NATIONAL ENERGY REGULATOR (NERSA)
 
CALL FOR NOMINATIONS FOR THE APPOINTMENT OF THE CHIEF EXECUTIVE OFFICER FOR NERSA 
 
The Minister of Mineral Resources and Energy, Honourable Gwede MANTASHE, hereby calls for nominations of persons to be considered for appointment as a Full-Time Regulator Member (FTRM) and Chief Executive Officer (CEO) of NERSA 
 
The National Energy Regulator (NERSA) is a regulatory authority established as a juristic person in terms of Section 3 of the National Energy Regulator Act, 2004 (Act No. 40 of 2004). NERSA's mandate is to regulate the electricity, piped-gas and petroleum pipeline industries in terms of the Electricity Regulation Act, 2006 (Act No. 4 of 2006), Gas Act, 2001 (Act No. 48 of 2001) and Petroleum Pipelines Act, 2003 (Act No. 60 of 2003). The structure of the Energy Regulator consists of nine members, five of whom are part-time and four are full-time, including the Chief Executive Officer (CEO). The Energy Regulator is supported by a staff under the direction of the CEO. 
 


CHIEF EXECUTIVE OFFICER (CEO) 
 

Requirements: • Minimum of Master's degree or equivalent in Engineering/ Finance/Economics/ Law/ Business Management • Minimum ten (10) years working experience including five (5) years in a Regulatory Environment and five (5) years at Executive Management • Experience in economic regulation • A sound understanding of regulatory policy in the South African context and of the South African Electricity, Piped- Gas and Petroleum Pipelines industries are of great importance. 
 
Candidates must be competent in the following: • Strategic Management Skills • Strategic Decision-making Skills • Relationship Management • Performance Management • Leadership Skills • Corporate Governance Skills 
• Financial Management Skills and Regulatory Skills. 
 

Key responsibilities: In addition to be a Full-time Regulator Member (FTRM) and subject to the directions of the Energy Regulator, the Chief Executive Officer (CEO) is also responsible for: 
1. The day-to-day management of the affairs of the Energy Regulator; 
2. The appointment of other employees and contracting with person to assist the Energy Regulator in the performance of its functions; 
3. Administrative control over the employees of the Energy Regulator; and 
4. Recommend to the Energy Regulator personnel and other resources that may be made available to the Full-Time Regulator Members responsible for the regulation of respective industries. 
 
The incumbent will: • Provide strategic and operational leadership and management of the work of NERSA staff in support of the regulatory functions of the Regulator to ensure the efficient and effective regulation of the Electricity, Piped-Gas and Petroleum Pipelines Industries • Participate in decision-making on licensee applications on prices, tariffs and charges by licensees and trading arrangements entered into in the operation of electricity supply, gas supply and petroleum pipelines operations • Participate in public consultation regarding regulations, rules, guidelines, codes of conduct, codes of practice and directives for effective regulation of the electricity supply, gas supply and petroleum pipelines industries • Maintain a comprehensive understanding of industry developments; review the physical and economic impact of licensees' energy facilities to ensure continued relevance of NERSA's decisions and regulatory framework • Participate in advising the Minister of Mineral Resources and Energy in particular, and government in general, on issues affecting the electricity, piped-gas and petroleum pipelines industries • Assist the Regulator with consultations, locally and internationally, with government departments and other bodies and institutions regarding any matter contemplated in the energy legislation for the three industries • Provide regulatory support to the Regulator, including preparing for Regulator meetings and papers for its consideration and supervising the execution of regulatory decisions of the Regulator on the Electricity, Piped-Gas and Petroleum Pipelines Industries as prescribed by legislation, regulation and stated Government policy • Prepare annually a multi-year strategic plan and an annual performance plan with budget for the planning year, including key performance indicators • Manage financial and physical resources of the Regulator economically, efficiently, effectively and in accordance with prudent management practices and in the spirit and requirements of the Public Finance Management Act • Prepare the Regulator quarterly and annual reports, and financial statements • Ensure that appropriate organisational policies, procedures, systems and processes are in place for the economic, efficient and effective operation of the Regulator.
