APPOINTMENT TYPE: 18 Months Fixed Term Contract
POSITION OBJECTIVE:
To provide input in the development of and help implement a Legal strategy and to assist with the provision of legal services to the business, including litigation, contract vetting, etc.

MINIMUM REQUIREMENTS:
• An LLB degree or equivalent qualification.
• At least five years post admission experience preferably within the public sector or exposure to public sector advisory in a firm of attorneys.
• Must be an Admitted Attorney/Advocate.
TECHNICAL COMPETENCIES:
• Knowledge and understanding of the local governmental landscape, the regulatory and legislative operating environment.
• Knowledge and the understanding of engineering-specific legislation with which SANRAL must comply, especially FIDIC suite of contracts
• Knowledge and understanding of a wide scope of legislation which includes but is not limited to:

- Preferential Procurement Policy Framework Act,
- Public Finance Management Act,
- South African National Roads Agency SOC Limited Act,
- National Treasury’s Regulations,
- Constitution of the Republic of South Africa and all other related legislations.
KEY RESPONSIBILITIES:
• Provide internal legal advisory services in relation to various regulations and areas of expertise, including labour and employment regulations, construction and engineering, real estate, procurement and SCM and environmental legal advisory.
• Provide legal advisory services regarding real estate issues such as planning and development, land use, tenant debt, transfer duties and deeds registration.
• Provide legal advisory services and counselling on legislative issues pertaining to procurement and SCM in the public sector.
• Provide advice on construction and engineering law, including infrastructure procurement and the drafting and administering of engineering contracts.
• Contribute to the development of SANRAL’s policies, procedures and controls through the provision of legal counsel.
• Resolve SANRAL issues and/or disputes through negotiation, mediation, arbitration and litigation methods.
• Resolve litigation instances including pre-suit negotiations, arbitrations, facilitations, and appeals as they may arise.
• Resolve FIDIC-related issues and/or disputes through adjudication, litigation, arbitration, mediation or negotiation.
• Co-draft, review, update and assist with the negotiation of all types of contracts with SCM and facilitate contract finalisation and storage.
• Manage the legal compliance capability including SANRAL’s legal compliance policy, management plan, risks, training schedule and non-compliance register.
• Identify and investigate business compliance failures to aid the reporting on ethics as well as regulatory and legislative compliance.
• Develop the knowledge management training policy, plan and materials.
• Monitor and report on outside counsel performance and whether services are aligned with SANRAL’s standards.
• Provide feedback to outside counsel on performance and share performance ratings with the SCM function.
