POSITION TITLE: Regulations Manager 2. DEPARTMENT: Compliance, Regulations and Accreditation 3. REPORTING TO: Compliance, Regulations and Accreditation Executive 4. GRADE LEVEL: D Band 5. LOCATION / CENTRE: Johannesburg JOB DETAILS Purpose The main purpose of the Regulations Manager is to manage the Regulatory Function and to ensure that regulated social housing institutions and other delivery agents comply with the Social Housing Act, its Regulations, and other relevant legislation. The Regulations Manager needs to develop/influence and implement regulating processes to ensure that accredited SHIs, social housing institutions and other delivery agents and sector stakeholders comply with applicable. The Regulations manager is also responsible for managing litigation, which becomes ancillary to the regulations of social housing institutions and other delivery agents and enforcement. Key Performance Areas – Activities Enforcement Provide legal advice on SHRA regulatory compliance and enforcement and present findings and legal recommendations. Evaluate enforcement cases by checking quality and completeness of evidence, checking against good practice and legal requirements, and requesting additional documentation (if necessary) to support the compiling of suitably strong case files as required. Provide legal support in enforcement engagements by managing cases, making recommendations, documentation on conclusion of engagements as required. Assist to build legal enforcement tools and templates to support case compilation by evaluating requirements, developing tools and templates, and handing over to managers for implementation. Assist with the review and update of legal approaches and enforcement tools continuously. Report on legal enforcement support by gathering all required information, collating, and reporting according to the agreed standards quarterly Litigation Management of litigation to achieve the desired optimal outcome by investigating all allegations of maladministration against regulated entities. Gather evidence on litigious matters, gain expert legal opinion and input when required to improve the SHRA litigation outcomes. Preparation and reviewing of court papers in collaboration with the outsourced practitioners. Assist the sourced Legal Counsel in litigation matters and provide support to ensure the best interest of the SHRA. Report on litigious matters to relevant governing structures by tracking progress and reporting as per standards within agreed deadlines. Legal Drafting Compile/amend legal documentation and contracts. Ensure that the best interest of the SHRA is protected in all legal documentation. Influence legal and regulatory drafting/amendments on behalf of the SHRA. Contract Management Management of appointed Service Providers. Preparing and drafting Service Provider Services Agreements and manage deliverables. Manage and monitor Service Providers’ expenses in accordance with agreed service levels. Draft allocated contracts by receiving brief and compiling contract in line with defined standards and requirements, referring for comment, making amendments and submitting for final approval by agreed deadline. Conduct first review of contracts received from external parties by evaluating contracts, making notes and comments on contract and submitting for final review within approved timeframe. Coordinate the distribution and delivery of approved and amended contracts by identifying required recipients and coordinating delivery within deadlines. Track the delivery of the contracted deliverables, standards, and budgetary allocations. Terminate contracts in cases of continuous non-delivery against regulatory requirements in accordance with legal requirements. Management Develops strategies to ensure that SHI’s and other delivery agents comply with government regulations. Serving as a liaison between regulatory bodies and operating divisions of the SHRA. Collating and responding to requests for information from regulatory bodies and SHRA auditors. Coordinating with operational units to ensure compliance with Regulations. Maintain current knowledge of regulations applicable to the SHRA and social housing sector. Monitor regulatory affairs and the effect changes will have on the SHRA’s operations. Develop and maintain professional relationships within all relevant government departments, local regulatory entities and fellow human settlement entities. Contribute to the strategy of the unit and the SHRA. Report and advise on all relevant new or changing legislation related to the SHRA Regulatory landscape that affects or impacts the regulated entities by reviewing legal decisions and prescripts, policies etc. Build unit capacity by identifying shortcomings and recommending enhancements to ensure the efficiencies within the Regulations unit. Manage and ensure that legal services providers are provided with timeous instructions. Managing and reporting on expenses within the unit. Facilitate communication and education sessions, internally and externally, to ensure that the SHRA is well informed of the Regulation legal and regulatory impact and requirements Policy Process Review Consistently review existing policies and procedures to ensure currency and relevancy. Amend policies and procedures in accordance with changes to the Regulations environment to ensure currency and relevancy. Submit amended policies and procedures for approval. Conduct communication and awareness sessions on the amended policies and procedures where applicable. Compile education and awareness documentation on the amended policies and procedures and distribute it across the SHRA to ensure that all role players are informed. Distribute education and awareness documentation on policy and procedure reviews to relevant external role players where applicable. Reporting Prepare and table monthly and quarterly submissions to the relevant governance structures, in consultation with all relevant operational units. Implementation of SHRA operational targets. Implementation and monitoring of SHRA Exco and Council Resolutions. Represent SHRA Identify and analyse all litigation by and against the SHRA to determine the nature and extent of the representation required. : Conduct research to ensure all relevant aspects are considered and known for representation. Represent the SHRA at the appropriate forums in terms of Ensuring the SHRA position is not disadvantaged. Compile and distribute a report on the outcomes of the representation to ensure that all relevant role players are informed of outcomes and further action required. Compile actions plans, where appropriate, manage and monitor the implementation if the SHRA is affected in any way. Strategic Contribute to the achievement of the SHRA’s overall performance as defined in the APP as required for Senior Managers. Reporting to the CAR MANCO, SHRA Executive and Board Committees. Establishment and implementation of systems and formal processes for drafting and managing legal agreements and enforcements measures. Drafting and implementation of business agreements in consort with the SHRA’s legal department. Managing services providers including negotiating best rates and service levels. Establishment and implementation of systems and formal processes for providing legal and compliance advisory services to the SHRA. Must be solutions driven. Analytical. Participate in relevant internal and external forums to ensure efficient collaboration between the SHRA , Municipalities and other stakeholders within Human Settlements. REQUIREMENTS Qualifications/Knowledge (including most relevant field of study) • An NQF Level 8 qualification in the Legal Discipline (LLB) or equivalent legal qualification. • Admitted Attorney Experience • 7 -10 years’ experience post admission • Experience in a corporate legal environment • Regulatory and Enforcement experience will be an advantage Note: SHRA reserves the right not to make an appointment or withdraw the advertisement.
