Description
To assist the department in handling complaints and queries from multiple sources, redirect complaints to external stakeholders, regulatory authorities and internal FSCA divisions in accordance with relevant protocols and management of the debarment register. The person appointed to this position will report to the Manager.
Key Performance Areas:
• Assess complaints and queries received by the Department;
• Refer matters that do not fall within the scope of the FSCA to external stakeholders;
• Refer matters that fall within the scope of the FSCA to relevant internal stakeholders;
• Engage with internal and external stakeholders with regards to the activities of the Department;
• Engage with relevant internal and external stakeholders to facilitate the closure of various matters;
• Assist with the outreach projects; and
• Attend to administrative responsibilities of the Department as directed by the management team
Other Key Competencies:
The candidate must demonstrate the following skills and attributes: A high level of judgement and a confident and decisive approach; problem analysis, information gathering, communication skills (verbal and written), good interpersonal skills and emotional intelligence, customer relations and persuasiveness skills.

Requirements

SENIOR ANALYST (MARKET TRANSPARENCY AND RISK MANAGEMENT DEPARTMENT) (Pretoria)

Description
Purpose of the Job
To oversee the implementation and supervision of the regulatory framework for credit ratings agencies (“CRAs”) and financial benchmark administrators (“FBAs”). CRAs are primarily regulated and supervised in terms of the Credit Rating Services Act No. 24 of 2012 (“CRS Act”); and the regulations of financial benchmarks is currently under development. The person appointed to this position will be stationed in the Market Integrity and Decision Sciences Division and will report to the Senior Manager: Ratings and Indices.
Key Performance Areas
- Provide support in the implementing and administering of the CRS Act, Conduct Standard - Requirements relating to the provision of a benchmark and any other subordinate legislation.
- Initiate and conduct routine market conduct on-site inspections of CRAs and FBA in terms of the Risk-Based Supervision approach.
- Review and recommend for approval or refusal of applications for licence, amendments, exemptions, and outsourcing arrangements for CRAs, and assist the licencing division in the review of applications for license for FBAs.
- Conduct relevant research to improve the standard of regulation in line with national and international developments and requirements.
- Participates in and contributes to discussions regarding possible regulatory and policy direction on the regulation and supervision of CRAs and FBAs.
- Represent the department at relevant internal and external meetings, committees, and forums in line with stakeholder engagement plan.
- Assist in the compilation of routine reports and commentaries within the set timelines.

Requirements
A bachelor’s degree in finance, economics, accounting, or law with at least 5 years of experience in the financial sector and/or the regulatory environment within the financial services industry. Good knowledge and/or experience of the functioning of the financial markets, credit rating services or financial benchmarks will be an added advantage.

SENIOR LEGISLATION SPECIALIST - OFFICE OF GENERAL COUNSEL (Pretoria)

Description
Purpose of the Job:
To provide specialised legal support on the development of legislation, opinions and interpretation of legislation administered by the FSCA. The person appointed will report to the Departmental Head.
Key Performance Areas:
- Assist National Treasury with the development, drafting and reviewing of primary legislation pertaining to the FSCA, including the necessary amendments thereof;
- Assist with the management of draft legislation to and through Parliament, and provide guidance and support to the organisation when Acts are being implemented;
- Review regulatory instruments, when requested, from a constitutional and administrative law perspective;
- Assist with the development of the annual legislative programme for the FSCA;
- Liaise and attend meetings with National Treasury and other stakeholders on the development of any legislation affecting the mandate of the FSCA;
- Provide legal advice and opinions on legislative matters affecting the FSCA including on the interpretation of legislation administered by the FSCA;
- Keep abreast of the legislative landscape nationally and identify pieces of legislation and provisions that may have an impact on financial services legislation and provide the necessary guidance to the organisation.

Requirements
An LLB degree, with about 10 years continuous post admission experience with at least five years in the drafting and interpretation of legislation, including subordinate legislation. Experience in and knowledge of Constitutional and Administrative law and/or financial sector law. Experience in stakeholder management, general management experience and the ability to interact at very senior levels will be necessary. Parliamentary experience is recommended. The completion of a Legislation drafting course will be an advantage.
