Qualification: Matric plus a bachelor's degree in law rated at NQF level 7 in terms of the South African Qualifications Authority (SAQA); Admission as a legal practitioner is compulsory; and Active membership with the Legal Practice Council is an added advantage.
 
Experience: At least five (5) years’ working experience in Legal and Compliance environment, of which at least three (3) years must be at a Middle Management level, dealing with litigation, civil matters, labour-related, driver’s license, and at least 2 -3 years’ experience in a SETA environment will be an added advantage.
 
Description:
  • Provide strategic leadership and direction for the Legal Services Unit of the CATHSSETA;
  • Establish, develop, direct and implement the strategic objectives and framework of the Legal Services of the CATHSSETA such that they are in alignment with the mandate as well as the statutory and regulatory requirements of the CATHSSETA;
  • Develop and manage the Unit’s operational plan and ensure implementation;
  • Manage productivity within Legal services and align business activities with strategic and operational plans;
  • Provide direction for an enabling environment to provide the CATHSSETA with best practice in Legal Services Unit;
  • Drive the Legal Services Unit to function as a collaborative, integrated function within CATHSSETA;
  • Implement polices, procedures and standards regulating the key aspects for which the Legal Services Unit of the CATHSSETA is responsible for and ensure proper assurance is applied to monitor compliance with those policies, procedures and standards;
  • Lead the implementation of decisions taken by the CATHSSETA’s Board about legal services matters;
  • Accept responsibility for driving the Legal and Compliance Unit through a formal process and personal leadership to ensure that sound corporate governance principles are adhered to throughout the Legal, Compliance Unit;
  • Provide continuous legal advice to the CATHSSETA’s Board and Management;
  • Draft, vet contracts, monitor performance thereof and advise on terminations that are due;
  • Liaise with panel of attorneys and update litigation register monthly, quarterly and annually on legal processes unfolding;
  • Develop, maintain and manage a contract library – prompt all with renewal and review notifications;
  • Account for original contracts, while the end-user & Finance Unit will keep a copy of the contracts for payment purposes;
  • Provide general legal advice and guidance to business units where required;
  • Monitor the implementation of legal and contract duties by parties involved;
  • Ensure that all agreements and contracts are filed safely within the CATHSSETA;
  • Provide advisory legal services and support to the organisation;
  • Provide legal support for minor labour or contractual-related matters to the organisation (e.g., CCMA, Bargaining Council, Small Claims Court, etc);
  • Proactively analyse potential cases and minimise costs by reviewing evidence before contracting external counsel;
  • Draft and negotiate contracts with internal and external clients and third parties, including managing the drafting and review of MOUs, SLA’s;
  • Review, prepare, and amend contracts to assist and support various business activities;
  • Standardise and harmonise contracts and thus create standard contracts for users within CATHSSETA;
  • Prepare draft agreements and circulate to stakeholders;
  • Develop Compliance Policy and Framework for due implementation;
  • Ensure the CATHSSETA Complies with all prescripts, including but not limited to the Skills Development Act, PFMA, Treasury Regulations, the CATHSSETA Constitution, etc.
  • Ensure the CATHSSETA compliance matrix is established and is adhered to;
  • Develop procedures to comply with new and impending legislation and codes;
  • Identify potential areas of compliance vulnerability and risk and issue corrective action mitigation strategies;
  • Compile monthly compliance reports for the various stakeholders;
  • Track legislative development and update management on the legislative changes;
  • Collaborate with other departments to direct, investigate or resolve issues of compliance;
  • Identify risk and develop risk mitigation plans against the operational plan of the CEO;
  • Develop the Unit’s Risk Register; and
  • Manage all the resources and assets allocated to the Unit.
