OMBUD FOR FINANCIAL SERVICES PROVIDERS (FAIS OMBUD) VACANCY DEPUTY OMBUD The Office of the Ombud for Financial Services Providers (“FAIS Ombud Office”), is established in terms of the Financial Advisory and Intermediary Services Act, 37 of 2002 (“the FAIS Act”), and its functions are performed by the Ombud for Financial Services Providers (“the FAIS Ombud”). The FAIS Ombud is mandated to consider and dispose of complaints in a procedurally fair, informal, economical and expeditious manner and by reference to what is equitable in all circumstances. The FAIS Ombud Office is located in Pretoria East, Gauteng. In order to discharge its mandate the FAIS Ombud Office requires the services of an experienced senior and legally trained individual who also has extensive experience in the financial services industry.
This position requires a professional with the following attributes: 1. Academic Background LLB (Senior Law Degree) with admission as an attorney/advocate; Good knowledge of the rendering of financial services, various financial products, the applicable legal framework and the regulation thereof; Thorough knowledge of the FAIS Act and its subordinate legislation, the FSOS Act and an understanding of the Financial Sector Regulation Act and other Financial Services Statutes. 2. Knowledge / Experience Required 15 years’ experience in a commercial legal advisory environment post admission; At least 10 years’ experience in a financial services regulatory/compliance environment; Extensive related senior management experience with expertise in legal drafting, analysing and interpreting complex legal and financial services issues; Extensive experience (at least 10 years) in a senior executive role relating to ADR or ombudsman processes in a financial services environment (i.e. Insurer, Bank, or a financial services provider) in South Africa; Strong written and verbal communication and relationship building skills; Sound judgment, ADR and conflict resolution skills; Advanced problem solving, planning and facilitation abilities; Decision making and strategic thinking skills; Organisational knowledge and networking skills; Sensitivity to diversity issues; Composure and presentation skills; Have a reputation for integrity and for fairness, effectiveness and adherence to time limits; Independent thinking, a fit and proper person, demonstrating high levels of competency, capability and financial soundness; Have sound leadership qualities and the ability to effectively contribute to a service-driven organization; Proven ability as a team leader with a commitment to create support and sustain an environment that enables the Office to achieve results.
