SENIOR MANAGER: INSPECTORATE Component: Compliance and Enforcement Department: Western Cape Liquor Authority (Bellville) Reference Number: WCLA 08/2023 Requirements: • NQF 7 Legal Administration or any other relevant NQF 7 qualification • At least 5 years’ management experience • At least 3 years’ experience in an administrative, regulatory and or compliance/enforcement environment • Project management experience. • Valid Code B/ EB driver’s license with no vehicle restrictions • No criminal record Experience and competencies which will be advantageous: • Exposure to systems and processes (advantageous) • Experience working with a governing board (advantageous) • Experience working in a schedule 3 organisation (advantageous) • Experience working in the public sector (advantageous) Key performance areas: 1. Facilitate the determination of public interest within all municipal areas. ➢ Ensure Inspections are conducted in all local municipal areas to facilitate public interest. ➢ Collaborate with stakeholders to collate input and data to interrogate public interest. ➢ Develop recommendations for decision making based on findings. ➢ Promote public communication with regard to regulation. ➢ Oversee the development of Problem Statements in Municipal areas including the Metro. 2. Ensure all licensed premises are inspected for compliance annually and where applicable quarterly ➢ Ensure complete Inspections are conducted timeously and iro all applications annually. ➢ Monitor the quality of inspectorate reports against LLT and Appeal Tribunal decisions. ➢ Ensure compliance notices are issued for non-compliance and where appropriate non-compliance reports are filed. 3. Engage key stakeholders such as SAPS and Local Government for effective regulation and compliance ➢ Maintain an institutional service standard or arrangement with DLO’s and Municipal partners. ➢ Develop a shared understanding with legislative partners to grow appreciation for regulation. ➢ Develop communication and awareness tools to promote advocacy and awareness of social ills and its relation to alcohol. 4. Supporting the Liquor Licensing Tribunal in the determination of public interest ➢ Ensure clear and compelling reports and evidence is presented. ➢ Engage with LLT on continuous basis to ensure Inspectorate supports Tribunal in decision-making. ➢ Advise on best practices developed within the Inspectorate. 5. Oversee Compliance Monitoring of Special Events and Temporary Licenses ➢ Ensure that compliance inspections are conducted for special events and temporary licenses. 6. Oversee Enforcement Operations of Licensed and Unlicensed Premises ➢ Ensure effective co-ordination of operations with relevant enforcement agencies. ➢ Ensure operations are conducted according to set procedures. ➢ Review impact of operations conducted and report to stakeholders. 7. Oversee Compliance Intelligence Gathering ➢ Ensure effective compliance intelligence is gathered and reported on for areas. ➢ Ensure credible intelligence gathering to inform compliance & enforcement interventions. ➢ Ensure relevant data is gathered and analysed to enable the LLT in determining public interest. 8. Oversee the investigations of complaints for Licensed and Unlicensed Premises ➢ Ensure complaints are investigated according to set procedures. ➢ Review outcomes of investigations conducted and report to stakeholders as needed. ➢ Monitor and assess the quality of investigations and inspectorate reports against LLT and Appeal Tribunal decisions. ➢ Ensure the section 64 process allows for the timeous serving of notices and submission of related inspectorate reports. 9. Strategic Management of Component ➢ Ensure all Compliance and Enforcement policies and procedures are in place and implemented. ➢ Contribute to the WCLA strategic decision-making process. ➢ Prepare and manage budget for Component. ➢ Ensure the coordination of liquor compliance & enforcement interventions. ➢ Proactively manage and report on component’s projects. ➢ Accurate input to QPR for component provided timeously. ➢ Ensure all policies and SOP’s (internal controls) developed and implemented for component. 10. People Management for Component ➢ Implement EE strategy within Component. ➢ Ensure staff development and performance management is taking place. ➢ Ensure WCLA policies and practices implemented within Component. • Knowledge of Public Sector legislation, e.g. Administrative Law, PFMA, National and Provincial Treasury. • Knowledge of relevant industry legislation and regulations, e.g. National Liquor Act, Provincial Liquor Act, POPI, PAJA, PAIA. • Sound knowledge and understanding of risk management, risk registers, risk mitigation etc. • Detailed working knowledge of Project Management. • Knowledge of communication and stakeholder relations practices. • Excellent business communication skills Knowledge: Skills: • Good verbal communication • High level of report writing skills • Good inter-personal and inter-departmental relations • Facilitation and presentation skills • Computer literate Physical demands: • General level of fitness is required for position. • Work is often conducted outside of head office, in remote, rural, urban and often volatile areas.
