Qualification: Matric plus a Bachelor’s Degree (NQF 7) in Law or equivalent as recognised by the South African Qualifications Authority (SAQA); Active Membership of Legal Practice Council; Admitted Legal Practitioner; Postgraduate qualification will be an added advantage; and Driver’s license.
Experience: At least 6 years’ experience within the field; and At least 2 -3 years’ middle management experience in a Legal field within a State-Owned Entity or Public Service.
Description:
1. Strategic leadership for the Unit
- Produce inputs into the strategic and Annual Performance Plan;
- Timely submission of inputs into the Organisation’s Strategic Plan, and APP and prepare Department/Unit Operational;
- Develop the Unit’s Operational Plan and ensure full achievement of targets;
- Produce the Unit’s monthly, quarterly and annual reports to the Management and Board structures;
- Perform effective contract management in the area of responsibility; and
- Submit any other reports as and when required.
2.1. Financial Management
- Develop a budget for the area of responsibility and monitor expenditure;
- Implement measures to ensure financial viability, thereby delivering robust and accurate financial planning and a reporting system that incorporates a balanced budget within the area of responsibility;
- Develop initiatives aimed at eliminating waste, improving productivity and reducing operating costs within the area of responsibility;
- Develop Demand Management Plans and ensure implementation is carried out;
- Provide inputs into the Procurement Plan for the organisation; and
- Timely preparation of terms of reference (TOR) for the procurement of goods and services are timely prepared.
- Unit’s assets properly managed in accordance with stipulated guidelines and procedures.
- Manage a positive and constructive culture;
- Set performance targets for the department and regularly monitor achievement thereof (performance management). Provide feedback on the performance of the subordinates;
- Manage capacity development of subordinate(s) by providing relevant training; and
- Manage Individual Development Plans/Individual Learning Plans (IDPs/ILPs) for subordinates to promote succession and talent retention. Monitor implementation of (IDPs/ILPs)
- Contribute to the development of internal controls and systems;
- Implement and monitor internal control systems and organisational policies;
- Submission of documents (reports/requests, etc.) to the Governance Structure;
- Compliance with legislative prescripts by ensuring timeous submission of reports to the AA Structures and Management Committees; and
- Timely submission of responses to Parliamentary Questions.
- Identify, assess and monitor risks within the Unit;
- Develop a risk register for the Unit;
- Participate in fraud risk assessments and monitor the action plan;
- Manage the implementation and monitoring of internal control systems and organisational policies;
- Manage the audit of performance information; and
- Submit responses to internal and external audit queries
- Provide continuous legal advice to the CATHSSETA Board and Management;
- Draft, vet contracts, monitor performance thereof and advise on terminations that are due;
- Liaise with panel of attorneys and update litigation register monthly, quarterly, and annually on legal processes unfolding;
- Provide general legal advice and guidance to departments and units where required; and
- Monitor the implementation of legal and contract duties by parties involved; and
- Provide advisory legal services and support to the organisation;
- Provide legal support for minor labour or contractual-related matters to the organisation (e.g., CCMA, Bargaining Council, Small Claims Court, etc.);
- Maintain a register of all written legal advice previously issued for reference purposes as a repository of historical activities;
- Minimise possible litigation cases against The CATHSSETA either internally or externally by providing support and guidance; and
- Proactively analyse potential cases and minimise costs by reviewing evidence before contracting external counsel;
- Develop, maintain, and manage a contract library - prompt all with renewal and review notifications;
- Account for original contracts, while end-user and the Finance Department keep copies of the contracts for payment purposes;
- Manage that all agreements and contracts are filed safely within the CATHSSETA;
- Conduct training on Contract Management life cycles with all divisional heads;
- Draft and negotiate contracts with internal and external clients and third parties, including managing the drafting and review of MOUs, SLAs;
- Review, prepare, and amend contracts to assist and support various business activities;
- Standardise and harmonise contracts and thus create standard contracts for users within CATHSSETA;
- Prepare draft agreements and circulate to stakeholders; and
- Create and manage CATHSSETA’s internal contracts for business operations.
- Develop Compliance Policy and Framework for the organisation;
- Perform the functions designated for the Deputy Information Officer in terms of Promotion of Access to Information Act of 2000 as amended (PAIA) and ensure that all the legal requirements, such as developing a PAIA Manual and preparing Annual Reports that are submitted to the Information Regulator South Africa;
- Develop and ensure implementation of various provisions of the Protection of Personal Information Act of 2013;
- Ensure the CATHSSETA complies with relevant legal prescripts, including but not limited to the Skills Development Act, Public Finance Management Act, Treasury Regulations, the CATHSSETA’s Constitution, etc.
- Review, amend and develop internal policies in conjunction with relevant line managers to ensure alignment with Public Policy, RSA Constitution, etc.
- Ensure the CATHSSETA complies with various pieces of legislation as and when required;
- Develop procedures to comply with new and impending legislation and codes of good practice;
- Identify potential areas of compliance vulnerability, risk, and issue corrective action mitigation strategies;
- Track legislative developments and update management on legislative changes; and
- Collaborate with other departments to direct, investigate, or resolve issues of compliance.

Knowledge Required
- Excellent knowledge of the pieces of legislation and regulations governing the SETAs.
- Understanding of the planning, budgeting and reporting processes in the public sector.
- Good knowledge of King III and IV Reports on corporate governance.

- Understanding of the relationship between various Arms of the State, that is: Parliament, Executive and Judiciary.
