Purpose of the Job:
The position is responsible for assisting with management and oversight of the Retirement Funds Governance and Trustee Conduct. The role will further support the Departmental in the development, monitoring and enforcement of the overall governance strategy for retirement funds and trustees. The person appointed in this position will report to the Departmental Head.
Requirements: A Bachelor's Degree in Law or Commerce (with a law major); with at least 7 year's relevant working experience within the Retirement Funds industry or Financial Sector, of which 2 must be at a junior management level. A good knowledge and understanding of the Pension Funds Act (PFA) and Financial Sector Regulation Act (FSRA) is a prerequisite.
• Responsible for drafting and overseeing of good governance principles and standards for funds;
• Assist with drafting and monitoring of fund governance returns;
• Monitoring of funds' ability to deliver on the six Treating Customers Fairly outcomes;
• Responsible for coordinating, arranging and managing the Annual Pension Funds Regulatory Conference;
• Provide input into the establishment, maintenance and monitoring of trustee training and qualifications;
• Propose and draft Guidance Notices and Conduct Standards in terms of the FSRA;
• Evaluate, consider and implement appropriate sanctions for trustees in cases where trustee conduct issues are detected;
• Assist the Retirement Funds Supervision Division with the implementation of appropriate enforcement actions provided for in Chapter 10 of the FSRA;
• Manage the dedicated inbox for enquiries relating to the Default Regulations;
• Responsible for the processing and evaluation of Default Regulation exemption and extension applications;
• Prescribe matters provided for in the Default Regulations;
• Provide support to the Retirement Funds Supervision Division with the presentation of cases to the Regulatory Action Forum;
• Provide assistance with drafting of the Authority's reasons in cases before the Tribunal;
• Provide the Retirement Funds Supervision Division's inputs to the various legislative enactments flowing from Twin Peaks regulation, sub-ordinate legislation and guidance for retirement funds; and
• Represent the Retirement Funds Supervision Division at external stakeholder engagements, speaking engagements and conferences; and
• Management of staff and ensure high performance culture.
