The ETDP SETA is looking for a suitably qualified and experienced Legal and Compliance Officer to join our dynamic team in the Corporate Services Division: 
 
LEGAL AND COMPLIANCE OFFICER 
Salary: R 663 028 (Total Cost to Company) 
 
Job Purpose: The Legal and Compliance Officer is responsible for ensuring that the organisation complies with the regulatory and legislative requirements and that the organisation’s operations comply with internal standards. Ensure that all legal and compliance risks are managed and that legal and compliance issues and processes are monitored and reported. The successful applicant will be based in the ETDP SETA Head Office in Johannesburg and report to the Manager: Corporate Servies. 
The successful candidate must meet the following minimum requirements: 
 
Minimum Requirements 
  • Matric / Grade 12 (NQF Level 4) and, 
  • A Bachelor of Law Degree, LLB, or B. PROC (NQF Level 7). 
  • Completed articles within the legal environment will be advantageous. 
  • A membership with the Compliance Institute of South Africa or any Legal Institute will be an added advantage. 
  • A minimum of five (5) working experience in a legal environment in contract management, litigation and or in regulatory compliance experience. 
  • Experience in developing and managing compliance monitoring programmes. 
  • A proven experience in coordinating compliance issues at an organisational level.
  • Strong contract drafting skills on commercial agreements (contract management). 
  • In-depth knowledge of applicable Compliance and Risk standards and management. 
  • Sound analysis and interpretation of laws and regulations knowledge. 
  • Computer literacy (MS Office packages) and an ability to work with data. 
  • A valid certified driver’s license is essential. 
 
Knowledge, Attributes and Skills Required 
  • Understanding and knowledge of regulations and legislation pertaining directly/indirectly to commercial contracts. 
  • Excellent advisory and consultation skills. 
  • Excellent skills in collecting and interpreting data. • Articulate effective communication (written and verbal) skills with the ability to communicate internally and externally (lawyers, regulators, auditors) at all levels. 
  • Good organisational and time management skills would lead to the timely delivery of all outputs. 
  • Strong investigative ability and be assertive. 
  • The ability to work under pressure and with minimum supervision. 
  • Be more attentive to details with sound practical conflict management skills. 
  • Provide general legal support and substantive legal advice to the organisation’s operations. 
 
Duties and Responsibilities 
  • Draft standard template of ETDP SETA Agreements (inter alia service provider agreements, suretyship agreements, SLAs, MOUs, MOAs, etc.). 
  • Negotiate contracts with relevant institutions and draft legal letters. 
  • Oversee the drafting and vetting of contracts, legal matters/instruments and compliance processes within the ETDP SETA. 
  • Peruse agreements/contracts and provide opinions on the organisation's acceptability and appropriateness (valid and legally binding). 
  • Draft and/or review leases, service level agreements, and all agreements attached to the ETDP SETA buildings. 
  • Facilitate the signing of legal agreements and explaining content to non-legal employees. 
  • Resolve legal disputes by conducting thorough research into relevant legal issues. 
  • Draft legal and policy documents and amend same when required. 
  • Attend all legal correspondence, e.g., letters of demand, summons, and all court processes received and to all legal-related matters for the organisation promptly, professionally and efficiently. 
  • Follow the organisation’s approved procurement policy and establish a panel of attorneys for the company. 
  • Liaise with external attorneys and advisors on specialised areas of law and prepare comprehensive briefs to counsel, where required. 
  • Consult and advise stakeholders on resolution of legal matters and the interpretation of the law. 
  • Prepare reports for senior management within the organisation. 
  • Drive the compliance risk assessment in analysing the compliance risks and identifying, describing and estimating the compliance risks affecting the organisation. 
  • Consolidate the compliance universe and monitor compliance in this regard. 
  • Develop and manage compliance programs to minimise instances of non-compliance. 
  • Monitor compliance with legislation, rules, codes, standards, policies, and procedures within relevant areas and report non-compliance issues to the Line Manager periodically. 
  • Ensure the promotion and assessment of the current state of compliance across the organisation. 
  • Develop and implement organisation compliance profiles. 
  • Participate in implementing compliance risk action plans and participate in special or ad-hoc strategic risk assessments or projects. 
  • Provide support with regard to developing, initiating, maintaining, and revising policies and procedures for the general operation of the organisation and related activities to prevent any risky conduct. 
  • Maintain compliance risk management plans of the ETDP SETA and oversee the maintenance of the relevant plans for accurate record keeping and tracking the recording of actions for improving compliance status. • Report compliance status in the management reports and to the Line Manager, Risk Management Committee and other structures as and when required. 
  • Provide advice to the relevant department in terms of compliance issues identified in the respective areas. 
  • Facilitate compliance management training closely with HR and other relevant stakeholders.
  • Research best practices in corporate governance to adopt and align them with the organisation's compliance practices. 
  • Compile monthly compliance reports for the various stakeholders. 
  • Any other duties as assigned by the Line Manager.

The ETDP SETA is looking to employ a suitably qualified person with project management experience in the capacity of a Provincial Skills Advisor position to join our dynamic team at the Western Cape Provincial Office: 
 
PROVINCIAL SKILLS ADVISOR – WESTERN CAPE PROVINCE 
Salary: R 663 028 (Total Cost to Company) 
 
Job Purpose: The Provincial Skills Advisor is tasked with coordinating and facilitating skills development programmes and projects in the province of their appointment. The incumbent will manage and coordinate all assigned provincial skills development initiatives such as learnerships, skills programmes, internships, bursaries, workplace-based learning agreements, support for small/micro levy-paying organisations, and communication of scarce and critical skills in the province.
In addition, he/ she will liaise with internal and external stakeholders concerning all aspects of skills development coordinated by the ETDP SETA. The incumbent will report to the Provincial Manager and the position is based at the ETDP SETA provincial office in Bellville (Western Cape). 
 
Minimum Requirements 
  • Bachelor’s Degree (NQF 7) in Education, Training and Development or Public Administration or Human Resources Development or Business Administration/Management. 
  • A certificate in Project Management will be an added advantage. 
  • At least 5 years of working experience in Training and Development in skills development processes with 3 years of working experience in a Project Management environment. 
  • Experience and knowledge in the Sector Education and Training Authority (SETA) environment. 
  • Sound knowledge and experience in stakeholder relations and management with good negotiation skills in the coordination of services. 
  • Proven experience in coordinating, implementing, monitoring and evaluating projects. 
  • The incumbent must have a good understanding and extensive knowledge of applicable policies, legislation, guidelines, standards, and procedures in skills development, including the Skills Development Act (SDA), Skills Development Levies Act (SDLA), Discretionary Grants Regulations, Public Finance Management Act (PFMA), etc. 
  • Extensive knowledge and experience in project scheduling, budgeting and administration systems operations skills. 
  • Ability to plan and organise work, using own initiative. 
  • Advanced computer skills in MS Office packages and data management systems. 
  • Willingness to work outside of office hours and under pressure. 
  • A valid driver's license and willingness to travel are mandatory.

Duties and Responsibilities 
The incumbents will be responsible for the following duties and responsibilities: 
  • Manage and implement the ETDP SETA provincial programmes and projects within the allocated targets and budgets. 
  • Develop a project monitoring and evaluation plan and tools for projects and evaluate projects continuously against provincial annual plans and deliverables. 
  • Monitor the implementation of identified learning programmes and conduct site visits. 
  • Monitor the contracted skills development providers, learners and workplaces and prepare verification audits. 
  • Recruit prospective skills development providers to embark on the accreditation process and encourage those who are already accredited to have their scope extended. 
  • Recruit prospective constituent employers and learners. 
  • Prepare, develop, and manage the contracts relevant to each project and manage the project deliverables. 
  • Manage all project-related conflicts and build relationships with the ETD Sector's skills development providers and stakeholders. 
  • Collation and processing of documents relating to payments. 
  • Manage and monitor payment of learners through payroll administration and ensure that skills development provider payments are made timeously. 
  • Process and manage learners on the MIS system and their respective databases. 
  • Effectively communicating the ETDP SETA skills development initiatives, ensuring that constituencies and stakeholders are engaged on what should be done to achieve the sector skills development and strategic priorities and market all the ETDP SETA services, programmes and projects. 
  • Conduct advocacy and outreach programmes. 
  • Distribute marketing materials and attendance of exhibitions and skills development-related events in the province. 
  • Plan and implement capacity-building programmes in the province. 
  • Undertake project reporting on the completion of projects to be linked to impact analysis. 
  • Provide progress reports on a monthly and quarterly basis as required and provide verifiable evidence supporting all reported achievements. 
  • Provide regular feedback to the Provincial Manager regarding the operational responsibilities and outputs. 
  • Any other ad hoc duties as assigned by the Provincial Manager as and when needed. 
 
The position will be based in Bellville. Extensive travelling will be required; hence a valid driver’s license is a pre-requisite.

PROVINCIAL RECEPTIONIST AND SWITCHBOARD OPERATOR – FREE STATE PROVINCE 
Salary: R 162 615 per annum (Total Cost to Company) 
 
Job Purpose: Under the Provincial Manager's supervision and as the first point of contact with the Provincial office. The incumbent will add value by ensuring that all visitors and callers are attended to courteously, professionally and efficiently per the ETDP SETA requirements and policies. Provide information to callers or transfer calls to appropriate offices; perform administrative and other related duties as required. The position is based at the ETDP SETA provincial office located in Bloemfontein. 
 
Minimum Requirements 
  • Must have a senior certificate (Grade 12) or equivalent qualification (NQF Level 4).
  • A certificate in switchboard operation will be an added advantage. 
  • A minimum of three (3) years of Receptionist and/or Switchboard management experience or proven experience in an office environment handling large numbers of calls. 
  • Working in a SETA/ training environment or public entity will be advantageous. 
  • Computer Literacy in MS Suite Office packages. 
  • Proven good telephone etiquette and problem-solving skills. 
  • Excellent administrative skills. 
  • Oral and written communication skills. 
  • Ability to work under pressure and think proactively where required. 
  • High levels of personal planning and organising skills.

  • Direct all queries and complaints to the Provincial Manager or a relevant official available. 
  • Ensure the neatness and tidiness of the entrance, reception, and boardroom areas at all times. 
  • Assist with welcoming attendees to relevant functions/events and directing them to appropriate venues. 
  • Effectively manage the reception of clients. 
  • Create systems of recording and reporting on queries. 
  • Provide general information and manage internal and external calls. 
  • Receive walk-in visitors and clients and deal with their requirements expeditiously. 
  • Administration of incoming and outgoing couriers and keeping documents/parcels for collection and delivery. 
  • Answering face-to-face enquiries and providing information when required. 
  • Report telephone equipment and line faults to the ITC. 
  • Provide and ensure that marketing materials and information about the ETDP SETA services are available to the public.
