ROAD ACCIDENT FUND (RAF) 
 
The Road Accident Fund's mission is to provide appropriate cover to all road users within the borders of South Africa; to rehabilitate and compensate persons injured as a result of motor vehicle accidents in a timely and caring manner, and to actively promote safe use of our roads.

SENIOR MANAGER: COPORATE LEGAL SERVICES
T.A.S.K GRADE 18

The role: The Senior Manager: Corporate Legal Services is accountable for providing management and technical leadership to the legal advice, litigation and contracts section in line with the strategic objectives of the organisation as determined by the Board of the RAF.
 
Key performance areas: • Strategy development and operational planning: • Guide the implementation of the overall strategic plan for the department • Guide the implementation of specific key performance indicators and measures against outcomes • Provide legal advice to business: • Manage, monitor and report on legal advice provided by the Legal Advice section • Manage and report on legal advice provided to the Board, executive management and business units • Instruct the Attorney to brief counsel on legal opinion • Consult with the Attorney and Counsel where appropriate • Conduct legal research • Maintain and update legal advice register • Manage RAF Corporate litigation: • Manage he litigation risk of the RAF • Draft and publish directives for the RAF giving effect to judgments • Prepare briefing notes for the CEO, Board and Minister of Transport • Advise the organisation on the litigation strategy to be adopted in respect of each of the managed litigated matters • Draft and vet contracts: • Draft and vet non-procurement contracts • Negotiate, draft I vet memorandums of understanding and other agreements • Institute and defend litigation actions for and against the RAF • Monitor and advise on various RAF litigation approaches and strategy • Reduction of litigated matters and litigation costs • Manage the litigation risk of the RAF • Draft and publish directives for the RAF giving effect to judgments • Manage service providers providing legal services to the Litigation Unit and to the organisation • Manage, monitor and report on contracts and other agreements drafted / vetted by the contract section • Negotiate, draft / vet memorandums of understanding and other agreements • Review and implement policy: • Oversee the development and implementation of policy, procedures and processes • Work with appropriate structures to ensure effective execution of policy and practices • Reporting: • Ensure preparation and submission of Regulation reports • Report quarterly on progress with implementation of operational plans • Ensure development of functional reporting systems, project or performance reporting for management • Financial management: • Report and review operations financial and non-financial goals • Ensure sufficient internal control measures are implemented for adherence to PFMA, RAF and other relevant legislation and regulation • Manage, monitor and control the department expense budget • Stakeholder management: • Engage with relevant internal stakeholders • Represent the Fund in relevant external activities and events • Communicate with all levels of stakeholder contact • People management: • Ensure that recruitment of operational workforce is in line with employment equity targets • Ensure the motivation, cohesiveness and alignment of the organization's team members • Manage staff in the department to ensure that they achieve their objectives in line with the strategic objectives of the RAF.
 
Qualifications and experience required: • Four (4) year degree in Law or equivalent • Admission as an Attorney of the High Court or Advocate • Right of appearance in the High Court • Postgraduate Law related qualification • At least 9 - 10 years' relevant experience in a corporate legal environment, of which 3 years must have been at management level in the area of expertise • Proven contracts drafting and negotiation experience.

SENIOR MANAGER: LEGAL ADMINISTRATION

The role: The Senior Manager: Legal Administration is accountable for overseeing the management of legal administration processes, systems and procedures in support of the legal proceedings. This role will provide legal advice by mediating, negotiation, handling and early settlement of informal conflict related matters outside the court system between RAF and other parties.
 
Key performance areas: • Strategy development and operational planning: • Provide input into the development, implementation and annual review of an overall strategic plan for the department • Provide input in determining and setting specific key performance indicators and measures against outcomes detailed in the departmental strategic plans • Ensure effective and efficient implementation of risk mitigations to reduce risk exposure • Informal mediation and dispute management: • Draw terms of a settlement that are either binding or non-binding • Recommend acceptance or rejection of compromise settlement offers - Conduct hearings to obtain information or evidence relative to the disposition of claims • Interview parties to clarify issues and develop a clearer understanding of the dispute • Analyse evidence and apply relevant laws, regulations, and policies • Prepare settlement agreements for disputants to sign • Settlement of non-litigious matters: • Recommend settlement for non-litigious matters • Where settlement fails, ensure preparation of a comprehensive opinion on conducting further litigation • Ensure that consultations are blocked, early assessment of files and early instructions to experts and assessors • Policy review and implementation: • Oversee the development and implementation of policy, procedures and processes • Work with appropriate structures to ensure effective execution of policy and practices • Reporting: • Ensure preparation and submission of Regulation reports • Report quarterly on progress with implementation of operational plans • Ensure development of functional reporting systems, project or performance reporting for management • Financial management: • Report and review operation's financial and non-financial goals • Ensure sufficient internal control measures are implemented for adherence to PFMA, RAF and other relevant legislation and regulation • Manage, monitor and control the department expense budget • Stakeholder management: • Engage with relevant internal stakeholders • Represent the Fund in relevant external activities and events • Communicate with all levels of stakeholder contact • People management: • Ensure that recruitment of operational workforce is in line with employment equity targets • Ensure the motivation, cohesiveness and alignment of the organization's team members • Manage staff in the department to ensure that they achieve their objectives in line with the strategic objectives of the RAF.
