MANAGER - SECURITIES, MONITORING AND CONTROL

About the Role
The incumbent will be responsible for ensuring compliance to all approval conditions; preparing legal agreements and applicable security documents as per the approval conditions; ensuring filing and safekeeping of all legal documents in compliance with applicable legislation; providing clearance for disbursement of loan funds; tracking and monitoring all approved active loans for identification of possible default; preparing loan portfolio reports on the performance and standing of the loan book; retrieving monthly reports on all defaulting accounts from the loans system; sending bulk sms reminders and letters of outstanding instalment to all defaulting clients; and communicating with regional teams to ensure corrective action is taken in rectifying non-payment. The role also entails initiating handover of defaulting accounts to legal debt collection and recoveries section.
Key duties and responsibilities
Permanent (Grade 16 – Total Cost to Company)

KEY DUTIES AND RESPONSIBILITIES
The Key Performance Areas will encompass:
Technical and Financial Due Diligence
Compliance to approval conditions
- Review all approved applications in line with relevant approvals.
- Load all approved applications on the loans system.
- Generate relevant loan implementation checklist for the attention of the loans consultant.
- Generate approval letters reflecting terms and conditions of the loan.
Provision of Legal Support for funding products
- Drafting and actioning of legal agreements and documentation in line with funding approval conditions
- Conduct legal research on legal aspects of disputes or problem areas and provide legal opinion where necessary.
- Drafting of security documents (suretyships, notarial bonds, mortgage bonds, cession agreements, etc.) in line with approval conditions
- Review and check all signed funding agreements for compliance
- Prepare all files relating to funding approvals and provide clearance to finance for disbursement of funds
- Conduct legal research on legal aspects of disputes or problem areas and provide legal opinion where necessary.
- Initiate the process for registration of securities and liaise with instructed attorney firms and insurance companies for registration where applicable
- Receive and verify all original securities for safekeeping and validate registration through deeds search
- Maintenance of Records related to Active Securities
- Ensure release of securities in all settled matters
Loan monitoring and reporting
- Track and monitor all approved active loans for identification of possible default
- Prepare loan portfolio reports on the performance and standing of the loan book
- Retrieve monthly reports on all defaulting accounts from the loans system.
- Send bulk sms reminders and letters of outstanding instalment to all defaulting clients.
- Management and Perfection of Securities
- Assist the funding units of the ECDC in formalising workouts/restructures and in the collection of outstanding loans through enforcing funding terms and security conditions
- Assist the Senior Legal Advisor in developing frameworks and techniques to deal with the perfection of securities to ensure recovery of ECDC funds
- Monitor progress on all matters allocated to attorney firms and provide support in the litigation processes
Stakeholder Management
- Manage relationships with different stakeholders, such as attorneys, counsel, ECDC funding units.
- Liaison and hold meetings with various stakeholders and funders for alignment to industry best practices.
MINIMUM REQUIREMENTS
- Bachelor's Degree or equivalent in Commerce / Legal.
- Minimum 8 years working experience of which 5 years must be at supervisory or consultancy level working in funding/Legal Administration.

The Key Performance Areas will encompass:
Procurement Legislation, Policies and Procedures
- Facilitate review of Procurement policy and procedure for possible amendments and communicate to staff members
- Ensure that best governance practices are in place, and provide valuable inputs towards policy formulation
- Keep updated and informed on the latest developments regarding PPPFA, Treasury Regulations, Procurement and BEE Acts on a regular basis
- Conduct workshops to all staff to ensure risk management, understanding and compliance on ECDC procurement policies and procedures and highlight approved amendments effected
Pre-tender Submission
- Ensure that briefing sessions are conducted to provide clarity and additional required information to suppliers
- Liaise with business unit managers to ensure that bills of quantities, job specifications or Terms of Reference are clearly defined
- Evaluate adequacy and effectiveness of procurement management control
- Serve as the SCM representative in the Bid Specifications Committee and Bid Evaluation Committee
- Provide guidance, practical assistance and support with regard to evaluation criteria to be used to ensure adherence to procurement policies and procedures.
- Ensure that quality standards, fairness and transparency are met, maximum investment returns realised, and the best qualifying supplier awarded the contract
- Formulate comprehensive and accurate evaluation reports with recommendations for authorisation
- Generate, amend and monitor expenditure trends per business unit from the expenditure reports and inform Procurement Committee of the discrepancies observed
- Compile Excel spreadsheet of Procurement approvals by the Business Units to monitor completion of projects and audit disbursements as against budgeted allocations
- Inform Finance Unit and Procurement Committee of transaction status and discrepancies observed, record all deviations for presentation to the Procurement Committee
- Ensure vetting of submissions, and that accountability is maintained and cost savings realised at all times
- Note and record deviation reports approved by the CEO and Executive Management
- Advertise and monitor capturing and maintenance of supplier applications into ECDC Database to encourage utilisation of suppliers on a rotational basis
- Conduct site visitations before implementation of project.
Reporting and Accounting
- Record attendance by Procurement members to the meeting
- Monitor that Procurement Committee recommendations are carried out and report back on a monthly basis
- Document procurement minutes accurately
- Account and provide management responses to all procurement related audit queries raised by Auditor General
- Compile a detailed procurement report to the Procurement Committee and to the CEO indicating projects status
- Compile procurement extracts to serve as proof of procurement approvals and source of reference before the payments can be effected
People Management
- Communicate and allocate departmental objectives to staff
- Ensure staffing levels are adequate to meet departmental objectives
- Train and cross train staff in relevant functions
- Ensure job profiles and performance management is in place for all staff
- Handle grievances and discipline issue
- Motivate and support staff
- Create a team orientated work environment

MINIMUM REQUIREMENTS
- National Diploma in the field of Commerce , Public Management , Built Environment or Law
- A minimum of 5 years working experience of which at least 3 years must be at a supervisory level in supply chain management within an infrastructure programme procurement environment.

DUE DILIGENCE CONSULTANT

The incumbent shall be responsible for providing support to the Enterprise Finance unit in conducting technical and financial due diligence. The role entails verifying the accuracy of business information submitted in support of funding applications; conducting site visits to obtain a deeper understanding of the enterprise; conducting qualitative and quantitative analysis on all information provided by the applicant; performing risk ratings using various systems in order to determine probability of default; conducting loss given default assessment against proposed loan exposure and value of collateral provided and providing feedback to the enterprise finance unit on the outcomes/recommendations of the risk assessment and due diligence. The incumbent will also be responsible for providing support to the Manager: Short and Long Term Funding in ensuring quality, efficiency, processing in all loan applications submitted for approval.

- Conduct site visits to obtain a deeper understanding of the enterprise where necessary.
- Conduct overall viability assessment of the applicant entity based on financial information provided.
- Perform overall risk assessment based on micro, macro and market factors applicable to the applicant entity.
- Ensure compliance of the submission within the prescripts of the relevant framework.
- Add value to the quality of regional applications for submission to the relevant approval authority.
- Credit Risk Analysis
- Perform risk ratings using various systems in order to determine probability of default.
- Assess value of exposure against collateral to ensure proper mitigation is in place for safeguarding overall credit risk to the ECDC.
- Analyse financial information submitted to ensure all applicable financial ratios are aligned to industry norms.
- Attend all regional office meetings to add value in areas relating to lending.
- Communicate and provide timely feedback to regions on progress of applications submitted for approval.
- Provide support to the Manager: Short and Long Term funding in all aspects of the lending process.
MINIMUM REQUIREMENTS
- National Diploma in Business Management /Commerce / Economics/ Finance/ Accounting
- 3 years working experience in Business/Finance/Accounting/Banking. Experience in lending or credit environment will an be added advantage.
