NATIONAL CREDIT REGULATOR (NCR)
 
The National Credit Regulator (NCR) was established as the regulator under the National Credit Act 34 of 2005 (the Act) and is responsible for the regulation of the South African credit industry. It is tasked with carrying out education, research, policy development, registration of industry participants, i.e. credit providers, credit bureaux, alternative dispute resolution agents, payment distribution agents and debt counsellors, investigation of complaints, and enforcement of the Act.
The Act requires the NCR to promote the development of an accessible credit market, particularly to address the needs of historically disadvantaged persons, low income persons, and remote, isolated or low density communities. 
 
The NCR invites applications from suitable candidates for the following positions:
 
 
 
 
LEGAL ADVISOR: INVESTIGATION & ENFORCEMENT 
(Re-Advertisement)
Paterson Grade: D- Lower 
Salary ranges from R405 200 – R769 900 maximum 
 
Requirements:
 The successful candidate must hold a four year Legal Degree, obtained from a South African University/ tertiary institution 
 The successful candidate must be an admitted Attorney and/or an Advocate registered with one of the provincial bar councils. The successful candidate must have a minimum of five (5) years post admission experience within a financial, regulatory and/or legal environment. 
 The successful candidate must have civil litigation experience. 
 
Duties:
 The successful candidate will deal with litigation matters, which will include complex and contentious matters, on behalf of the department from the National Consumer Tribunal, High Court, SCA and Constitutional Court. 
 Drafting of pleadings, reports and legal opinions. 
 Provide legal advice and assistance to specific issues related to the NCA and other related legislation. 
 Prepare and present cases at the National Consumer Tribunal and/or Courts. 
 Assessing investigation reports and advising on appropriate enforcement action. 
 Liaising with internal and external stakeholders. 
 Conducting research on legal issues concerning the consumer credit industry. 
 Provide administrative and legal support to the department. 
 Duties will also include the service and filing of documents and pleadings at the National Consumer Tribunal and/or Courts. 
 
Technical Skills: 
 Knowledge of the National Credit Act and related legislation will be an added advantage. 
 Knowledge of debt counselling procedure and provisions will be an added advantage.
 Understanding of court processes. 
 Administrative, research, and negotiation skills will be an added advantage.

LEGAL ADVISOR – COMPLAINTS
Paterson Grade: D-Lower
Salary ranges from R405 200 – R769 900 maximum
 
Requirements:
 The successful candidate must hold a relevant Legal Degree (BProc and/or LLB) and a minimum of 2 years post admission experience as an Attorney or Advocate working in a litigation environment.
 A minimum of 1 year experience within a Regulatory Environment will be an added advantage.
 
Duties:
 Effectively dealing with general and debt counselling complaints in accordance with the National Credit Act.
 Assessing investigation reports and advising on enforcement action to be taken.
 Preparing and presenting cases at the tribunal and/ courts.
 Provision of legal advice on specific issues related to the National Credit Act and other related legislation.
 Carrying out external communications and presentations related to the National Credit Act.
 Attending meetings with external parties on behalf of the department.
 Drafting agreements, memoranda and legal briefs on behalf of the department and the NCR as and when required.
 Research into issues and topics relevant to the NCR within the credit market.
 Providing training to internal staff on the National Credit Act, court decisions and related pieces of legislation.

LEGAL ADVISOR: DEBT COUNSELLING (RE-ADVERTISEMENT)
Paterson Grade: D-Lower
Salary ranges from R 405 200 – R 769 900 maximum
 
Requirements:
 The successful candidate must hold a relevant four years Legal Degree, admission as an Attorney or Advocate and a minimum of 5 years relevant working experience in a financial, regulatory or legal environment.
 A minimum of 3 years’ debt counselling process experience.
 
Duties:
 Provide effective legal advice on debt counselling and payment distribution related matters in relation to the National Credit Act and relevant legislation.
 Provide administrative and legal support to the debt counselling department and industry.
 Participate in appropriate committees as and when required and provide input from a legal perspective.
 Be a custodian of the departmental investigation and enforcement processes and mandate.
 Draft and review terms of reference, contracts/service level agreements and memorandum of understanding as and when required.
 Liaise with appointed service providers supporting the department on legal related matters and monitor their performance and service rendered in line with the service level agreement.
 Provide legal support on the compliance monitoring processes of debt counsellors, credit providers and payment distribution agents.
 Draft legal documents, legal opinions and represent the department at the NCT as and when required.
 Be responsible for providing oversight on the DC training course offered by NCR appointed training service providers (this includes monitoring of MOU provisions, revision of the course as and when necessary and others)
 Conduct research on legal matters impacting debt counselling provisions to ensure an improved regulatory dispensation.
 Monitor trends and practices in the debt counselling industry and recommend intervening strategies where necessary to be undertaken.
 Conduct training/information sharing sessions with internal and external stakeholders on related matters.
 Draft debt counselling guidelines as and when required.
 Conduct and maintain effective stakeholder engagement
 
Knowledge:
 National Credit Act and related legislation;

DEBT COUNSELLING ADMINISTRATOR
Paterson Grade: B-Upper
Salary ranges from R103 300 – R185 900 Maximum
 
Requirements:
 A suitable candidate must have a minimum of one (1) year post matric qualification in office or general administration/ business or equivalent with at least two (2) years relevant debt counselling experience.
 A debt counselling course certificate will be an added advantage.
 
Duties:
 Provide administrative support on the departmental compliance monitoring function for debt counsellors, credit providers and payment distribution agents.
 Provide administrative support to debt counsellors, credit providers and payment distribution agents where necessary.
 Support the monitoring officers and payment distribution analysts within the department.
 Receive and manage transfer requests of consumers under debt counselling.
 Participate in the lapsing process of debt counsellors.
 Maintain and control a functional filling and storage system.
 Take minutes during meetings.
 Resolve Debt Help System related queries.
 Send out communiqué to all industry participants.
 Liaise with other departments on debt counselling related issues.
 
Knowledge:
 National Credit Act, particularly the debt counselling provisions.
 General administrative principles.

AUDIT AND RISK MANAGEMENT COMMITTEE MEMBERS X 1 WITH INFORMATION TECHNOLOGY EXPERTISE X2
 
Requirements:
A relevant Postgraduate qualification in Information, Communication & Technology with ten (10) years executive experience of which five (5) years is as a Board Member gained from the Regulatory environment.
Preference will be given to candidates who are Executives or former Executives with sufficient knowledge and experience in governance frameworks, decision structures, governance processes, reporting structures, policies and standards, compliance, risk mitigation and internal controls.
In addition to the above, the applicant must have extensive expertise in ICT governance, strategy & its implementation and ICT management and mitigation of ICT risks. Knowledge and understanding of King III Report on Corporate Governance. Well-developed business acumen and leadership skills.

Responsibilities:
The Audit and Risk Management Committee is an advisory committee that assists the NCR in fulfilling its oversight responsibilities with regard to internal controls, risk management and governance.
 
The committee will be responsible for assisting the CEO who is the Accounting Authority in the effective execution of her/his responsibilities as well as regulate and discharge all its responsibilities as contained in the Audit and Risk Management Committee charter. The Audit and Risk Management Committee will meet at least four times per year.
