SENIOR ANALYST - SUPERVISION: INVESTMENT PROVIDERS (PRETORIA) Reference Number FSCA388 Description Purpose of the Job: To assist in the management and supervision of the activities of the Alternative Investment industry and to monitor Alternative Investment compliance with the provisions of the applicable Alternative Investment legislation within the framework of the objectives of the department. The person appointed to this position will report to the Manager. Key Performance Areas: • Monitor compliance with legislation to ensure sound and efficient Financial Services Providers and the protection of consumers; • Analyse financial statements and other statutory reports of Financial Services Providers; • Ensure that following a thorough analysis, matters are referred for regulatory actions where applicable; • Assist Manager with theme work and conduct research in terms of risk base supervision approach; • Identify and report trends in the financial services sector with possible impact on the FSCA’s regulatory objectives; • Take part in the implementation of a Conduct Risk Framework as part of supervision and monitoring; • Perform onsite inspection in terms of risk-based supervision approach; • Assist junior staff with planning and performance on onsite inspection; • Liaison with Financial Services Providers; and • Perform administrative or other activities relating to the regulation framework. SPECIALIST ANALYST - LICENSING: INSURERS & INVESTMENT PROVIDERS DEPARTMENT (PRETORIA) Reference Number FSCA 175 Description Purpose of the Job: To assist the department with the processing of new licence application, developing, streamlining, and ensuring appropriate licensing processes, procedures, frameworks. To assist with the development and enhancement of regulatory frameworks providing commentary views on policy matters impacting the licensing processes. The person appointed to this position will report to the Manager: Licensing Department Key Performance Areas: • Assess licence applications and apply mind to technical issues in the licence applications and provide solutions. • Assist in unpacking complex business models and clearly identifying the risks involved ensuring that the mitigations provided are appropriate and sensible • Assist in developing and enhancing the licensing framework; • Assist the department in executing licensing functions with defined SLC; • Assist with identifying gaps in the licensing framework and assisting in informing policy in addressing the gaps; • Where necessary and required, provide appropriate guidance, and support to the various applicants in terms of their licence application submissions; • Liaise with other stakeholders both internally and externally where required on the licence applications that require consultation and collaboration and ensure that stakeholder input is taken on-board in decision-making; • Supporting teammates and providing technical support, advice and guidance to the team when required. Requirements Degree in Commerce/Law and a minimum of at least 4 years practical experience in the financial services industry, regulatory environment, risk and compliance management functions/roles. Must have a good understanding of the following pieces of legislation- CISCA, FAIS (investment management activities and online FOREX/Derivatives trading platforms workings knowledge), Financial Markets Act (ODPs). Good technical understanding of the workings of the sectors and the interplay between them is key. Knowledge and understanding of the working of crypto assets is an advantage. Key Performance Areas: • Analyse annual financial statements and other statutory returns of Financial Services Providers to ensure that proper reporting standards have been followed; • Liaise with Financial Services Providers on issues of non-compliance identified during analysis of statutory returns; • Identify and report trends in the financial services sector with possible impact on the FSCA’s regulatory objectives; • Assess financial statements in line with the business model of Financial Services Providers; • Identify financial risks based on analysis of financial statements and any other financial information; • Analyse problems identified by regulated entities or as a result of new innovations and recommend solutions; • Support team members with analysis of other forms of financial reports; • Perform on site inspection in terms of risk based supervision approach; • Liaison with various stakeholders; and • Assist the team with ad-hoc projects.
