ENTERPRISE RISK AND COMPLIANCE MANAGER
Type & Grade: Market Related (6 Month Fixed Term Contract)

Department & Unit: Office of the Chief Executive Officer
 
POSITION OVERVIEW:
The primarily purpose of this role is to play in the second line of defence in order to actively drive the improvement of governance, risk management and compliance across all lines of defence within NSFAS. This role will serve to assist the GRC executive in the execution of the mandate for the unit.
 
RESPONSIBILITIES:
Contribute to Strategic Development for the Department
• Define overall governance, risk and compliance requirements for NSFAS (strategy), including an execution plan and roadmap.
• Provide input into the strategy for the department/section and participate in executive strategy discussions.
• Provide input into budget and ensure budget management.
• Develop and build a network relevant to deliver on the core mandate of the GRC with Executive and Senior Management.
• Define overarching governance, risk and compliance policy frameworks, templates and standards.
• Work across the GRC unit to strengthen the unit overall and contribute to its overall success (not just that of risk).
 
Governance and Compliance Operations
Governance
• Driving the implementation of governance and policy frameworks.
• Driving policy developments, especially where there are policy gaps in high-risk areas of the organization.
• Writing or updating policies, where this is required.
• Driving and overseeing policy maintenance and changes.
• Defining and maintaining delegation of authority.
• Defining governance and oversight committee structures and develop oversight over terms of reference.
 
Risk
• Assisting with the definition of all relevant risk frameworks and policies.
• Implementing and maintaining all relevant risk frameworks and policies.
• Assisting with the facilitating strategic risk assessment organisational wide to drive out top and strategic risks at least once a year.
• Coordinating the maintenance of risk management registers and reporting.
• Serving as the central liaison for risk champions.
• Management of risk acceptance and policy deviations processes.
 
Compliance
• Defining and managing staff declarations.
• Development and implementation of compliance universe and contributing to the combined assurance framework.
• Collating changes to regulations.
• Defining compliance assurance requirements.
• Performing compliance assessments.
 
Establishment of a Design Authority
• Set up governance structure design authority through drafting of Design Authority Charter and Terms of Reference.
• Implement a Design Authority Policy.
• Provide an oversight function on the project artefacts presented by the business.
 
Leading High-Performance Teams
• Set, control and report on key performance areas and performance contracts.
• Coach, mentor and train the team and develop reports for performance improvement, career progression and recognition purposes.
• Maintain compliance, consistency, and take corrective action when needed.
• Participate in HR and organisational recruitment processes.
 
Ensure Compliance, Monitoring, Evaluation and Sound Reporting
• Use of approved reporting templates and tools and make recommendations for improvements over time.
• Submit risk and compliance reports timeously and to required standards.
• Adhere to risk management framework and methodology and processes.
• Report on all governance, risk and compliance activities at agreed intervals
• Collate integrated reported for the unit
• Collaborate with line one and others in line two and three to bring about recommended changes to the governance, risk and control landscape, such that all lines are strengthened

DESIRED SKILLS AND EXPERIENCE
Minimum requirements:
• Bachelor’s degree in Audit, Accounting or Legal qualifications
• At least 10 years’ proven experience in the field of governance, risk management and compliance
• Proven experience of positively impacting line one and two from a governance, risk and control perspective
• Demonstrated capability in governance and risk management methodologies
• Ability to develop and maintain governance charters and quality standards, including risk management
• Experience in designing practical governance oversight structures
• Experience in risk management, including collating risk management results and mitigations, developing strategic and top risk registers, developing and overseeing risk mitigation strategies
• Experience in combine assurance models, including compliance
• Experience in shifting cultures from a governance, risk, and control perspective
• Experience in developing, maintaining and managing policy frameworks and policy writing, or assisting others with same

• Knowledge of Public Financial Management Act.

• Postgraduate degree in Audit, Accounting or Legal qualifications

The main purpose of the job is to tell the NSFAS story across multiple platforms, digital and traditional; build communication support for the aims and work of NSFAS. The role of the Manager is to develop strategies and creates trusted, objective information and inclusive messages that enable stakeholder engagements in the work of NSFAS. RESPONSIBILITIES:

• Develop and maintain publication production processes, plans, and material to promote NSFAS.
• Establish and lead the editorial and content-generating team.

Media Engagement and Reputation Management

POSITION OVERVIEW:
The purpose of this job is to facilitate the review and updating of NSFAS Eligibility Criteria/Student Funding Criteria. The job also involves the establishment of processes that enables the review of an existing policy, conducting research to inform new policy developments and updates as well as the consultation process with the sole purpose of facilitating the funding decisions for new, continuing and returning students.
 
RESPONSIBILITIES:
Facilitate Processes to Develop Student Funding Policy
• Establish the baseline for the review/development of the student funding policy
• Ensure there is policy alignment to funder rules by engaging the Funder (DHET)
• Obtain necessary inputs from the relevant stakeholders to inform the policy approach
• Lead the development of the draft policy

Perform Preliminary Research to gather inputs for the Policy

• Collaborate with the risk and compliance to define and maintain the compliance universe, compliance management processes and drive implementation
• Manage the legal service budget
• Work across the GRC unit to strengthen the unit overall and contribute to its overall success (not just that of legal services).
• Provide input into budget and ensure budget management.
 
Legal Services Operations
• Develop, implement and maintain all policies and processes for all legal services
• Support the core operations within the entity from a legal perspective, including the assistance with the drafting of relevant policies (such as the student funding policy), and MOUs with institutions and third parties to enable the work of the operations unit
• Provide labour law advice and compliance where required
• Oversee compliance to PAJA, PFMA, NCA, POPI and NSFAS Act
• Assist with contract enforcement
• Assist and manage contract dispute management
• Drafting of regulations where required
• Handling responses to the media, Parliament or other oversight type bodies
• Providing legal opinions and advice
• Providing legal support to the forensic team
• Providing legal support to the entity generally
• Overseeing and managing the ethics hotline
• Review and provide legal advice on tender documents.
• Participate on the bid evaluation committee to ensure practices followed are in line with legislation.
• Manage ongoing litigation matters and advise management accordingly.
• Liaise with relevant departments, in collaboration with the compliance officer, to ensure that where legal risks have been identified, appropriate courses of action have been taken.
• Provide legal protection and risk management advice to management
• Review and draft contracts, MOUs, and agreements in line with all statutory and/or legal requirements.
• Provide and interpret legal information.
• Conduct training and disseminate appropriate legal requirements to staff.
• Conduct legal research where needed.
• Write the terms of reference when specialist advice from external legal firms is required and manage the relationship with the legal firms to ensure performance. On an ad-hoc basis.
 
Ensure Compliance, Monitoring, Evaluation and Sound Reporting.
• Use of approved reporting templates and tools and make recommendations for improvements over time.
• Submit legal reports timeously and to required standards.

• Set, control and report on key performance areas and performance contracts.
• Coach, mentor and train the team and develop reports for performance improvement, career progression and recognition purposes.
• Maintain compliance, consistency, and take corrective action when needed.

DESIRED SKILLS AND EXPERIENCE
Minimum requirements:
• LLB
• Admitted Attorney or Advocate
• At least 10 years’ experience in the legal profession, of which at least 5 at a management level
• Must demonstrate a multi-disciplinary legal experience across some or all of the following:
▪ Sound understanding of PAJA and its application and compliance thereto
▪ Contract drafting and management
▪ Sound understanding of government supply chain regulations and requirements
▪ Labour law advice and compliance
▪ Compliance management
▪ PFMA compliance
▪ Contract enforcement

• Track record of having provided legal opinions

POSITION OVERVIEW:
The main purpose of the job is to provide professional legal and advisory services on behalf of the NSFAS. This role is secondly responsible for the review of legal and contractual risks and ensuring the efficient administration of governance-related matters.
 
RESPONSIBILITIES:
Provide Legal and Advisory Services
• Review and provide legal advice on tender documents to the Legal Lead.
• Review ongoing cases.
