EXECUTIVE: IMPROPER CONDUCT AND ENFORCEMENT
Position Summary: The Executive: Improper Conduct and Enforcement role is Executive: Improper Conduct and Enforcement oversees and manages the appeals, improper conduct and enforcement oversight statutory function to ensure compliance of the engineering sector as stipulated in sections 24, 26, 28-33 the Engineering Profession Act 46 of 2000 of South Africa. The Executive: Improper Conduct and Enforcement reports to the Chief Executive Officer.
Duties & Responsibilities
- Provide leadership in communicating the Vision, Mission, Objectives, Principles, Values, and the organisation’s Strategic Plan.
- Provide strategic oversight in the development of the Division’s Annual Performance Plan (APP) and the Business Units Operational Plans.
- Provides direct line management to the Business units of Improper Conduct and Enforcement including monitoring workload, performance management, developing skills and knowledge, providing support where necessary.
- Oversees the implementation of the enforcement framework in accordance with contraventions of the Code of Practice and Identification of Engineering Work.
- Oversees the Casework in investigating potential cases and reviewing current practices, in accordance with the method of Inquiry.
- Devises procedures for the effective, efficient and consistent handling of cases in accordance with the above laws and internal policies.
- Provides guidance and direction and determines the appropriateness of enforcement action with respect to Identification of Engineering work and the overall sector compliance needs.
- Works closely with the Team to ensure investigations are thorough and produce robust decisions that will withstand scrutiny from a knowledgeable audience.
- Uses judgement to ensure a fair and consistent approach to compliance and enforcement, in all cases, particularly those which are more sensitive or complex in nature.
- Identifies and monitors potential risk areas relating to public safety and interest in the engineering sector requiring greater monitoring, guidance, and compliance.
- Responsible for dissemination of advisory notes to guide the industry where sector risks have been identified or where behaviour contravenes the code of Practice.
- Publishes the list of engineering professionals on whom charges have been preferred in compliance with the EPA Act and POPI Act.
- Develops and implements stakeholder engagement plan to build strong relationships with stakeholders with a similar role or portfolio on the sector.
- Prepares the annual budget for division and support costs for the Divisions under authorisation by the CEO.
- Implements, and maintain mechanisms regulating financial control and budgeting in the division.
- Works with the team to develop the operational plan aligned to the activities within the Annual Performance Plan (APP) and the strategic plan, ensures decisions are appropriately disseminated and followed through to implementation.
- Works closely with relevant stakeholders contributing to the development and implementation of internal policies, standards, guidelines, and procedures by the Regulatory Instruments Division and ensuring they are adopted by the Team.
- Co-ordinate and Manage the Investigating Committee of Council to ensure that their Terms of reference and statutory functions are delivered in full.
Desired Experience & Qualification
- A minimum of a postgraduate qualification (NQF level 8) in Law/Commerce/Engineering (in the regulatory, compliance or enforcement field) OR equivalent.
- Admission as an attorney or advocate or Professional registration with the relevant body in accordance with qualification.
Experience:
- A minimum of 15 years of experience in the areas of statutory compliance/ regulatory oversight/ engineering sector; and
- A minimum of 5 years of experience in a compliance and/or enforcement role within the engineering sector at executive management level.
- Experience in the Regulatory sector or the Built Environment would be an added advantage.
Knowledge, Skill and Competency:
- Knowledge of EPA Act 46 of 2000 and other related legislation required for regulation in the Built Environment Sector.
- Excellent written, oral, presentation and planning skills, combined with the ability to present conclusive findings to key stakeholders. Good interpersonal skills to encourage teamwork and collaboration.
- A proactive and professional approach to work, with the ability to organise and plan their own work on a day-to-day basis and maintain a focused approach to completing objectives/tasks.
- Sensitivity and diplomacy in dealing with privacy issues together with a high level of understanding of confidentiality and security of personal information.
- A credible leader and role model, committed to continuous development and leading by example.
- Strong communication and analytical skills are essential.

COUNCIL SECRETARY (Re-Advert)
Position Summary: The Council Secretary role is responsible for providing Council with guidance in their duties, responsibilities, powers and ensure their awareness and knowledge on all laws and regulations relevant to ECSA, including monitoring and advising them on business ethics, good governance, and the relevant international developments thereof. The Council Secretary reports to the resident of the Council with the dotted line to the Chief Executive Officer.
Responsibilities includes but not limited to:
- Provide leadership in communicating the Vision, Mission, Objectives, Principles, Values, and the organisation’s Strategic Plan.
- Provide strategic advisory services in relation to secretariat services to the Council and Executive Management.
- Advise the Council collectively and individually of their legal rights and obligations in relations to matters of their responsibilities the law (EPA), and good corporate governance.
- Prepare, collate and distribute Council Charter and Committee Terms of Reference and work plans.
- Develop and distribute Delegations of Authority, Terms of Reference and Council Charter providing advice regarding its content.
- Maintain the ECSA’s statutory registers including minutes, Council registers, registers of disclosures of conflict of interests.
- Prepare reports to Council and its Committees and any other forum in relation to any subject matter of governance from time to time.
- Ensure that the Council decisions, resolutions, approvals and other communications are formally channelled to the appropriate members of staff and other stakeholders.
- Participate with the EXCO team in developing a vision and strategic plan to guide the organisation.
- Identify, assess, and inform EXCO team of internal and external corporate governance issues that affect the organisation.
- Ensure council procedures are both followed and regularly reviewed.
- Oversee the efficient and effective day-to-day operation of the Council Secretariat Division.
- Develop and monitor corporate governance compliance checklist for ECSA.
- Ensure ECSA compliance with all statutory and regulatory requirements.
- Ensure the proper induction, orientation, ongoing training and education of Council members, including assessing the specific training needs of Council members and executive management in their fiduciary and other governance responsibilities.
- Administer the funds of the Business Unit according to the approved budget and prepare and submit monthly management accounting reports.
- Provide regular feedback to EXCO and Council (and its committee/s relevant to the work of the Division) with regards to the operations of the Division.
- Oversee the preparation of all or parts of the annual report and ensuring the statutory deadlines are met and the statutory and regulatory disclosures are validated.
Minimum Requirements:
- A LLM in Corporate Governance, and/or Corporate Law qualification or equivalent qualification.
- Membership Certificate of the Chartered Governance institute of Southern Africa.
- Admitted attorney/advocate is advantageous.
Experience:
- Minimum of Fifteen (15) years’ experience in the corporate governance, Compliance and company/board secretariat and a minimum of five (5) years in a company/board/ council secretary role.
- Experience in the regulatory/ professional council environment would be an added advantage.
Knowledge, Skill and Competency:
- Knowledge of legal and regulatory requirements affecting corporate governance instruments and guidelines.
- Good understanding of leadership and management principles.
- Knowledge of financial and risk management.
- Strong organisational skills and+ writing Skills and ability to interpret and advice on the application of legislation.
- Advanced understanding of strategic management, strong work ethics and values, proficiency in MS Office.
