NATIONAL CREDIT REGULATOR (NCR)
 
The National Credit Regulator (NCR) was established as the regulator under the National Credit Act 34 of 2005 (the Act) and is responsible for the regulation of the South African credit industry. It is tasked with carrying out education, research, policy development, registration of industry participants, i.e. credit providers, credit bureaux, alternative dispute resolution agents, payment distribution agents and debt counsellors, investigation of complaints, and enforcement of the Act.
The Act requires the NCR to promote the development of an accessible credit market, particularly to address the needs of historically disadvantaged persons, low income persons, and remote, isolated or low density communities. 
 
The NCR invites applications from suitable candidates for the following positions:
 
 
 
JUNIOR INSPECTOR - INVESTIGATION AND ENFORCEMENT (RE-ADVERTISEMENT)
Paterson Grade: C-Lower
Salary ranges from R159 100 – R302 300 maximum
 
Requirements:
Education
• The successful candidate must hold a 3-year legal degree, investigations related degree or an equivalent qualification.
Additional
• A valid code B driver’s license
• 3 - 5 years’ investigative and/or NCA and/or experience within a regulatory environment is essential.
 
Duties:
• Conducting investigations and monitoring of compliance with the National Credit Act.
• Drafting investigation mandates and reports.
• Questioning witnesses and conducting research.
• Providing information in order to obtain search warrants.
• Keeping up to date with the latest relevant decisions of tribunals and courts.
• Continuous improvement.
 
Technical skills:
• Excellent report writing ability.
• Evaluative and problem-solving skills.
• Ability to apply law to facts.
• Good Computer skills.
• Understanding of the South African consumer credit market.

SENIOR LEGAL ADVISOR: INVESTIGATION AND ENFORCEMENT (RE-ADVERTISEMENT)
Paterson Grade: D-Lower
Salary ranges from R405 200 – R769 900 maximum
 
Requirements:
▪ The suitable candidate must hold a four-year legal degree (LLB / BProc) Degree and must be an admitted attorney or advocate with substantial commercial litigation experience.
▪ 5 years post admission litigation experience will be an added advantage.
▪ The suitable candidate must have knowledge of debt counselling practices and processes.
▪ The suitable candidate must have a minimum of five (5) years relevant working experience in a financial, regulatory, or legal environment.
▪ A minimum of two (2) years in a supervisory role will be an added advantage.
▪ Experience working within the credit industry will serve as an added advantage.
▪ Insolvency procedure knowledge and experience will serve as an added advantage.
 
Duties:
▪ The successful candidate will deal with litigation matters, which will include complex and contentious matters, on behalf of the Investigations and Enforcement Department within the National Consumer Tribunal, High Court, SCA and Constitutional Court.
▪ Assessment of investigation reports and evidence.
▪ Drafting of pleadings and/or the necessary enforcement action on behalf of the NCR
▪ Representation and litigation of matters on behalf of the NCR and the Department at the National Consumer Tribunal and/or Courts.
▪ Provide support to the Investigations and Enforcement Manager in ensuring the department achieves its targets.
▪ Handle complex complaints and enquiries referred by the Manager of the Department / Exco as and when required.
▪ Oversee the enforcement team (Junior and – Legal Advisors) by providing technical inputs as well as monitoring performance.
▪ Review of drafts and pleadings submitted by the enforcement team.
▪ Providing guidance/training to inspectors, legal advisors, internal and external stakeholders.
▪ Liaising with internal and external stakeholders.
▪ Contract Management and review of performance in line with service level agreements.
▪ Provide effective legal advice in respect of the NCA and other relevant legislation.
▪ Weekly, monthly and quarterly report compilation of departmental performance.
▪ Assist with development and implementation of departmental policies and procedures.
▪ Legal Risk detection.
▪ Participate in appropriate committees as and when required and provide the necessary legal inputs.
▪ Draft and review Terms of Reference, Memorandums, Contracts, Service Level
Agreements, Tenders, Settlement Agreements and Opinions.
▪ Conduct research on legal matters impacting the NCA to ensure improved regulatory dispensation.
▪ Budget monitoring.
▪ Investigations and Report compilation when required to do so.
▪ Ensure timeous delivery of agreed outcomes
 
Technical Skills:

• The suitable candidate must hold B.com law/ LLB with 2 years relevant working experience in a regulatory or compliance environment.
 
Duties:
• Conducting compliance monitoring through desktop exercises, virtual or onsite visits;
• Conducting market conduct analysis;
• Drafting, issuing and enforcing compliance notices;
• Monitoring submissions and analysing statutory reports;
• Conducting workshops to credit providers and alternative dispute resolution agents;
• Drafting compliance monitoring reports.

MANAGER: RISK AND AUDIT SERVICES
Paterson Grade: D-Upper
Salary ranges from R646 500 – R 1 228 400 maximum
 
Requirements:
▪ The successful candidate must hold a degree in risk/audit/commerce/operations/finance/business administration/management or equivalent qualification with a minimum of 5 years relevant experience in the public sector.
▪ Managerial/supervisory experience is a must and experience in a regulatory environment will be an added advantage.
▪ Advanced qualification and/or certification in audit and risk will be an added advantage.
 
Duties:
▪ Provide leadership and set out clear vision of the risk and audit department of the NCR.
▪ Provide oversight to the overall and related risk and audit services of the NCR.
▪ Develop and implement the NCR risk management framework (strategic and operational).
▪ Periodic review of the strategic and operational risk registers.
▪ Prepare reports for the Audit and Risk Management Committee.
▪ Develop, implement, maintain and monitor business continuity plan for the NCR.
▪ Manage and coordinate the outsourced internal audit function of the NCR.
▪ Monitor management’s commitment and implementation of corrective measures to address audit findings.
▪ Ensure that the organisation is appraised of pending regulatory changes, trends, and best practices and assess the potential impact of these changes to the organisational policies and procedures.
▪ Draft the strategic and annual performance plans (APP) of the NCR.
▪ Lead the process for the development of the NCR operational plans aligned to the strategic and annual performance plans.
▪ Develop and implement performance monitoring and evaluation measures to ensure achievement of the targets set in the APP and overall performance of the NCR.
▪ Monitor the performance information for the NCR.
▪ Ensure adherence to the dtic annual compliance calendar.
▪ Ensure accurate and timeous reporting at all levels.
▪ Develop and/or update and implement policies and procedures for the operations of the risk and audit services department.
▪ Monitor compliance to policies, procedures and systems that support the operations of the department.
▪ Perform contract management of related contracts for the department.
