Purpose of the job

To provide strategic leadership to ICASA’s Engineering and Technology Division.

 

Key Outputs

The successful candidate will report to the Chief Executive Officer, and their responsibilities will include:

  • To function as the custodian of technical, engineering, and spectrum management functions; within the Authority in respect of electronic communications, broadcasting, and postal services; as prescribed in the Electronic Communications Act, Electronic Communications and Transactions Act, Broadcasting Act, Postal Services Act, and any other related legislation that may be enacted in the future.
  • To lead the development and adoption of the engineering and technology strategy for the Authority, including the identification and adoption of appropriate solutions for the effective execution of the mandate of the Authority in line with applicable legislation.
  • To be the custodian of spectrum management and spectrum resources in a manner that ensures the efficient, effective, and economical use of frequency spectrum.
  • To ensure effective spectrum monitoring in line with international best practice and ITU-R standards and guidelines.
  • To ensure the availability of appropriate engineering and technology expertise, tools, methods and logistics for spectrum planning and management, spectrum licensing, type approval licensing, spectrum monitoring, telecoms networking, and quality of service measurements.
  • To conduct research and innovative forward planning in spectrum management, telecommunications technologies, network engineering, and broadcasting so as to anticipate and cater for ongoing technological innovation.
  • To preserve and improve the accuracy of the technical data needed for spectrum allocation, allotment, and assignment.
  • To promote and advance ICASA’s interests in the ITU, other related UN bodies, and regional bodies, while contributing to South Africa’s participation and obligations within these forums.
  • To ensure cross-border cooperation with regulators of neighbouring countries.
  • To develop and update electronic communications regulations, including those related to spectrum and contribute to other regulations promoting the rollout of broadband.
  • To ensure that appropriate levels of expertise and skills are employed within the Engineering and Technology division.
  • To function as the lead for engineering and technology related engagements between the Authority and the sector it regulates.
  • To ensure that the appropriate divisional budget is compiled, monitored, and controlled.
  • To provide the Authority with a solid technical base through the expertise, tools, data, and outside relationships; to make informed decisions on relevant aspect of electronic communications, broadcasting and postal services technologies requiring regulation by ICASA.

 

Qualifications and Experience

  • A BSc/BEng Degree in Electrical or Electronic Engineering.
  • A Master’s Degree in Engineering, Electronic/Electrical Engineering, Telecommunications Engineering, ICT/Technology, or relevant discipline (NQF Level 9).
  • At least 10 years of experience in managing telecommunications systems engineering, spectrum management or ICT technology projects.
  • At least 5 years’ experience at Senior Management level in Engineering or the ICT sector.
  • 1 – 3 years’ experience at Executive level will be a strong recommendation.
  • Experience working with regional and global regulatory bodies (e.g., ITU, CRASA, ATU) will be advantageous.
  • Active Professional Engineer (Pr Eng) registration with ECSA.
  • Membership of SAIEE, IEEE or other international associations for electrical and electronic engineering practitioners will be advantageous.

EXECUTIVE: LEGAL AND CCC

Purpose of the job                                                                                             

To direct, administer, and coordinate all legal activities in accordance with the mandate of ICASA. Lead and direct staff responsible for the following functions and/or business units: Regulatory Support and Legislative Drafting; Litigation, Contracts and General Legal Support; Risk Management; Compliance and Business Continuity; and Fraud Prevention and Investigations. Assist the CEO in the development of organisation policies and goals that cover legal and risk management practices of ICASA.

 

Key Outputs: The successful candidate will report to the Chief Executive Officer and their responsibilities include:

  • Ensure provision of adequate advice, quality legal opinions, proper support, and education to internal stakeholders in a timely manner to minimize any actual or potential risk for ICASA.
  • To ensure that the appropriate divisional budget is compiled, monitored, and controlled.
  • To ensure that appropriate levels of expertise and skills are employed within the Legal and CCC division.
  • Ensure review, update and quality drafting of regulations and legal opinions in a timely manner with appropriate input from internal and external stakeholders through a holistic, integrated approach with due regard to international trends and benchmarking, where appropriate.
  • To coordinate and facilitate the Authority’s timely engagement in external inquiries, policy consultations, and other matters affecting its regulatory responsibilities.
  • Ensure pro-active management of legal action/litigation in a timely manner in the best interests of ICASA with due regard to costs.
  • Ensure proper negotiation, drafting and/or vetting of contracts in a timely manner to safeguard the rights and interests of ICASA.
  • Ensure appropriate liaison with guidance and support for the CCC in a timely manner without encroaching on its independence.
  • As a member of the EXCO Team, contribute to the formulation and implementation of ICASA strategy.
  • Operate in collaboration with and build effective relationships with ICASA management, the EXCO Team as well as ICASA Council.

 

Qualifications and Experience:

  • Master of Laws degree (NQF Level 9).
  • Admitted Attorney or Advocate.
  • 1 – 3 years’ experience at Executive level will be a strong recommendation.
  • 10 – 15 years of post-admission experience of which at least 8 years should have been at Senior Management level.
  • Proven track record within legislative framework of ICT industry.
  • At least 5 years of experience in Litigation and Commercial Law.
  • More than 5 years of experience within a regulatory environment.
  • Focus on Technology Law will be advantageous.

Purpose of the job                                                                                                               

To conduct research on regulatory policies relating to access to ICT services in line with the mandate of ICASA and its underpinning legislation. To assist the Manager in developing regulatory agenda to support the future growth path of the ICT sectors such as content and postal services.

 

Key Outputs: The successful candidate will report to the Manager: Access to ICT Services and their responsibilities will include: ● Conducting research into socio-economic issues relating to access to ICT and Postal services ● Conducting Regulatory Impact Assessment ● Keeping abreast with developments in the regulation of ICT services ● Conducting workshops and making presentations to stakeholders as and when required ● Analysis of written and oral submissions ● Compiling and writing consultative and policy documents ● Drafting regulations ● Making presentations to stakeholders on various ICT and Postal services issues.

 

Qualifications and Experience: ● Undergraduate Degree (NQF 7 or 8) in relevant fields such as Social Science, Broadcasting, Journalism, Developmental Economics or Law ● A minimum of 2 years of professional experience conducting research in the social sciences, law, broadcasting or postal policy ● Ability to engage with stakeholders at all levels.

COMPLAINTS AND COMPLIANCE COMMITTEE (CCC) MEMBER

INVITATION TO SERVE ON THE COMPLAINTS AND COMPLIANCE COMMITTEE (CCC) OF THE INDEPENDENT COMMUNICATIONS AUTHORITY OF SOUTH AFRICA: THREE (3) POSITIONS

 

The Independent Communications Authority of South Africa (ICASA) is a Chapter 9 institution established under section 192 of the Constitution of the Republic of South Africa. ICASA is responsible for the regulation of the electronic communications, broadcasting and postal industries in South Africa, as mandated by the Independent Communications Authority of South Africa Act, 2000 (Act No. 13 of 2000) (ICASA Act), and Electronic Communications Act, No 36 of 2005 (ECA).

The ICASA Council hereby calls on all independent, suitably qualified and interested persons to apply to serve as members of its Complaints and Compliance Committee (“CCC”), for a period of three (3) years. A member of the Complaints and Compliance Committee (“CCC”) must be fit and proper in accordance with section 17A (4) of the ICASA Act.

Applicants must be South African citizens.

 

Role and Responsibilities: In terms of sections 17B, 17C and 17D of the ICASA Act the CCC is vested with an obligation and powers to, amongst others, investigate, hear if appropriate, and make findings on all matters referred to it by the Authority including complaints and allegations of non-compliance with the applicable Acts and make recommendations to the Authority on what action should be taken by the Authority.

 

CCC MEMBERS

In terms of section 17A (4) a member of the Complaints and Compliance Committee must be a fit and proper person and must—

  1. have suitable qualifications and experience in communications, economics, electronic engineering, broadcasting, law, commerce, technology or public policy;
  2. be committed to the objects of this Act and the underlying statutes;
  3. not be an office-bearer or an employee of any party, movement or organisation of a party-political nature;
  4. not be an unrehabilitated insolvent;
  5. not be mentally ill or disordered;
  6. not have been convicted of an offence after the commencement of the Constitution of the Republic of South Africa, 1993 (Act No. 200 of 1993) and sentenced to imprisonment without the option of a fine; and
  7. not be subject to any disqualification contemplated in section 6 and be subject to the provisions of section 12.

 

Prospective candidates must possess one of the following expertise: -

 

1. ENGINEERING

Required qualifications: The applicants must be in possession of a postgraduate degree in Electronic Engineering / Electrical Engineering / Engineering and Technology Management or any related degree in the same field.

Experience:

  • More than ten (10) years’ experience in the electronic communications network and services environment.
  • Knowledge of radio frequency spectrum management, electronic communication numbering system, interconnection, facilities leasing, digital technologies, data communications, networking and digital electronic systems and related fields will be an added advantage. 
  • Knowledge of the legislative instruments regulating the electronic communications, broadcasting and postal in South Africa.

 

2. ECONOMICS

Required qualifications: The applicants must be in possession of a postgraduate degree in Economics or related qualification in the same field.

Experience:

  • More than ten (10) years’ experience in Economics, cost management models; accounting principles and practices, financial data analysis and reporting.
  • Knowledge of electronic communication networks and services environment, numbering systems, interconnection, facilities leasing, digital electronic systems and related fields will be an added advantage.
  • Knowledge of the legislative instruments regulating the electronic communications, broadcasting and postal in South Africa.

 

3. BROADCASTING

Required qualifications: The applicants must be in possession of a postgraduate degree in Media and Communications Studies or related degree in the same field.

Experience:

  • More than ten (10) years’ experience in line with the tenets of the Broadcasting Act No.4 of 1999 of South Africa.
  • Knowledge of media management, digital media / platforms, broadcasting content, media ethics, Public/Free-to-Air, Community, Commercial/Private Broadcasting systems, Broadcasting Signal Distribution.
  • Knowledge of the Broadcasting legislative environment regulating the sector in South Africa.

4. LAW

Required qualifications: The applicant must be an admitted attorney or advocate of the High Court of South Africa.

 

Experience:

  • More than ten (10) years’ legal experience in South Africa.
  • Knowledge and expertise to investigate and adjudicate complaints and disputes relating to the electronic communications, broadcasting and postal sector, weighing evidence and drafting findings.
  • Deep knowledge of the legislative instruments regulating the electronic communications, broadcasting and postal in South Africa; including administrative law to ensure lawful, reasonable and procedural fairness.

 

Remuneration: CCC Members will be paid such remuneration allowance as the Council of the Authority determines, in terms of Section 17(8) of the ICASA Act No. 13 of 2000 as amended. As per Treasury Regulation 20 under Government Notice No. R. 225, published in Government Gazette No. 27388 of 15 March 2005, persons employed by state organs or those serving on such Commissions and Committees of Inquiry will not be entitled to additional remuneration or fees payable for partaking in the work of the CCC.

 

Disqualification in terms of section 6 of the ICASA Act is applicable

 

Selection Procedure: Short-listed candidates will be invited for interviews, to be conducted by a panel appointed by the ICASA Council. It will be the prerogative of the Council to make the final appointment upon recommendation by the selection committee.

 

Term of Office: The successful candidates will be appointed for a three-year term of office, which is renewable for one additional term only, and will be subject to the CCC Terms of Reference and such other terms and conditions as prescribed by law and the Council of the Authority.

INVITATION TO SERVE ON THE COMPLAINTS AND COMPLIANCE COMMITTEE (CCC) OF THE INDEPENDENT COMMUNICATIONS AUTHORITY OF SOUTH AFRICA: COMPLAINTS AND COMPLIANCE COMMITTEE CHAIRPERSON VACANCY

 

The Independent Communications Authority of South Africa (ICASA) is a Chapter 9 institution established under section 192 of the Constitution of the Republic of South Africa. ICASA is responsible for the regulation of the electronic communications, broadcasting and postal industries in South Africa, as mandated by the Independent Communications Authority of South Africa Act, 2000 (Act No. 13 of 2000) (ICASA Act), and Electronic Communications Act, No 36 of 2005 (ECA).

The ICASA Council hereby calls on all independent, suitably qualified and interested persons to apply to serve as Chairperson of its Complaints and Compliance Committee (“CCC”), for a period of three (3) years. A member of the Complaints and Compliance Committee (“CCC”) must be fit and proper in accordance with section 17A (4) of the ICASA Act.

Applicants must be South African citizens.

 

Role and Responsibilities: In terms of sections 17B, 17C and 17D of the ICASA Act the CCC is vested with an obligation and powers to, amongst others, investigate, hear if appropriate, and make findings on all matters referred to it by the Authority including complaints and allegations of non-compliance with the applicable Acts and make recommendations to the Authority on what action should be taken by the Authority.

 

Requirements

The Chairperson of the Complaints and Compliance Committee must be:

  • A judge of the High Court of South Africa, whether in active service or not; or
  • An advocate or attorney with at least 10 years appropriate experience (Public and Administrative Law litigation; Technology, Media, and Telecommunications Law, Tribunal and Adjudication experience); or
  • A magistrate with at least 10 years appropriate experience, whether in active service or not.

The Chairperson of the CCC must manage the work of the CCC and preside at hearings of the CCC.

 

CCC MEMBERS

In terms of section 17A (4) a member of the Complaints and Compliance Committee must be a fit and proper person and must—

  1. have suitable qualifications and experience in communications, economics, electronic engineering, broadcasting, law, commerce, technology or public policy;
  2. be committed to the objects of this Act and the underlying statutes;
  3. not be an office-bearer or an employee of any party, movement or organisation of a party-political nature;
  4. not be an un-rehabilitated insolvent;
  5. not be mentally ill or disordered;
  6. not have been convicted of an offence after the commencement of the Constitution of the Republic of South Africa, 1993 (Act No. 200 of 1993) and sentenced to imprisonment without the option of a fine; and
  7. not be subject to any disqualification contemplated in section 6 and be subject to the provisions of section 12.

 

Remuneration: CCC Members will be paid such remuneration allowance as the Council of the Authority determines (in terms of Section 17(8) of the ICASA Act No. 13 of 2000 as amended). As per Treasury Regulation 20 under Government Notice No. R. 225, published in Government Gazette No. 27388 of 15 March 2005, persons employed by state organs or those serving on such Commissions and Committees of Inquiry will not be entitled to additional remuneration or fees payable for partaking in the work of the CCC.

 

Disqualification in terms of section 6 of the ICASA Act is applicable

 

Selection Procedure: Short-listed candidates will be invited for interviews, to be conducted by a panel appointed by the ICASA Council. It will be the prerogative of the Council to make the final appointment upon recommendation by the selection committee.

 

Term of Office: The successful candidate will be appointed for a three-year term of office, which is renewable for one additional term only, and will be subject to the CCC Terms of Reference and such other terms and conditions as prescribed by law and the Council of the Authority.
