The Housing Development Agency (HDA) is a national public sector development agency that acquires and prepares land as well as develops the land and project manages the development of housing and human settlements. We carry out our activities in partnership with a range of stakeholders including national, provincial and local government and municipalities, as well as with communities, developers, financiers and other affected parties. Established in 2009, the Agency was established by an Act of Parliament in 2008 and is accountable through its Board to the Minister of Human Settlements. The HDA has the following 5-year fixed term contract position:
MANAGER: CORPORATE LEGAL
Location: Head Office – Johannesburg
Reporting Line: Head: Corporate Support

Main Purpose: To provide the HDA with accurate and relevant legal, compliance management and advice to minimise legal risks. To ensure effective contractual arrangements and statutory compliance for the HAD
Key Performance Areas:
1. Strategic Management
• Review the HDA strategy from a legal perspective and ensure compliance
• Develop the HDA legal department with special emphasis on contractual, land legal and intergovernmental relations and legal compliance
• Develop implementation plans to ensure that the HDA legal strategy is implemented
• Monitor, manage and implement the plans to ensure that the legal strategy is achieved
2. Contract Management
• Drafting and/or reviewing of all contracts for the HDA including but not limited to:
o Commercial agreements
o Service provider contracts
o Land purchases and disposal contracts
o Land and building management contracts
o Service level agreements
o Project management agreements
o Memoranda of Understanding
o Intergovernmental relationship related contracts
o Terms and Conditions of Employment contracts
o MTOP’s, IP etc.
• Managing and responsible for the reviewing of all contracts signed by the HDA
• Provide input and advice on appropriateness of all contracts and any other agreements and recommends any required amendments
• Guide the development of strategic contracting and contract management approaches
• Develop process to support the HDA with contract management
• Recommend all contracts for signature or amendments to the authorized HDA signatories
3. Legal Management
• Review and interpret relevant documentation, statutes and information in order to determine the appropriate HDA position
• Provide legal advice to all HDA departments
• Review legal and contractual environment and identify potential risks
• Provide advice to manage legal risk against the HDA
• Review of all correspondence from CEO to any external stakeholder
• Provide advice on any disputes, litigation or arbitration related matters
• Represent HDA in litigation and dispute resolution processes and procedures as appropriate (internally and externally)
• Manage service providers providing legal advice or representation to HDA
• Represent the HDA in providing legal support and specialist advice to stakeholders and partners
• Participate in and contribute to the IGR legal forum
• Represent the HDA in internal and external litigation and dispute matters
• Be well versed in administrative and employment law and applicable legislation
4. Land Legal Management
• Ensure that effective legal agreements are in place for all land and properties under the HDA
• Review and assess all land agreements
5. Service Provider Management
• Establish legal panel for respective areas of expertise
• Procure legal service providers
• Instruct and manage legal service providers
• Monitor performance in line with briefs provided
• Manage all litigation undertaken by service providers
• Manage legal expenditure on service providers in line with the approved budgets
6. Statutory Compliance and Governance
• Ensure that the HDA regulations are relevant and updated to enable the HDA to carry out its mandate as per HDA act
• Review statutes and policies to ensure alignment to legislation and regulations
• Ensure HDA compliance with relevant legislation
• Review statutes and policies aligned to legislation and regulations
• Interpret statutes and potential implications for the HDA
• Identify legal obligations and risks for the HDA
• Develop and review policies and procedures to ensure legal compliance
• Ensure appropriate implementation by the HDA of appropriate legislation and regulations
• Ensure HDA complies with relevant legislation
• Management of all legal actives within the HDA
• Support the Management of all litigation within the HDA
7. People Management
• Select, assign, lead and manage people
• Set clear objectives for self and others and measure achievements against these objectives through implementation of the performance management systems
• Build and manage relationships with staff members
• Manage and support staff development
• Implement HDA HR policies and procedures as required
8. Requirements
• Admitted as an attorney or advocate of the high court required
• 5-10 years post qualification experience required
• Contracts drafting and management experience required
• Knowledge, insight and experience of the private sector construction environment and/or public sector human settlement environments would be preferable
• Must have good understanding of the PFMA

Main Purpose:
To support the CEO’s Office with providing strategic and operational direction in the various programmes within the HDA and support the CEO in implementing an effective human settlements delivery model to drive the delivery of the HDA mandate.
Key Responsible Areas
1. Strategic Vision and Leadership
• Define and develop the existing strategic vision for the HDA with input from the CEO, Board, Management, and sector key role players.
• Communicate strategic vision to internal and external stakeholders.
• Develop and continuously implement a culture of performance, critical assessment, accountability, and responsibility within the entire organisation.
• Have the insight to recognise the property and build environment opportunities and steer the HDA into a flexible and innovative industry leader.
• Assist the CEO to creating value to the key and strategic shareholders.
• Acts as a strategic partner on the leadership team and works closely with the team to ensure they are meeting performance expectations.
• Drive the delivering against key business metrics.
• Provide methods to improve quality, efficiency, and productivity as well as cost containment processes.
• Works collaboratively to develop and/or improve systems, processes, controls, and procedures that improve the overall efficiency of the HDA and ensure excellent services.
• Work autonomously while ensuring CEO expectations are readily met.
• Holistic understanding of the South African property development sector as a whole.
2. Operational Strategy
• Manager and oversee the core business delivery and assist the CEO in ensuring that the annual performance plan targets are achieved.
• Support and monitoring of the functionally integrated business plan that is aligned to strategic vision.
• Coordinate with the CEO the implement of the organisation’s strategies within required timeframe, within the relevant regulations.
• Assist with reviewing business reports required to the Board and other key stakeholders.
• Assist the CEO with building an effective, aligned, integrated, dynamic and high-performance management team.
• Oversee performance of HDA’s deliverables to ensure achievement of strategic plans, objectives and goals and provide monthly reports to the CEO.
• Assist the CEO with identifying performance gaps and assist with addressing with relevant stakeholders in order to fast-track project delivery.
• The incumbent must have the ability to establish and grow the HDA’s role as a developer of human settlements.
• Build and maintain a strong stakeholder network of potential key stakeholders, funders, and partners.
• Develop the HDA to deliver its mandate, achieve its reputational goals and financial sustainability goals.

4. Built Environment Management
• Oversee the development and presentation of project proposals across the HDA.
• Oversee the development and project implementation processes.
5. Programme Integration and Monitoring
• Coordinate the integrated functioning of all operational functions.
• Oversee the integration and alignment of various departments and their operational plans
• Address any challenges to CEO to mitigate.

8. Requirements
• Civil engineering, project management or construction / built management Degree required.
• A master’s degree, e.g., MBA, MBL will be an advantage.
• 3-5 years Senior Management experience required.
• Experience in government infrastructure development required.
• Knowledge of MFMA and PFMA.
• Knowledge of iDMSS and/or other infrastructure procurement systems.
• Experience in the human settlement’s environment with particular emphasis on development of land for human settlement.
• Demonstrated implementation of values-based management and adherence to corporate governance principles.
• Familiar and experience with the Intergovernmental Relations Framework.
• Familiarity with public sector land asset management legislation and regulations.

• Provide advice and assistance to others in order to ensure their compliance with policy and governance procedures
• Identify areas of non-compliance and implement corrective action

• Review quality improvement review findings, and formulate recommendations to improve the quality standards
6. Requirements
• A relevant qualification (degree or similar) in the Public Administration, Development, Development Finance, or similar fields is required (i.e., Bachelor of Arts Monitoring and Evaluation, Strategic Planning, Development Studies, Business Development and Finance etc) is required
• An honours is required
• Understanding of Government Planning and Business Planning Processes
• Experience in performing audits will be an added advantage
• Excellent report writing and communication skills
• Minimum 8 years of work experience in Business Planning, Strategic Planning, Financial Reporting and analysis, Monitoring and Reporting Project Management
• Experience in Human Settlements sector will be an advantage
• Valid driver’s license and willingness to travel
• Competent at MS Office, MS Excel and other Innovation tools

1. Accounts Receivable:
• Follow up on capex claims with the provincial department.
• Oversee that all queries from clients are attended to.
• Oversee customer statements or invoices are submitted timeously to the clients.
2. Accounts Payable:
• Receive project invoices and review for compliance in applicable financial policies and procedures, delegations of authority and capital expenditure submission standards.
• Reconcile invoices to statements before submitting for payment and ensure that all outstanding invoices are followed up.
• Support finance in the provision of financial information on projects as and when required.
• Ensure the completeness, accuracy and timeous processing of project transactions, e.g., that creditors are paid within 30 days.
3. Projects Expenditure Compliance:
• Ensure construction invoices are supported by relevant supporting documentation.
• Ensure the payment certificates from the principle agent agrees to the invoice claimed.
• Perform forecasting on total spending using units completed against total amounts claimed as per the payment certificate.
• Review stage of inspection certificates and ensure that the contractor does not claim for the same erf number on the same stage more than once.
• Verify whether the erf is completed and claimed as per payments certificate and is supported with happy letters.
4. Project Finance Management:
• Prepare monthly cashflow reports per project.
• Prepare project funding and expenditure reconciliation per project.
• Check correctness of expenses allocated in compliance with the approved budget.
• Review general ledger transactions to ensure accuracy and complete journal entries when required.
5. Risk Management:
• Coordinate completion of the office operational risk register.
• Liaising with the relevant owners to update the risk register.
• Submit updated risk reports to the risk manager.

The HDA has the following five-year fixed term contract position:
MANAGER: PROJECT FINANCE
Location: Head office, Johannesburg
Reporting Line: Chief Financial Officer
Reference: HDA MPF/2023
Main Purpose: To ensure the finances of the project finance sare appropriately managed, reported on and are compliant to ensure the overall financial success of the HDA’s mandate.
Key Performance Areas:
1. Governance and Administration:
• Ensure good governance and compliance with the Public Finance Management Act (PFMA), National Treasury Regulations and other relevant legislative requirements.
• In collaboration with the CFO, develop policies and procedures for project management.
• Liaise with internal and external auditor.
• Manage the overall project finances to ensure they are run effectively and that the accurate financial information is provided
• Ensure management of risks within the project finance
• Review annual audit management letter and internal audit reports and address findings.
• Assist various committees as requests.
2. Financial Reporting for Projects:
• Manage the accuracy allocation of expenses to relevant project cost centres.
• Manage the completeness, accuracy and timeous processing of project transactions, e.g. creditors are paid within 30 days
• Review reconciliation between bank cash balances and projects ledger report
• Manage bank account balances daily to ensure no overspending takes place.
3. Projects Finance Management
• Oversee compliance with the Division of Revenue Act (DORA) requirements by the relevant provinces/ municipalities
• Oversee the effective management of operational costs through Medium Term Operational Plans (MTOPs) agreements
• Oversee the detailed budgeting for projects.
• Monitor and report on projects budgets and actuals pertaining to projects monthly
• Review projects funds monitoring report to flag financially underperforming projects and communicate with CFO
• Manage monthly reporting of cashflows pertaining to projects.
• Develop a monthly tracking and reconciling system for projects’ capital and operational expenditure.
• Develop a comprehensive monthly cash flow projection report
• Oversee the accurate and timeous transfer of funds for project expenditure when necessary.
• Prepare reports to the relevant governance structures.
• Ensure that projects are financed as per the approved allocations
• Oversee that monthly confirmations are signed by relevant authorities, both from the HDA and funder
• Oversee the compliance of invoices submitted for payment, ensure all supporting documentation is attached
• Ensure that authorised invoices are in line with the approved delegations of authority document
4. Project Funding:
• Manage consultations and collaboration with Project and Development Managers on appropriate structures and requirements relating to funds availed to the HDA projects
• Provide support in relation to inter-governmental fiscal relations concerns and interests of the HDA
• Maintain appropriate relations with funders and draft reports necessary, ensuring compliance with implementation agreements and contracts
• Manage the draw-down of funds as per available schedule.
• Advise on fiduciary management, in particular ring-fencing budget and subsidy flows.
• Manage debtors’ balances to ensure timeous receipting of funds.
• Review monthly fund reconciliations to ensure fund expenditure is aligned with the implementation protocols/ funding agreements
• Review and approve customer invoices monthly.
5. People Management:
• Select, assign, lead and manage people.
• Set clear objectives for self and others and measure achievements against these objects through implementation of the performance management system.
• Build and manage relationships with staff members.
• Manage and support staff development (e.g., training, workshops, etc)
• Develop and manage the implementation of succession plans for key individuals and critical positions
• Implement the HDA HR policies and procedures as required.
• Manage risks and address issues as they arise.
6. Requirements :
• An Honours degree in Finance Management is required.
• A minimum of 6-8 years’ relevant experience in Project Finance
• A minimum of 5 years’ project finance management experience
