executive - Licensing and Compliance and their responsibilities will include: ● Oversight of the Broadcasting and Radio communication Frequency Coordination functions ● Development and implementation of the Department’s Annual Business Plan ● Development and management of the Department’s allocated budget ● Development, review and implementation of the internal business processes related to the Spectrum Licensing function ● Management of the Spectrum Licensing Department’s administrative function ● Identification and management of the Spectrum Licensing Department’s Risks.● Liaison and communication with internal, external stakeholders ● Providing technical support on spectrum related matters to the Licensing and Compliance Division as well as other internal and external stakeholders as required ● Performing technical coordination with neighbouring countries ● Undertaking research to keep the Authority’s mandate on par with international technological advancements, including participating in International/Regional/National technical fora and Council Committees ● Development, implementation and leadership of projects within the Spectrum Licensing Department.

EXECUTIVE: LICENSING AND COMPLIANCE

Purpose of the job
To lead the Licensing & Compliance Division in managing and overseeing all matters relating to service licences (across broadcasting, electronic communications / telecommunications and postal services sector), spectrum licences, numbering and type approval and advise on regulatory applications and related operational matters; as well as to provide strategic leadership and management of compliance and enforcement of all legislative and regulatory requirements as prescribed in line with ICASA’s mandate in the ICT sector.
Key Outputs: The successful candidate will report to the Chief Executive Officer and their responsibilities will include: ● ICT Services Licensing - overseeing the ICT Services Licensing Unit and ensuring fulfilment of the Authority’s licensing mandate in line with inter alia Chapter 3 of the Electronic Communications Act, 2005 ● Type Approval & Numbering – overseeing the Type Approval and Numbering function; ensuring implementation of relevant technical standards for equipment and facilities as required in terms of the applicable statutes; and ensuring implementation of the requisite regulatory regime for management of numbering resources ● Spectrum Licensing – overseeing the Spectrum Licensing function; leading and directing the Authority’s execution of its mandate in respect of management of spectrum including planning, licensing and assignment in line with inter alia Chapter 5 of the Electronic Communications Act, 2005 ● Compliance and Enforcement – oversee, monitor and enforce compliance with licence terms and conditions, regulations and legislation as applicable across broadcasting, electronic communications / telecommunications and postal services sector ● Budget Management - oversee and manage the budget for the Licensing & Compliance Division ● Implementation and/or improvement of internal business processes ● Management of Division’s administrative functions ● Risk Management Identify and manage Licensing and Compliance Risk ● Strategic Planning and Execution - Contribute to the formulation and implementation of ICASA strategy.
