The QCTO is a Council established under the Skills Development Act 97 of 1998 for standards generation and quality assurance for all qualifications in the Occupational Qualifications Sub Frame Work (OQSF).
The QCTO is looking for highly motivated, competent and professional individuals to fill the following position: - DEPUTY DIRECTOR: LEGAL X1 (Re- Advertisement) (Permanent Position) REF: QCTO 181 Salary Notch: R 882 042.00 – R 1 038 999.00 per annum (Total Cost to Company) LOCATION: PRETORIA Manage the Legal Services function in the QCTO. Key functions: • Implement and comply with regulatory and legislative arrangements and reporting requirements; • Develop policies and procedures related to Legal Services to ensure they remain relevant; • Provide legal assistance to QCTO internal stakeholders; • Manage litigation on behalf of QCTO; • Provide oversight of external legal services and monitor progress of work, including legal fees; • Conduct legal research and furnish opinions; • Provide contractual and other documentary drafting and review services; • Develop organisational standard contract and Service Level Agreement (SLA) templates • Review and vetting of all QCTO contracts and Service Level Agreements (SLAs) • Facilitate all contracting processes at QCTO and amendments of contracts thereof • Provide general legal advice and counsel internally; • Provide legal assistance in commercial transactions and negotiations as necessary; • Assist with budgetary planning for Legal Services; • Manage and monitor the expenditure for Legal Services against the allocated budget; • Implement and monitor the Legal Service operational plan; • Manage the performance of direct reports in a manner that creates a culture of high performance; • Provide employees with the necessary information and resources to deliver on their objectives and meet the targets of Legal Services; • Provide legal advice on labour related matters and represent the QCTO at the CCMA and Labour Court; • Advising management on the process and substantive aspects of disciplinary action for misconduct; • Prepare arguments for CCMA and Labour Court conjunction with HR Unit; • Determining management strategies and options during conciliation and mediation proceedings, in consultation HR; • Analysing labour cases, in consultation with HR, settlement agreements drafted by CCMA/no statutory mediators in order to assess the practical implications, risks and possible liabilities; • Preparing cases, heads of argument and pleadings and settlement agreements, in consultation with HR; • Assisting with the analysis, evaluation and implementation of arbitration and pre-dismissal arbitration awards to determine possible grounds for rescission or review; • Providing procedural advice for incapacity investigations and advising management on work adaptations and alternative work options; • Advise management on process and substantive aspects of grievance management in terms of the procedure and substantive aspects of disciplinary action for misconduct; • Assist management in the appointment of a Chairperson and Initiator of disciplinary enquiries and assist employers’ representatives with investigations; • Educate management and employees on policies, procedures, collective agreements and relevant legislation continuously; • Managing the Collective Bargaining processes in the QCTO; • Manage, facilitate, and advise on labour relations cases in respect of dispute resolution, grievances and disciplinary cases within the QCTO; • Prepare arguments for CCMA and Labour Court conjunction HR; • Facilitate end-to-end disciplinary processes in liaison with line management and represent the employer at external tribunals (CCMA or Labour Court) on assigned cases; Requirements: • A Bachelor’s Degree in related field (minimum NQF Level 7). At least 6-8 years' experience in the legal field. 3 years' experience in a management position. At least 6-8 years’ experience in the areas of commercial law, labour relations and litigation. Must have knowledge and exposure of Public Service, QCTO mandates and strategies, education system and pedagogy, Post school education framework, relevant Government wide legislation e.g. National Qualifications Framework Act, Skills Development Act and National Skills Development Strategy III. • Must have skills in applied strategic and operational thinking, Budgeting and financial management, Problem solving and analysis, Communication, Stakeholder engagement and management, Policy development and management, Quality management, Legal drafting and Managing litigation. Professional Financial Related designation, i.e. current membership of a relevant and recognised professional body. Chartered Accountant (CA: SA) qualifications will be an added advantage. Must have 10 years' collective experience in the field of Finance and/ or Accounting related field. Minimum of five (5) years’ experience at senior management position in the field of Finance and/ or Accounting. Must have both experience in the area of financial management and supply chain management. Must have knowledge of Public Service regulations, QCTO mandates and strategies and relevant Public Service legislation. Must have Legislative knowledge and prescripts e.g. relevant Acts, Public Service Act, PFMA and National Treasury Regulations. Must have knowledge of QCTO services, business processes, value chain and values. Must have skills in strategic capability, leadership, budgeting, financial management, people management and empowerment, problem solving and analysis. Must have good skills in communication, planning (strategic, medium term and short term), stakeholder engagement and management.
