EASTERN CAPE LEGISLATURE ADVERTISEMENT No 1 of 2024 INVITATION OF INTERESTED PERSONS TO APPLY TO SERVE AS A COMMISSIONER IN THE EASTERN CAPE PUBLIC SERVICE COMMISSION The Eastern Cape Provincial Legislature, acting in terms of section 4(3)(b) of the Public Service Commission Act, 1997 (Act No. 46 of 1997) read together with section 196 of the Constitution of the Republic of South Africa, 1996 hereby invites suitably qualified and/or experienced individuals to apply to serve as a Commissioner nominated by the Premier, in the Public Service Commission. The Public Service Commission is a Constitutional Institution, and its powers and functions are set out in section 196 of the Constitution, the Public Service Commission Act, 1997, and the Public Service Act, 1994.Those functions include inter alia the following: 1. To promote the values and principles set out in Section 195 of the Constitution throughout the Public Service; 2. To investigate, monitor and evaluate the organization and administration, and the personnel practices of the Public Service; 3. To propose measures to ensure effective and efficient performance within the Public Service; 4. To give direction aimed at ensuring that personnel procedures relating to recruitment, transfers, promotions and dismissals comply with the values and principles set out in Section 195 of the Constitution; and 5. To report in respect of its activities and the performance of its functions, including any finding it may make; and direction and advice it may give, and to provide an evaluation of the extent to which the values and principles set out in Section 195 of the Constitution are complied with. Kindly note that - (a) A Commissioner is appointed for a fixed period of 5 years which may be renewable for one additional term only by the President after approval in terms of section 196 (7) of the Constitution after being approved by the Provincial Legislature and nominated by the Premier in terms of section 196(8) of the Constitution. (b) A Commissioner must be - (i) A South African Citizen; and (ii) A fit and proper person with knowledge of, or experience in administration, management or provision of the public services. (c) A Commissioner must not hold office in any political party or any political organization. (d) A Commissioner shall not, without the approval of the President of the Republic of South Africa, perform or engage in any remunerative work outside the duties or his or her Office. MINIMUM REQUIREMENTS (a) A post-graduate degree (NQF 8) in Law/Public administration/Political Sciences or related qualification (b) A master's degree (NQF 9) in Law/Public Administration/Political Sciences or related qualification in a related field will be an added advantage. (c) Eight (08) years' experience at Senior Management level in the public service (d) Certificate of successful completion of Nyukela Public Service Senior Management Service (SMS) Pre-entry Programme issued by the National School of Government e) A candidate should have no criminal record and should not have been previously charged with and convicted of misconduct in the Public Service and must demonstrate a high level of integrity. (f) A valid driver’s licence, Code B minimum. DIRECTION TO CANDIDATES (a) Applications must be submitted using the details below on a properly completed and signed Z83 form. Applicants must please use the new Z83 Form. (b) The Z83 form must be accompanied by a comprehensive Curriculum Vitae, recently certified copies of academic qualifications and a certified copy of RSA Identity Document. (c) The certified copies of documents should have been certified not longer than six (06) months as at the date of application. (d) Failure to comply with the above directions will result in the application being disqualified. (e) All shortlisted candidates will be subjected to Security Screening and Security Clearance. (f) In the event of any negative outcomes during competency assessment, security clearance, evaluation of documents and other vetting checks, the employer reserves the right to cancel any contractual obligations entered into with the candidate (g) Applications received after the closing date will not be considered and applicants are therefore advised to ensure that their applications reach the Eastern Cape Provincial Legislature on or before the closing date. (h) Candidates in possession of foreign qualifications should attach a certificate of evaluation of their qualifications from South African E Qualifications Authority.
