CHIEF COMPLIANCE OFFICER
Type: Permanent 
Salary: The total remuneration package will be based on qualifications and experience.

The position of Chief Compliance Officer is vacant. The Chief Compliance Officer will report directly to the Principal Officer and will be based at Head Office, Pretoria.
 
The total remuneration package will be market related and is negotiable, based on qualifications and experience.
 
The role of Chief Compliance Officer is to provide strategic direction and drive the execution of the Risk Management and Compliance Strategy aligned to the overall organisation strategy, ensuring compliance by the Scheme to Legislation, the King IV Report on Corporate Governance, applicable regulations and governance controls.
 
The Chief Compliance Officer will be required to lead the Risk and Compliance Function: through the implementation of the following KPA’s

Key Performance Areas (KPAs):
  • Responsible for the development and integration of an overall Risk Management and Compliance Strategy which is aligned to the overall Scheme objectives
  • Managing and monitoring the execution of operational plans for the Risk Management, Compliance, Ethics Management, and Fraud, Waste and Abuse
  • Introducing controls aimed at ensuring compliance with the Scheme rules by Scheme members, Scheme officers and contracted service providers
  • Performing quality assurance reviews of policies and procedures to ensure effective compliance with the Scheme’s governance practice
  • Maintaining effective relationships with stakeholders while maintaining a reporting structure for the Risk and Compliance Division
  • Providing a central source of guidance and advice to the Risk, Social and Ethics Committee together with the Board and its Committee’s in respect of risk and compliance issues, including compliance with statutory regulations and with King IV
  • Developing and maintaining measures that guide and monitor ethical conduct by Trustees, Committee Members, management and staff members in the Scheme
  • Overseeing the management of trustee and employee vetting services
  •  Keeping abreast of, and when appropriate informing the Board of current governance thinking, governance best practice, both locally and internationally while ensuring that the Annual Integrated Report is aligned to same
  • Monitoring regulatory activities performed by the Council for Medical Schemes and Registrar of Medical Schemes
  • Lead the development of the Scheme’s Annual Integrated Report as part of the Scheme’s Statutory Compliance function
  • Facilitating an appropriate organisational response to legislative requirements and addressing compliance
  • Responsible for implementing methods to monitor compliance with regulatory reporting and disclosures
  • Maintaining an effective and efficient legal gate keeping function
  • Ensuring that Scheme role players are adequately trained on the requirements of pertinent legislation including the Promotion of Access to Information Act, the Financial Advisory Intermediary Services Act and the Consumer Protection Act
  • Confirming that the Scheme’s service providers are adequately accredited
  • Monitoring usage of Scheme registered trademarks by contracted providers and other entities
  • Ensuring that the appropriate scheme responses are developed to the unauthorised use of scheme registered trademarks
  • Ensuring that contractual relationships between the Scheme and participating employers are defined in accordance with Board decisions
  • Ensuring that legal documents are compiled in accordance with relevant legislature and safe guards the Scheme
  • Ensuring that sufficient protocols are in place to minimise Fraud, Waste and Abuse and to detect suspicious occurrences early
  • Ensuring compliance with environmental laws and general best practice for environmental management
 
Qualification requirements are:
  • Honours/ Postgraduate/Professional qualification at NQF8 Level in Law or equivalent in a related field;
  • Twelve (12) years of functional experience with five (5) to eight (8) years leadership in a highly strategic Governance Senior Management role which includes but is not limited to staff supervisory, budgetary, and management responsibility.
 
The following is an added advantage:
  • Knowledge of King IV Report on Corporate Governance
  • Accreditation with a relevant Compliance and/or Risk Body

Desirable
Experience in a Healthcare funding industry would be beneficial.
