FINANCIAL SECTOR CONDUCT AUTHORITY (FSCA) SENIOR ANALYST MICRO AND ACCESS PRODUCT INSTITUTIONS DEPARTMENT Ref No: FSCA 209 Purpose of the Job: The department is accountable for supervising the business conduct of micro insurers and other financial services entities operating in the “micro” or “access product” space, as well as their related Financial Service Providers (FSPs). The person appointed in the role will be expected to assist the department to monitor compliance with the provisions of the Financial Sector Regulation Act, 9 of 2017 (FSR Act) and other relevant financial sector laws to ensure a sound and efficient micro institutions industry. The person appointed to this position will report to the Manager: Micro and Access Product Institutions. Requirements: A Bachelor’s degree in Commerce/Law or related field, coupled with at least 3-4 years’ work experience, preferably in the financial services industry and in compliance management. A good knowledge and understanding of micro institutions and access products in the financial sector is required. The candidate must also have a good understanding of the FAIS regulatory environment. Key Performance Areas: • Assist the Manager and Head of department in the development and implementation of an effective and efficient conduct of business supervisory framework for micro institutions and FSPs, based on the Treating Customers Fairly (TCF) approach; • Assist the Manager and Head of department by recommending and implementing changes to the regulatory framework and policy within the FSCA; • Monitor compliance with legislation and ensure that unfair treatment of customers by Micro and Access Product institutions and FSPs is attended to; • Responsible for coordinating and conducting on-site inspections, and ensure that matters emanating from the inspections are attended to timeously; • Analyse compliance reports of FSPs; • Liaise with FSPs on issues of non-compliance identified during analysis of statutory reports; • Identify financial risks based on analysis of financial statements and any other financial information of FSPs. • Conduct research, coordinate and manage project-based activities, and provide support to the Micro and Access Product Institutions team; • Assist the Manager and Head of department in establishing, implementing and maintaining proper quality management and control procedures in the department; • Assist the Manager and Head of department in preparing and providing inputs to all statutory and supervisory reports; • Liaise with internal and external stakeholders in respect of regulatory and supervisory matters; • Actively participate in and contribute to industry and FSCA committees as and when required; • Perform administrative and other supervisory activities delegated by the Manager and Head of department. SENIOR ANALYST SUPERVISION: BANKS AND PAYMENT PROVIDERS DEPARTMENT Ref No: FSCA 221 Purpose of the Job: To effectively regulate and supervise the Banks and Payment Providers, to protect the interest of consumers and to ensure a sound regulatory environment. The person appointed in these positions will report to the Manager: Banks and Payment Providers. Requirements: Bachelor’s degree in Commerce, Law or Banking and other relevant discipline with at least 3-4 years working experience within the financial services industry. The candidate must have a good knowledge and exposure to the financial sector, a good understanding of the Banks Act of 1990 and the Financial Sector Regulation act. Key Performance Areas: •Monitor compliance with legislation to ensure sound and efficient Financial Services Providers and the protection of consumers; •Analyse financial statements and compliance reports of Banks and Payment Providers; •Identify and report trends in the financial services sector with possible impact on the FSCA’s regulatory objectives; •Conduct on-site inspections in terms of the risk-based supervision approach and report on the outcomes of such visits; •Liaise with the Banks and Payment Providers industry stakeholders; and •Perform administrative or other activities relating to the supervision of the Banks and Payment Providers. The person appointed to this position will report to the Manager. Requirements A B. Com or law degree with at least 5 years relevant work experience in the insurance industry. Sound knowledge and understanding of the Insurance Acts and the insurance industry related operational requirements are essential. A Compliance and/or Risk Management background is needed. Key Performance Areas: • Liaise with the public and other stakeholders when receiving complaints or enquiries; • Investigate complaints and enquires within the required departmental turnaround times; • Monitor compliance with legislation to ensure the protection and fair treatment of policyholders; • Participate in on-site inspections to insurers to establish compliance with insurance legislation; best practice and market conduct related issues; • Manage relationships with insurers assigned in the portfolio; • Perform administrative and other activities relating to the regulatory framework as may be required; and • Assist the department with projects that the department is working on.
