The Community Schemes Ombud Service Act (Act 9 of 2011) was promulgated on 11 June 2011 and provides for the establishment of the Community Schemes Ombud Service (“CSOS”) as a public entity. The CSOS has been classified as a Schedule 3A Public Entity in terms of the Public Finance Management Act (Act No.1 of 1999) (PFMA).

Gauteng x1 (Ref. CSOS/AGP/02/2024) 
Reporting to the Senior Manager: Dispute Resolution and offers a total cost to company package of R1 200 642.48 per annum. 
 
Requirements:
• Bachelor’s degree in Law/BProc/ LLB. 
• Admitted as an Attorney. 
• Expertise and understanding of Community Schemes governance and adjudication of disputes. 
• 5 years of expertise as an Adjudicator or Senior Management role or 10 years as a conciliator and/or court work/litigation/conciliation and/or arbitration processes of the CCMA or Bargaining Councils. 
• Ability to resolve complex disputes. 
• Ability to draft judgments and reports. 
• Understanding the political and legislative environment of the CSOS and thorough knowledge of the CSOS as well as the Sectional Titles Management Act. 
• Thorough knowledge of the CSOS Act as well as Sectional Titles Management Act, Companies Act, Housing Scheme for Retired Persons Act South Africa, Co-operatives Act, Promotion of Administrative Justice Act. 
• Expert user of case management modules and Client and service centric. 
• MS Office skills. 
 
Key Performance Areas: 
• Conduct adjudications on disputes referred to adjudication in a fair, equitable and transparent manner. 
• Working with the Dispute & Governance team. 
• Excellent case management and closure of all matters within the prescribed time limit. 
• Ensure that the adjudication order is issued to both parties with enforcement notices. 
• Issue Adjudication orders with prescribed timeframes. 
• Subject their adjudication orders to quality assurance. 
• Prepare and issue Notices of Set down for all Adjudication hearings inviting parties to a formal or virtual hearings. 
• Consider all evidence. 
• Conduct investigations, inspections, enter or inspect asset, record or another document. 
• Evaluate all evidence, apply legal research and applicable case law. 
• Issues an adjudication order which is binding on the parties to the dispute.

This position reports to the Senior Manager: Dispute Resolution and offers a total cost to company package of R659 475,00 per annum. 
 
Requirements
• Degree in Law (NQF level 7). 
• 2-3 years of experience within the legal environment. 
 
Key Performance Areas 
• Assessment on all applications for dispute resolution to determine jurisdiction. 
• Identification of issues in dispute to Section 39 of the CSOS Act. 
• Prepare Notice 43 to CSOS Act. 
• Facilitate submissions received from various interested parties to Section 44 of the CSOS Act;. 
• Set the matter down for a Conciliation hearing to Section 47 of the CSOS Act. 
• Prepare file for Conciliation hearing. 
• File management. 
• Managing and capturing reports on case management system in the division. 
• Assist with telephone complaints as well as walk-in applicants. 
• Providing weekly feedback to complainants. 
• Prepare monthly reports on all matters.

Requirements
• Bachelor’s degree in law / NQF 7. 
• At least 3 – 5 years of experience in the dispute resolution environment. 
• Understanding of the case management process. 
• Knowledge in the reporting and processing of cases in the dispute resolution environment. 
• Knowledge of current professional standards and of the Community Schemes environment.

Key Performance Areas 
• Preparing and issuing Notices of Set down for all Conciliation hearings, inviting parties to a formal conciliation hearing.

This position reports to the Manager: Governance, Compliance and Enforcement and offers a total cost to company package of R659 475,00 per annum.
 
Requirements
• A 3 – year degree in Law (NQF 7). 
• A total of 4 years working experience. 
• Postgraduate qualification in Law and Admission as an Attorney will be advantageous. 
• Previous experience in Sectional Titles will be advantageous. 
• Advances MS Office (Word, Excel and PowerPoint). 
• Extensive knowledge of the CSOS Act & Regulations. 
• Sectional Titles Schemes Management Act & Regulations.

Key Performance Areas 
• Ensure compliance of Community Schemes Governance Documents with all applicable legislation. 
• Receive the schemes governance documentation (new sectional title, amendment of an existing and registered scheme from regulation, rules, unanimous resolutions). 
• Liaise with the scheme for outstanding documents. 
• Conduct quality assurance on the schemes governance documentation. 
• Compile a report with recommendations for the scheme. 
• Receive community schemes amended version. 
• Conduct further verification and quality assurance on the amended documentation. 
• Issue the approval certificate. 
• Submit to the office of the Chief Ombud for signature. 
• Present the signed signature to the scheme. 
• Update the database. 
• Liaise with the deeds office and receive establishment certificates. 
• Check that all documents are attached as per the application form. 
• Verify the authenticity of submitted documentation. 
• Receive correct measures from schemes. 
• Monitor compliance. 
• Update the schemes database compliance status. 
• Submit the certificate to the Chief Ombud for approval. 
• Ensure that all suggested amendments on the Community Schemes Governance document have been affected by the Executive Authority of the Community Schemes. 
• Governance document and the final document submitted to CSOS. 
• Ensure that the Community Schemes Governance Documentation is legible and complete. 
• Request the community schemes to replace the Governance documentation where necessary. 
• Ensure that the Governance Documentation are of good quality. 
• Ensure that the Governance Documentation is archived as per the Record Management Policy. 
• Process all applications for requests for access to the Governance Documentation. 
• Retrieve the Governance Documentation from archive files where necessary. 
• Ensure that the access fee is paid by the requested before access to information is granted. 
• Provide the duly registered Community Scheme with the compliance certificate after approval by the Chief Ombud. 
• Submitting management reports on the implementation of the CSOS Act about Community Schemes Governance Documentation management. 
• Facilitate the development and implementation of the Governance Documentation Management Policy.

SENIOR MANAGER: GOVERNANCE, COMPLIANCE & ENFORCEMENT

This position will be reporting to the Adjudicator General and offers a total cost to company package of R1 386 811.80
 
Requirements
• Degree in law.
• Post-graduate qualification in Law or Management an added advantage.
• A total of 10 years working experience, and 5 years of which must be at supervisory level and within a legal compliance environment.
• Advanced knowledge in alternative dispute resolution.
• Knowledge of the community schemes environment/sector.
• Sound understanding of political and legislative environment of the CSOS Act as well as the Sectional Titles Management Act, Companies Act, Share Block Act, Schemes for Retired Persons Act and Cooperative Act.
• Excellent communication skills – both verbal and written.
 
Key Performance Areas
• Review and consolidate all CSOS practice directives and oversee their implementation.
• Interpretation of the CSOS legislative framework through development of practice directives; implementation of sound and legally compliant processes and procedures for the registration and quality assurance of schemes documentation.
• Oversee that appropriate enforcement measures are developed and implemented in the regions to ensure compliance within schemes.
• Ensure that mechanisms are put in place for the schemes to maintain their compliant status.
• Assist in the development and roll out of Transformation and Educational programmes for the benefit of CSOS stakeholders.
• Research on case law and/or legal prescripts referenced in court judgments and recommend for development and/or amendments of legally sound CSOS practice directives.
• Research on CSOS orders and recommend appropriate training interventions for both internal and external stakeholders.
• Participate in forums and tasks, overall research, and regional training to enhance service delivery.
• Manage resources (i.e., budget/finances, asset/equipment, and staff) within the business unit to ensure that they are utilized optimally.

The Community Schemes Ombud Service (CSOS) is contributing towards skills development by providing graduates with opportunities to gain work experience in various skills areas. It is therefore inviting applications for an Internship Programme that would run for a period of twelve (12) months
