CONTRACTS MANAGER - LEGAL SERVICES
 
ACCOUNTABILITY
The Contracts Manager is accountable to the Executive Manager of Corporate Services (EMCS) of the Coega Development Corporation (CDC).
 
MANDATE
The Contracts Manager is mandated by the EMCS to manage and administer both pre and post contractual matters which include the review, drafting and negotiation of contracts, and the monitoring of the performance signed contracts until their close-out.
 
DESCRIPTION
 
SPECIFIC RESPONSIBILITIES
In furtherance of this primary responsibility, the Contracts Manager is required to undertake the following key but not limited, responsibilities:
  • Drafting, Evaluation, Negotiation and Execution of contracts;
  • Maintain contractual records and documentation such as Contracts Register, contractual changes, and other related documents for all CDC Contracts.
  • As needed, provide guidance on contract matters to project managers or other operational staff, including training to new project managers and other employees in contracting practices and procedures.
  •  Develop and implement procedures for contract management and administration in compliance with CDC’s procurement policy.
  •  Monitor compliance by company employees with established procedures. Identify areas of recurrent pressure.
  •  Monitor customer satisfaction with our terms and conditions and contracting practice and recommend changes where necessary.
  •  Monitor and oversee compliance with agreed milestones, and deliverables
  •  Assist Supply Chain Unit in ensuring formal contract close-out, extensions and/ or renewals.
 
Furthermore, you are to ensure that:
  • You are aware of and have access to the CDC’s SHEMS;
  • You are aware of your responsibilities and duties as laid out in the CDC’s SHEMS;
  • You are aware that you work in a safe and environmentally friendly manner;
  • You ensure that the company’s housekeeping standards are maintained throughout your area of responsibility;
  • You report any unsafe conditions or acts which you cannot rectify yourself to your SHE representative or to the Senior SHE Project Manager as soon as possible;
  • You report all SHE incidents which occur within your area of responsibility promptly and in the correct format;
  • You are totally familiar with your responsibilities in terms of the CDC’s emergency plan;
  • You communicate to the Senior SHE Project Manager any required changes to the SHEMS prior to implementing these changes;
  • You timeously complete and correctly record any corrective action which needs to be taken in order to rectify a SHE matter;
  • You give full co-operation to, and participate in (as required), the CDC’s internal and external SHEMS audits.
 
You have the authority to:
  • Immediately stop any person(s) on CDC property from committing an unsafe or destructive act or omission;
  • Take whatever immediate steps you deem necessary to prevent injury or environmental damage when confronted with an unsafe or destructive condition.
 
Additionally ensure that:
  • During your period of employment and subsequent thereto, you shall keep confidential and shall not make use of, directly or indirectly, and shall not disclose any of the CDC’s trade secrets or confidential information or those of its subsidiary or associate companies or those of other persons who have made disclosures to the CDC under conditions of confidentiality, other than to persons authorised by the CDC or those employed by the CDC who are required to know such secrets or to have such information for the purpose of their employment with the CDC.
  • You shall not, without the written permission of the CEO, be directly or indirectly employed for gain in any business or pursuit other than that of the CDC.  Such permission will be granted only if the CEO is satisfied that the activity is not in conflict with the CDC’s interests, and that the Employee’s ability to fulfil his/her duties to the CEO satisfaction will not be impaired.
  • It is conditional that you and/or no immediate relative or member of my household be employed by an organisation in direct competition with the CDC, without the CDC’s written approval. The CDC reserves the right to enquire as to the place of employment of my spouse or any member of my household.
  • You will abide by the CDC Code of Conduct and Ethics Policy which seeks to codify the expected ethical behavior from me, to meet the ideal of good corporate governance.
 
REQUIREMENTS
  • LLB or Equivalent and minimum of 5 years’ experience in Contracts Management
  • Knowledge of Contract Management, Tendering Procedures and Project Management.
  • Knowledge of procurement related legislation such as PFMA, PPPFA, BBBEE etc and Treasury Regulations.
  • Other related regulations such as CIDB / Statutory Safety requirements / Quality requirements, etc
  • Report writing skills, negotiation skills, communication skills, organizational skills, presentation skills and strong computer skills
  • Knowledge of ERP/Oracle system will be an advantage
  • Driver’s License Code B

QUANTITATIVE ANALYST - ICT, RESEARCH & STRATEGY
 
ACCOUNTABILITY
The Quantitative Analyst is accountable to the Chief Knowledge & Digital Officer of the Coega Development Corporation (CDC) through the Unit Head: Research Unit.
 
MANDATE
The Quantitative Analyst is mandated by the Chief Knowledge & Digital Officer - ICT, Research and Strategy to take responsibility of ensuring increased responsiveness and continuous improvement on the day-to-day operations of the Unit of the CDC.
 
DESCRIPTION
 
RESPONSIBILITIES AND OBLIGATIONS
The primary objective of the Quantitative Analyst is to assist the team in providing accurate and clear analysis that will assist the organization in optimizing opportunities. The Quantitative Analyst will be required to work within a multidisciplinary team and will assist the unit to conduct market research and economic analysis. This role requires an innovative thinker who can:
  • Provide accurate results to be used for decision making;
  • Design Mathematical/Statistical models for decision-making processes;
  • Provide technical support on the design of selected Project impact evaluations (financial and Economic) using Mathematical/statistical, quantitative economic and financial models;
  • Assist as needed in preparations for surveys and qualitative research initiatives;
  • Conduct data analysis for impact evaluation and other analytical outputs using Statistical packages, including data management and cleaning tasks; inspect, perform logic and consistency checks on, clean, merge, and transform raw data; run regression analysis and produce tables, figures, and other analytical outputs with minimum supervision;
  • Present completed work both internally and externally with minimum supervision;
  • Be able to compile Business Case and Project concepts with minimum supervision;
  • Collect primary and secondary data to produce high quality and timely research deliverables;
  • Gather Information and data through desktop research and various other methods;
  • Interpret findings of research and communicate these effectively, both verbally and in writing;
  • Be able to interact with all structures of the organization for input and presentations;
  • Present research work both internally and externally with minimum supervision;
  • Undertake other duties as required to commensurate with the level of this post.
 
COMPETENCIES AND REQUIREMENTS
  • An Honours degree in Operations Research, Financial Mathematics, Financial Economics, Econometrics or equivalent;
  • Minimum of 3 years of experience in a similar environment;
  • Experience in a consulting environment will be an advantage;
  • Willingness to travel;
  • Experience involving economic analysis, forecasting of macroeconomic and financial variables, econometric modelling or generation of macroeconomic scenarios;
  • Solid knowledge of macroeconomic and financial indicators, and an understanding of models that can be used for impact analysis or forecasting;
  • Strong knowledge in Microsoft Excel and knowledge of statistical modelling software; ·
  • Strong analytical, problem-solving, and synthesizing skills;
  • Team-oriented but able to complete tasks independently to a high standard;
  • A strong communicator, able to explain technical topics clearly and confidently to a non-technical audience;
  • Proactive, structured, organized, and detail-oriented;
  • Strong writing skills.

UNIT HEAD - LEGAL - CORPORATE SERVICES
ACCOUNTABILITY
The Unit Head: Legal Services is accountable to the Executive Manager: Corporate Services (EMCS) of the Coega Development Corporation (CDC), and indirectly to the CEO.
 
MANDATE
The Unit Head: Legal Services is mandated by the CDC Board of Directors, the CEO, and Executive Manager: Corporate Services, to lead the legal services of the CDC, including company secretariat.
 
DESCRIPTION
 
RESPONSIBILITIES AND OBLIGATIONS
  • Develop and implement a legal services strategy aligned with the strategic business objectives of the CDC;
  • Develop a legal compliance framework in order to ensure compliance with all statutory/legal obligations;
  • Adopt a proactive role in the identification, mitigation and monitoring of legal risks which might adversely impact the strategic business objectives of the CDC;
  • Provide  advice and support to the CEO and the Board on all legal matters which will directly and/or indirectly affect the organisation;
  • Draft and review all legal related policies and procedures to ensure alignment and compliance  with relevant legislation;
  • Provide legal support to CDC’s internal governance structures, the negotiations team and may participate directly in driving negotiations with prospective investors;
  • Draft contracts, conduct research and gives in writing or verbally opinions to Project Managers within the organisation requiring same;
  • Issue instructions and manage the CDC’s legal service providers;
  • Conduct internal litigation such as disciplinary hearings for the CDC;
  • Oversee the proper conduct of litigation between the CDC and external stakeholders;
  • Ensure the provision of central coordination, oversight and focus on the CDC’s risk management initiatives;
  • Perform administrative and managerial tasks relating to the section and coordinating the activities of the section.

COMPETENCIES AND REQUIREMENTS
  • Post graduate LLB or equivalent;
  • An admitted Attorney with the Right of Appearance in the High Court of SA/ Advocate;  
  • Must have minimum 5yrs+ post admission legal experience in a law firm/ similar;
  • Sound knowledge of commercial law, public law, property law, environmental law;
  • Must be capable of doing commercial litigation and opinion writing;
  • Knowledge of the IDZ and the legislations governing it;
  • Constructive dispute resolution abilities;
  • Sound knowledge of Corporate Governance  
  • Technical expertise of various sub disciplines of business risk management in the organization, from credit to market risk to operational risk;
  • Experience in commercial/ business environment;
  • A good knowledge of public sector environment;
  • High level of confidence required and an aspiring work ethic;
  • Excellent communication and problem solving skills
  • Performance driven, strategic thinker, and an effective team player;
