NATIONAL CREDIT REGULATOR (NCR)
 
The National Credit Regulator (NCR) was established as the regulator under the National Credit Act 34 of 2005 (the Act) and is responsible for the regulation of the South African credit industry. It is tasked with carrying out education, research, policy development, registration of industry participants, i.e. credit providers, credit bureaux and debt counsellors, investigation of complaints, and enforcement of the Act. The Act requires the Regulator to promote the development of an accessible credit market, particularly to address the needs of historically disadvantaged persons, low income persons, and remote, isolated or low density communities. 
 


The NCR invites applications from suitable candidates for the following position.
 
 Applications Developer & Support x2 
Paterson Grade: C-Lower 
Salary ranges from R 159 100 – R 302 300 maximum 
Requirements:
▪ The successful candidate will hold a relevant Degree/National Diploma in Information Technology/Computer Science/ Information Systems or equivalent coupled with at least 3-4 years’ experience in ICT applications development, implementation, support and maintenance / enhancements environment. 
 
Duties:
▪ Evaluating and analysing user requests and business requirements to develop applications within the MS Windows environment. 
▪ Developing business applications in line with SDLC and Agile methodologies and ensure it meets business requirements. 
▪ Analysing, developing, deploying, maintaining and supporting existing and new applications/systems. 
▪ Build and develop SQL databases which under pin the systems and perform data backup and migration. 
▪ Perform unit and integration testing and fix bugs or defects on business applications. 
▪ Assisting in user acceptance testing on the developed / changes on existing business applications. 
▪ Preparing detailed design flow charts (process flow) which show the logical operations and steps of the system and from which the program code will be built to meet the desired outcomes. 
▪ Document applications built in terms of program development, logic, coding and corrections. 
▪ Investigate, analyse and document reported defects (root cause analysis). 
▪ Assist in developing user, training manual and training user for new implemented business applications. 
▪ Research on components that can be used in the development environment. 
 
Knowledge:
▪ Applications development using C#, VB.Net,ASP.NET Web-forms, XML, MVC, HTML and other software development tools. 
▪ Knowledge of SQL Server, MySQL and Ms Access. 
▪ Report writing using Ms SQL report services. 
▪ Data analysis using SQL Server integration services. 
▪ Project management methodologies and life cycle. 
▪ Agile methodologies and life cycle. 
▪ Knowledge of SDLC. 
▪ Web and windows Services development (APIs), Service Oriented Architecture and UML. 
▪ Microsoft dynamics 2016 - Great Plains. 
▪ Integrate new software with existing systems. 
▪ Evaluate and identify new technologies for implementation. 
▪ Support, maintain and document software functionality. 
▪ File Transfer Protocol monitoring. 
 
Skills:

Salary ranges from R253 900 – R482 400 maximum
 
Requirements:
▪ The successful candidate must hold a 3-year Legal Degree and/or an Investigations related degree with at least 4 years working experience. Credit Industry, Regulatory compliance experience and an understanding of debt counselling will be an added advantage.
▪ A valid code B driver’s licence with own vehicle is essential as well as the willingness to travel.
 
Duties:
▪ Conducting investigations and monitoring of compliance with the National Credit Act and other relevant legislation.
▪ Drafting investigation mandates and reports.
▪ Questioning witnesses and conducting research.
▪ Providing information to obtain search warrants.
▪ Obtain search warrants
▪ Assessment of evidence collected and drafting of investigation reports
▪ Interpreting the National Credit Act
▪ Providing witness testimony in the National Consumer Tribunal and Courts.
▪ Keeping up to date with the latest relevant decisions of Tribunal and Courts.

▪ The successful candidate must hold an LLB Degree or an equivalent legal degree with a minimum of 2 - 3 years’ post-graduation working experience within a financial, regulatory and/or legal environment.
▪ Admission as an Attorney or Advocate as well as Credit Industry experience will be added advantage.
 
Duties:
▪ Drafting of pleadings and legal opinions.
▪ Assessing investigations reports and advising on enforcement action.
▪ Preparing and presenting cases at the National Consumer Tribunal and/or Courts.
▪ Liaising with internal and external stakeholders.
▪ Conducting research on legal issues concerning the consumer credit industry.
▪ Provide administrative and legal support to the department.
▪ Duties will also include the service and filing of documents where necessary.

SENIOR LEGAL ADVISOR- INVESTIGATIONS AND ENFORCEMENT (RE-ADVERTISEMENT)
Paterson Grade: D-Lower
Salary ranges from R405 200 – R769 900 maximum
 
Requirements:
▪ The suitable candidate must hold a four-year legal degree (LLB / BProc) Degree and must be an admitted attorney or advocate with substantial commercial litigation experience.
▪ 5 years post admission litigation experience will be an added advantage.
▪ The suitable candidate must have knowledge of debt counselling practices and processes.
▪ The suitable candidate must have a minimum of five (5) years relevant working experience in a financial, regulatory, or legal environment.
▪ A minimum of two (2) years in a supervisory role will be an added advantage.
▪ Experience working within the credit industry will serve as an added advantage.
▪ Insolvency procedure knowledge and experience will serve as an added advantage.
 
Duties:
▪ The successful candidate will deal with litigation matters, which will include complex and contentious matters, on behalf of the Investigations and Enforcement Department within the National Consumer Tribunal, High Court, SCA and Constitutional Court.
▪ Assessment of investigation reports and evidence.
▪ Drafting of pleadings and/or the necessary enforcement action on behalf of the NCR
▪ Representation and litigation of matters on behalf of the NCR and the Department at the
National Consumer Tribunal and/or Courts.
▪ Provide support to the Investigations and Enforcement Manager in ensuring the department achieves its targets.
▪ Handle complex complaints and enquiries referred by the Manager of the Department / Exco as and when required.
▪ Oversee the enforcement team (Junior and – Legal Advisors) by providing technical inputs as well as monitoring performance.
▪ Review of drafts and pleadings submitted by the enforcement team.
▪ Providing guidance/training to inspectors, legal advisors, internal and external stakeholders.
▪ Liaising with internal and external stakeholders.
▪ Contract Management and review of performance in line with service level agreements.
▪ Provide effective legal advice in respect of the NCA and other relevant legislation.
▪ Weekly, monthly and quarterly report compilation of departmental performance.
▪ Assist with development and implementation of departmental policies and procedures.
▪ Legal Risk detection.
▪ Participate in appropriate committees as and when required and provide the necessary legal inputs.
▪ Draft and review Terms of Reference, Memorandums, Contracts, Service Level Agreements, Tenders, Settlement Agreements and Opinions.
▪ Conduct research on legal matters impacting the NCA to ensure improved regulatory dispensation.
▪ Budget monitoring.
▪ Investigations and Report compilation when required to do so.
▪ Ensure timeous delivery of agreed outcomes.
