NATIONAL CREDIT REGULATOR (NCR)
The National Credit Regulator (NCR) was established as the regulator under the National Credit Act 34 of 2005 (the Act) and is responsible for the regulation of the South African credit industry. It is tasked with carrying out education, research, policy development, registration of industry participants, i.e. credit providers, credit bureaux, alternative dispute resolution agents, payment distribution agents and debt counsellors, investigation of complaints, and enforcement of the Act.
The Act requires the NCR to promote the development of an accessible credit market, particularly to address the needs of historically disadvantaged persons, low income persons, and remote, isolated or low density communities.
The NCR invites applications from suitable candidates for the following positions:
JUNIOR LEGAL ADVISOR: COMPLAINTS
Paterson Grade: C-Lower
Salary Ranges from R159 100 – R302 300 maximum
Requirements:
▪ The successful candidate will have an LLB or relevant Legal Degree and at least two (2) years’ experience in a similar position with a commercial or credit environment.
▪ Admission as an attorney will be an added advantage.
Duties:
▪ Effectively dealing with general and debt counselling complaints in accordance with the National Credit Act.
▪ Implementing an in-house complaints handling process in accordance with the National Credit Act.
▪ Attending meetings with external parties on behalf of the department.
▪ Advising on enforcement action to be taken when necessary.
▪ Assisting with preparation and presentation of cases at the Tribunal.
▪ Provision of legal advice on specific issues related to the National Credit Act.
▪ Research into issues and topics relevant to the NCR within the credit market.
▪ Participating in team activities aimed at improving customer satisfaction and business performance.
Knowledge:

Requirements:
▪ The successful candidate must hold a four year Legal Degree, obtained from a South African University/ tertiary institution
▪ The successful candidate must be an admitted Attorney and/or an Advocate registered with one of the provincial bar councils. The successful candidate must have a minimum of five (5) years post admission experience within a financial, regulatory and/or legal environment.
▪ The successful candidate must have civil litigation experience acquired within a legal practice.
Duties:
▪ The successful candidate will deal with litigation matters, which will include complex and contentious matters, on behalf of the department from the National Consumer Tribunal, High Court, SCA and Constitutional Court.
▪ Drafting of pleadings, reports and legal opinions.
▪ Provide legal advice and assistance to specific issues related to the NCA and other related legislation.
▪ Prepare and present cases at the National Consumer Tribunal and/or Courts.
▪ Assessing investigation reports and advising on appropriate enforcement action.
▪ Liaising with internal and external stakeholders.
▪ Conducting research on legal issues concerning the consumer credit industry.
▪ Provide administrative and legal support to the department.
▪ Duties will also include the service and filing of documents and pleadings at the National Consumer Tribunal and/or Courts.
Technical Skills:

PROCUREMENT INTERN
Stipend: R5391.00 per month
Requirements:
• The candidate must have a relevant 3-year tertiary qualification in Supply Chain Management, Logistics, Finance or equivalent qualification.

Duties:
• Assist with the SCM office administration including meeting bookings for the committees.
• Assisting in the documents allocation/ circulation during tender evaluations including booking meeting venue in a timely manner.
• Assist to prepare monthly and quarterly SCM reports.
• Execute the complete Competitive Open Tender, RFI and RFQ processes including accurate capturing of scores.
• Ensure that procurement processes within different departments are adhered to with regards to compliance and Internal controls.
• Ensure that all the tender submission prequalification checks and verification are performed on time and loaded on the NCR website
• Responsible for obtaining and analysing quotations from suppliers, do the scoring according to the PPPFA and follow-up on orders to ensure on-time delivery.
• Maintaining a contract register by updating it for new contracts, amendments, expired contracts and with reminders.
• Maintain tender register and Purchase order register.
• Prepare BBBEE Spend report as and when required.
• Check, verify supplier details and tax compliance status on National Treasury central supplier database.
• Ensure that all the departmental documents are properly filed for audit purposes.

SENIOR LEGAL ADVISOR: INVESTIGATION AND ENFORCEMENT

Requirements:
▪ The suitable candidate must hold a four-year legal degree (LLB / BProc) Degree and must be an admitted attorney or advocate with substantial commercial litigation experience.
▪ The suitable candidate must have at least 5 years post admission litigation experience.
▪ The suitable candidate must have knowledge of debt counselling practices and processes.
▪ The suitable candidate must have a minimum of five (5) years relevant working experience in a financial, regulatory or legal environment.
▪ A minimum of two (2) years in a supervisory role will be an added advantage.
▪ Experience working within the credit industry will serve as an added advantage.
▪ Insolvency procedure knowledge and experience will serve as an added advantage.
Duties:
▪ The successful candidate will deal with litigation matters, which will include complex and contentious matters, on behalf of the Investigations and Enforcement Department within the National Consumer Tribunal, High Court, SCA and Constitutional Court.
▪ Assessment of investigation reports and evidence.
▪ Drafting of pleadings and/or the necessary enforcement action on behalf of the NCR
▪ Representation and litigation of matters on behalf of the NCR and the Department at the National Consumer Tribunal and/or Courts.
▪ Provide support to the Investigations and Enforcement Manager in ensuring the department achieves its targets.
▪ Handle complex complaints and enquiries referred by the Manager of the Department / Exco as and when required.
▪ Oversee the enforcement team (Junior and – Legal Advisors) by providing technical inputs as well as monitoring performance.
▪ Review of drafts and pleadings submitted by the enforcement team.
▪ Providing guidance/training to inspectors, legal advisors, internal and external stakeholders.
▪ Liaising with internal and external stakeholders.
▪ Contract Management and review of performance in line with service level agreements.
