The Information Regulator (Regulator) is a juristic person established in terms of Section 39 of the Protection of Personal Information Act 4 of 2013 (POPIA) which enjoins the Regulator to be independent and impartial and to perform its functions and exercise its powers without fear, favour or prejudice. It is accountable to the National Assembly and has jurisdiction throughout the Republic of South Africa. The Regulator is responsible for the promotion and protection of the right to privacy as it relates to the protection of personal information and right of access to information. In this regard, it exercises its powers and performs its functions in accordance with POPIA and the Promotion of Access to Information Act 2 of 2000 as amended (PAIA). The Regulator consists of five (5) Members namely: the Chairperson and four (4) ordinary Members appointed by the President of the Republic of South Africa for a five (5) year term. The Chairperson and two (2) ordinary Members are appointed on a full-time and the other two (2) Members on a part-time basis. Section 47 of POPIA empowers the Regulator to establish its own administration to assist it in the performance of its functions. In this regard, the Regulator must appoint the Chief Executive Officer (CEO) and other staff members to assist it in the performance of its functions. The Head Office of the Regulator is situated in Braamfotein, Johannesburg. COMPLAINTS AND INVESTIGATIONS OFFICER: POPIA (2 POSITIONS) 
DIVISION: POPIA

SALARY LEVEL: NINE (09)

SALARY: R468 459.00 (Basic salary per annum plus benefits) 
The successful candidate will be required to sign a performance agreement annually.
 
REQUIREMENTS
  • Matric certificate plus a 4-year Law Degree at National Qualifications Framework (NQF) Level 7 or 8 as recognised by South African Qualifications Authority (SAQA); 
  • Minimum of three (3) to five (5) years in conducting of investigations preferably within a regulatory environment; 
  • Technical and practical knowledge of the Protection of Personal Information Act 4 of 2013; and 
  • Experience in alternative dispute resolution will be an added advantage. 
 
SKILLS AND COMPETENCIES REQUIRED 
Knowledge of Protection of Personal Information Act No. 4 of 2013 Act No. 4 of 2013, the Constitution of the Republic of South Africa Act 108 1996, Promotion of Access to Information Act 2 of 2000 and its Regulations, Promotion of Administrative Justice Act 3 of 2000, A good knowledge and understanding of the law of evidence. Ability to work under pressure, able to work independently and within a team. Good office management and administration skills, excellent telephone etiquette, computer literacy with advanced knowledge of Microsoft packages and good typing skills, ability to conduct basic research, 
Time management, Analytical skills and pay attention to details, Interpersonal relationship, Excellent Communication (writing and verbal) skills with proven experience in reporting writing. 
 
KEY PERFORMANCE AREAS 
  • Ensure compliance with applicable protocols and prescribed standard operating procedures, including confidentiality and non-abuse of investigation powers. 
  • Identify and implement methods to improve efficiency and quality investigation of complaints. 
  • Draft and execute investigation plans with clear and reasonable timelines. 
  • Assess complaints in terms of POPIA. 
  • Conduct quality investigations into alleged breaches of POPIA (gathering all relevant, admissible evidence and analysing such evidence). 
  • Resolving complaints by means of dispute resolution mechanisms, i.e. settlement, mediation and/or conciliation. 
  • Drafting of pre-investigation reports, investigation reports and closing reports. 
  • Conduct mediation sessions with data subjects and responsible parties 
  • Draft, submit investigation reports to the Enforcement Committee 
  • Liaise directly with various internal and external stakeholders 
  • Providing reasonable assistance to any person(s) who wishes to make a complaint to the Regulator. 
  • Respond to enquiries by the responsible parties; 
  • Various other duties as may be determined from time to time by the Regulator.

  • Perform monitoring of compliance activities as assigned; 
  • Draft, submit and communicate the outcomes of an assessment in terms of section 91 of POPIA;
