SENIOR ADVISOR: LEGAL AND COMPLIANCE Based in National Office (Pretoria) Ref: 22/10/01 Cluster: Human Capital and Corporate Services Remuneration package: A competitive salary package with benefits ROLE OVERVIEW Reporting to the Senior Manager: Corporate Services, the incumbent will implement, direct and manage the internal legal function through the implementation of processes, procedures, systems and tools to ensure the efficient and effective delivery of relevant and best-fit solutions to inter alia manage and co-ordinate the conceptualisation, development and finalisation of all SALGA contractual arrangements and to provide expert advice to all business units of SALGA. To provide internal legal advice and services such as drafting of legal opinions to enable improved decision making; and to implement and direct the compliance function and its interventions through the implementation of processes, processes, procedures, systems and tools to ensure the efficient and effective delivery of relevant and best-fit solutions and services). QUALIFICATIONS AND EXPERIENCE ▪ LLB degree and admitted as an Attorney/ Advocate. ▪ At least 5 years’ relevant experience of which at least 3 years have been at an equivalent level within a medium to large sized organisation; ▪ Demonstrates a sound understanding of the Local Government Sector; and ▪ Sound track record in effectively managing complex and sensitive stakeholder engagements at all levels. ▪ Sound understanding of policy and legislative frameworks in area of responsibility. ▪ Knowledge of the SALGA business and sustainability requirements. ▪ Understanding of project management principles. ▪ Understanding of expense management principles and regulations. ▪ Contract management principles. ▪ Valid Driver’s License. KEY PORTFOLIO AND PERFORMANCE FOCUS AREAS ▪ Legal Services: Minimise, mitigate and manage all legal disputes on behalf of SALGA. Maintain a preferred external panel of legal practitioners and negotiate and maintain the applicable agreements with the appointed panel of legal practitioners. Provide guidance, advice and where necessary co-ordination in respect of the initiation or defence of litigation, arbitration and legal disputes, with a view to the protection of SALGA’s rights. Oversee and/or monitor the management of external legal practitioners instructed to act for SALGA in respect of legal proceedings and, where necessary implement governance mechanisms in this regard. Drafting legal opinions, reports and legal documents. Provide support to all SALGA units with regard to commercial matters and legal advice in order mitigate legal risks ▪ Compliance Services: Draft and review SALGA’s compliance management policies and strategies to ensure its compliance with applicable legal prescripts. Conduct legislative assessments to determine regulatory risk, implementing legislative and regulatory changes that impact the business and ensuring soundness and quality control in respect of overall compliance of the entire organisation. Define and set standards for achieving compliance and ensure ongoing monitoring of compliance to identify areas of non-compliance. Ensure the accuracy and integrity of the compliance database and ensure quality and validity of the data. ▪ Research & advise: Be a key repository of knowledge and information on legal & compliance matters relating to SALGA. Guide, support and provide professional advice to SALGA. Facilitate the implementation of Compliance interventions internally. ▪ Planning: Provide input to the development and monitoring of implementation of procedures, systems and mechanisms to ensure the effective delivery of services within area of responsibility. ▪ Capacity Building: Facilitate training programmes/peer learning sessions in the areas of focus/professional discipline. ▪ Expense Monitoring and Governance: Assist with the preparation of budgets and monitoring of the monthly expenditure in area of accountability. Assist in the identification of potential revenue sources in area of responsibility (where applicable). Participate in procurement committees as required and adhere to procurement requirements and deadlines for identified programme/s Actively save costs in the area of responsibility. Independently applies functional or technical knowledge in order to perform higher level clerical, administrative and secretarial duties well within policy and procedural requirements. ■ Secretarial Services: With minimum supervision, schedule internal & external meetings with higher levels of complexity (diary management, professional communication with participants, booking venues & equipment; handle all relevant logistical arrangements) according to SALGA requirements and within budget. Drafts, prepares and edits responses to correspondence.
