LEGAL ADVISOR (12 MONTHS CONTRACT)

DEPARTMENTAL MISSION: To provide legal advisory services to PRASA’s business divisions, departments and subsidiaries.
OUTPUTS:
Provide advice, guidance and consultation expertise on legal matter
• Provide expert legal guidance and support to departments, divisions and subsidiaries
• Promote and drive awareness of laws and regulations that are applicable to PRASA and its subsidiaries
• Monitor legal compliance to legislation, policy and process throughout the organisation on a regular and ongoing basis
• Provide substantial practical support and advice with respect improvements of business controls and risk management
• Create and submit monthly, quarterly and annual reports on legal matters
• Ensure all process deviations are brought to the attention of the General Manager: Legal
• Draft and provide legal opinions
• Lead and participate in the undertakings of legal due exercises to identify and mitigate legal risks facing PRASA
• Build and manage effective and productive business network relationships with all relevant internal and external parties
Develop and/ or review contracts
• Draft and vet contracts
• Provide expert legal advice to all areas of the business with the drafting and negotiation of contracts
• Ensure business contracts are structured and drafted taking cognizance of the best interests of PRASA, its Divisions and Subsidiaries and minimising organizational legal risk
• Ensure all original contracts are recorded and entered into the filing system for easy access and safe keeping
• Ensure outstanding contracts are followed up for signature
Legal Representation of PRASA, its Divisions and Subsidiaries
• Manage and direct any queries or issues arising from attorneys
• Report on the progress of cases handled by external attorneys
• Ensure that out of court process settlements are considered before instructing attorneys
Financial Management
• Ensure that the costs incurred in matters under his/ her management are reasonable and fair to PRASA
• To the extent that legal matters are to be referred to external legal practitioners, to ensure that such legal matters are referred to legal practitioners as per the approved list of service providers
• Negotiate charge out rate where possible
• Monitor expenditure in relation to the significance or value of the claim or matter defended
Support development of corporate law frameworks
• Provide major contributions in the development, implementation and monitoring of corporate law frameworks, policies, procedures and uniform norms and standards for the provision of legal services and management of legal risk
• Provide expert analysis and commentary on legislation relevant to PRASA and assist in developing a risk management strategy for the organisation.
KNOWLEDGE:
Knowledge and understanding of South Africa’s Legal Framework (in particular, Public Law, Property Law, Labour Law, Constitutional Law, Tax Law) as framework e.g. drafted bills etc.

• Knowledge of Alternative Dispute Resolution processes in Engineering and Construction Contract;

• Admitted Attorney
• Certification of Admission
• Drivers Licence - Own Transport
Experience:
• 8 to 10 years’ Legal Experience
• 5 years post admission experience in Commercial/Corporate Law
