Purpose of the Job: A Litigation manager is responsible for the overall proceeding of the litigation portion of an MVA claim. They must also handle budgeting and review legal documents. He/she must manage a team working under them and advise them on effective trail strategy, legal questioning and litigation management. He/she also have significant input in the hiring and terminating of employees. Additionally, He/she must review the overall litigation department of a region and make improvement to help it function more effectively. On occasion He/she will need to attend court and settlements. He/she may also help RAF to avoid protracted litigation process before it gets to an advanced stage. In such cases, the Senior Claims manager should be consulted on decisions that could potentially give rise to more legal costs. He/she can help the region evaluate the risk that the decision entails and determine the chances of the potential costs in the event litigation is pursued to its fullest. He/she can also provide guidance, counseling and advice on other decisions the region could make or ways in which the RAF could prevent or minimize the chances of litigation.
Key Performance Areas:
Develop and implement departmental policies, procedures and operational plans
- Provide assistance to Senior Claims Manager in formulating and implementing strategic direction of claims management.
- Ensure that work is carried out according to approved policies and procedures.
- Manage the mapping and standardization of departmental processes
Ensure that Summons, court processes, special pleas, exchange of pleadings, preparation of trials, tenders, trials, trial outcomes, appeals are accurately and efficiently processed in a timely manner and in accordance with RAF policies, processes and procedures and relevant court rules and Practice Notes
- Assume responsibility and accountability in the management of the regional claims litigation in his/her jurisdiction.
- Recommend policies and procedures and directives to lessen the negative impact of the adverse judgments.
- Publish and circulate positive judgments outcomes and document lessons learnt for sustainability of good and positive litigation strategies.
- Attend high court / magistrate's court Case flow management Meetings.
- Ensure that case flow management is adhered to.
- Ensure that diligent financial controls are put in place and adhered to.
- Comply with audit requirements.
- Comply with Risk Management Standards.
- Implement Effective Quality controls.
- Implement effective internal controls.
Ensure that Panel attorneys are managed in terms of the Service Level Agreement
- Increase number of non-trial date tenders and settlements.
- Increase use of one expert.
- Increase number of tenders before 21 and /or 10 days before trial.
- Inculcate and implement use of one expert to curb unnecessary litigation costs
Management of resources (human, finance and equipment) to ensure smooth running of the department
- Conduct performance appraisals.
- Maintain discipline and take corrective action where necessary.
- Ensure continuous development of staff/employees.
Reporting

Qualifications and Experience:
- Four (4) year Degree in Law or equivalent
- Admission as an Attorney of the High Court or Advocate.
- NQF8 (Post graduate Diploma / Honours Degree/ Professional Qualification Degree) advantageous
- Relevant 6-8 years' experience in claims environment of which 2 (two) years must have been on a management/supervisory level/area of expertise.

Remuneration
A total cost to company of minimum remuneration package applicable to this position is R766 887.00 per annum and will be negotiable commensurate with experience.
