INDEPENDENT CHAIRPERSON OF THE NATIONAL CONSULTATIVE AND BARGAINING FORUM (NCBF) REF NO: NCBF 06/09/24
Background:
The BMA is an armed service established by the Border Management Authority Act (No.2 of 2020) as a Schedule 3A Public Entity with the objective to provide an integrated, single command and control within the border law enforcement area. The authority operationalized on the 1st April 2023. The BMA has recognized trade unions in the workplace which have a right to bargain with the employer. The parties established the National Consultative and Bargaining Forum where issues of mutual interest will be negotiated. In terms of the constitution of the forum, the parties agreed for the forum to be chaired by an independent chairperson.
Job purpose:
Independent Chairperson that is not influenced by any relationship between him/herself and the BMA and registered trade unions representative and is preferably not an individual who is also an employee or have any association to the BMA. Should have knowledge of applicable law and procedure prior to chairing the Collective Bargaining proceedings, he/she must also have a clear understanding of Labour Law; Bargaining Councils and CCMA.
We hereby invite applications from suitably qualified and interested individuals to apply for the Independent Chairperson for BMA’s National Consultative Bargaining Forum who meet the following requirements.
Requirements:
- Relevant tertiary qualification in Labour Law or Human Resources, qualification at NQF Level 7, a post graduate qualification will be an added advantage.
- At least 10 years’ experience of chairing collective bargaining processes at a Bargaining council or CCMA.
- A minimum of three (3) reference letters on a letterhead of the institutions where services were rendered pertaining to chairing collective bargaining processes.
- Conversant with Labour legislations and case law related to collective bargaining.
- 5-10 years’ experience in chairing bargaining councils or similar institutions.

Responsibilities:
Ensure that all the forum meetings ran orderly and terms of the relevant provisions of the Constitution of the forum including but not limited to:
- That only those persons who are entitled are present at the meeting (including invitees, if any).
- That the quorum of members is present.
- Ensure the proceedings are carried out as per signed protocols.
- To see that the wage negotiations are conducted in the order as given in the agenda.
- He/she may vary the order with the consent of the meeting.
- Ensures that the participants do not raise discussions or suggestion of amendments or otherwise on any matter which is not within the scope of the meeting.
- The chairman shall also see that the participants do not discuss anything for which specific motion is not agreed to before the meeting.
- Maintenance of order during the proceedings.
- Ensure that all parties are given fair chance to present and be heard.
- Maintain fairness and be partial all the times.
Salary: Daily rate as determined by the National Treasury
Term of Office: This appointment will be for a period of two (2) years.
