NATIONAL ENERGY REGULATOR (NERSA)
The National Energy Regulator (NERSA) is a regulatory authority established as a juristic person in terms of Section 3 of the National Energy Regulator Act, 2004 (Act No. 40 of 2004). NERSA’s mandate is to regulate the electricity, piped-gas and petroleum pipeline industries in terms of the Electricity Regulation Act, 2006 (Act No. 4 of 2006), Gas Act, 2001 (Act No. 48 of 2001) and Petroleum Pipelines Act, 2003 (Act No. 60 of 2003). The structure of the Energy Regulator consists of nine members, five of whom are part-time and four are full-time, including the Chief Executive Officer (CEO). The Energy Regulator is supported by a secretariat under the direction of the CEO. The Energy Regulator wishes to recruit personnel with appropriate competencies in the following area:

Salary package: R908 541.00– R1 402 317.00 per annum (CTC)

Requirements: * LLB Degree Admission as an Attorney or Advocate * Minimum of seven (7) years’ experience in the legal field * Five (5) years post admission as an Attorney or Advocate and management experience.
Strong technical knowledge of the energy industry legislation, regulations, legal processes and procedures * Drafting of legal opinions and submissions * Drafting and vetting of contracts* Civil litigation * Drafting and commenting on legislation, regulation and policy * In-depth knowledge and understanding of the energy industry specifically relating to the following legislation and regulations: Electricity Regulation Act, National Energy Regulation Act, Gas Act, Gas Regulation Levies Act, Petroleum Pipelines Act and Petroleum Pipelines Levies Act.

Purpose: Reporting to the Executive Manager - Corporate Services, the incumbent will be responsible for the provision of legal services to NERSA by providing sound legal advice according to the latest case findings and law, provide direction on litigation matters and manage the Legal Advisory Services Department.
Key responsibilities: The successful incumbent will be responsible for : * Legal advice to the Energy Regulator, its Committee, Sub-committees, the CEO’s Office and various NERSA projects: * Guide the application of legislation, regulations, rules, relevant policies and procedures by NERSA and its staff * Identify practices that could expose NERSA to legal risk and formulate corrective action/s to the relevant stakeholders * Assess legal research as required by the Energy Regulator, its Committees, Sub-committees, the CEO’s office and various NERSA projects * Formulate legal opinions and provide advice as required by the Energy Regulator, its Committees, Sub-committees, the CEO’s office and various NERSA projects * Respond to legal queries from members of the public and parties that have dealings with NERSA * Provide leadership at meetings of working groups or technical committees to ensure that decisions made at these meeting have considered legal implications for NERSA * Facilitate and oversee litigation and expropriations on behalf of NERSA * Ensure effective document management of all cases * Legal Contracts: * Prepare legally sound contracts in the appropriate NERSA format * Review and comment on contracts when necessary on behalf of NERSA * Legislation, Regulations and Policies: * Interpret and provide legal opinion or advice on current and new energy legislation, regulations and policies * Actively engage in public hearings/consultations and validate NERSA’s position in the development of energy or other relevant legislation, regulations and policies * Participate in Parliamentary Portfolio Committee (PPC) processes, as and when requested * Guide the implementation of new legislation, regulations and policies * Management of the department: * Develop a legal advisory services strategy and manage its execution * Convene regular departmental meetings to communicate the department’s strategy, its implementation, key developments, etc. * Monitor or manage the department’s budget (particularly variances) on a monthly basis * Allocate tasks to legal advisory services staff and service providers, monitor their performance, and provide support (through mentoring or coaching and giving regular and timely feedback) where it is required * Source and retain legal advisory services skills * Oversee skills and knowledge acquisition (within the legal advisory services team) through formal and less formal training and development programmes * Liaise with the HR Department in conducting performance appraisals and ensure that competency and training gaps are addressed * Manage staff performance (i.e., goals and target setting; providing performance feedback; coaching and mentoring; assessing performance; recognizing and rewarding performance; etc.) in accordance with the Performance Management and Development System * Provide continuous leadership, supervision, training and development of staff ensuring an effective and motivated team.
