Job Description
The Competition Commission is looking for a dynamic, seasoned and experienced litigator possessing extensive experience in practicing at the bar or a law firm.
The prospective candidate should essentially be a litigation specialist who has appeared before courts and handled complex civil or commercial and/or competition cases.
 
We offer a competitive market related total cost to company package of R 1 866 509,22
(Negotiable commensurate with experience)


Please note that the position is available on a five (5) year fixed term contract (which may be renewed at the exclusive and sole discretion of the Commission and is subject to the signing of a performance agreement).

Minimum requirements:
  • A Bachelor of Laws (LLB) degree or equivalent legal qualification and admission as an attorney / advocate (if admitted as an advocate, the candidate must have served and completed pupillage). All international qualifications must be accompanied by a SAQA accreditation certificate.
  • Fifteen years (15) years post admission experience, of which at least five (5) years must preferably include management experience.
  • Litigation experience, preferably civil and commercial (proven track record of cases must be submitted)
  • Superior drafting, analytical and litigation skills.

Key Responsibilities:
  • To appear and represent the Commission in the Competition Tribunal, Competition Appeal Court or any court in trial proceedings, appeal and review proceedings, contested merger hearings, application proceedings etc.
  • Drafting pleadings, giving advice on evidence, preparing witness statements, leading and cross-examining witnesses, preparing and presenting heads of argument.
  • Prosecuting and opposing appeals in the Competition Appeal Court.
  • To provide high quality advise to the Commission on the litigation strategy of cases.
  • To advise on and to provide superior legal solutions to procedural and substantive legal challenges arising from the Commission’s litigation;
  • To develop and apply a project management approach to the litigation of cases in the Competition Tribunal in order to ensure expeditious and effective prosecution of cases;
  • To provide strategic leadership to the Commission litigation teams;
  • To build the internal litigation capacity of the Commission;
  • To undertake research and advice the Commission on emerging trends in the litigation pipeline and
  • To assess, evaluate and advise on the strengths and weaknesses of theories of harm and economic evidence in abuse of dominance and merger investigations.

Job Description

Skills and Experience
We are looking for a dynamic, hardworking and a committed individual who meets the following requirements:
  • An LLB Degree or equivalent qualification and Admission as an Attorney / Advocate (if Admitted as an Advocate, must have served and completed pupillage).
  • Min 8-10 years post admission experience, of which three (3) years must preferably include management experience. Added advantaged +10 years post admission experience.
  • Litigation experience, preferably civil and commercial.
  • Competition Law experience is an advantage.
  • Drafting, analytical and litigation skills.
 
Other considerations:
  • Practical work exposure to area of expertise will be further considered to balance against other requirements.
 
Key Accountabilities
The main responsibilities of the incumbent will, inter alia, include:
  • To contribute to the planning and execution of the annual performance plan and business plan of the Legal Services Division and to participate in the Commission’s strategic planning processes and committees.
  • To manage, supervise and evaluate the performance of a team of legal counsel.
  • To provide strategic and substantive guidance on competition cases handled by team members in order to ensure expeditious and effective prosecution of firms that contravene the Competition Act, and effective presentation of mergers and acquisition transactions.
  • To provide and supervise the provision of timely and well researched legal advice to the Commission.
  • To manage and litigate cases before the Competition Tribunal, Competition Appeal Court, High Court, Supreme Court of Appeal and the Constitutional Court.
  • To instruct, brief and manage attorneys and counsel representing the Commission.
  • To assist in negotiating and concluding consent and settlement agreements; and
  • To co-ordinate, facilitate and execute activities to build internal capacity for legal compliance, drafting and litigation.

The Commission seeks to appoint a Legal Secretary in the Legal Services Division. We are looking for a dynamic and energetic team player who will coordinate office activities for case teams, perform a variety of legal secretarial duties such as scheduling hearings, preparing legal documents and correspondence, and providing information and direction to others.

Duties and Key Responsibilities:
  • Managing invoices and administrative processes for the appointment of external Counsel and law firms and monitoring expenditure on external Counsel's and law firm's fees against the approved litigation budget.
  • Providing administrative support to litigation teams.  
  • Take or transcribe minutes of consultations, meetings, prehearings and interviews of witnesses.
  • Assist litigation teams in making travel arrangements including travel arrangements for external Counsel, witnesses and experts.
  • Assist litigation teams in the preparation of discovery and trial record.
  • Assist litigation teams with litigation record management (including uploading of litigation records to the KMS etc).
  • Ensuring that all procurement documents for appointment of external Counsel and law firms have been approved and submitted to finance.

Job Description
