DIRECTORATE: STRATEGIC SUPPORT SERVICES SECTION: LEGAL SERVICES 
LEGAL ADVISOR 
SALARY: R482 294 – R626 000 p.a. [T15] TOTAL COST TO COMPANY: R880 251.00 – R1 064 714.00 p.a. 

Job Purpose: Provide legal advice to the Municipality. Manage contracts and service level agreements. Draft items to Council and committees. Draft and implement items to the relief municipal court prosecutor if delegated. 
 
 
Duties: Draft and provide accurate legal opinions and advice to the Municipality. Draft legal documents and agreements. Manage ad hoc litigation on behalf of the Municipality. Manage the administration of Municipal properties in accordance with relevant legislation, policies, procedures and guidelines. Conduct research and draft items for Council and committees. Monitor the performance of staff. Compilation of legislation and commenting on legislation. Comment on draft legislation as received from Province, SALGA, upon internal requests, etc. Drafting and managing by-laws for Municipality. Litigation: receive notice of intention to issue summons. Drafting and providing legal advice. Amend, draw up and comment on contracts and service level agreements. Draft items under delegated powers to relevant committee, Council, Municipal Manager/Director. Instituting and/or defending of legal action on behalf of Council. Provide a legal information service to Council and the administration. Act as relief prosecutor to prosecute accused persons in the municipal court on behalf of the Municipality and carry out any legal action or defend the Municipality in any legal action. 

 
Requirements: Law degree at NQF 7 level. Admitted attorney or advocate. Valid Code B driver’s license. Computer literacy. Proficient in at least two of the official languages of the Western Cape. Sound knowledge of applicable Local Government legislation, policies and procedures. Excellent written and verbal communication skills. High level of responsibility. Ability to work under pressure. Ability to deal with conflict situations. Good research ability. Previous experience in Local Government and court procedures. Proven experience in administrative law, planning law, municipal property administration, procurement law, law of delict and evictions. 
 
Experience: 5 years’ experience in legal environment which includes litigation, contracts & contracts management, labour, administrative, delicts and environmental law.
