NATIONAL LOTTERIES COMMISSION (NLC) The National Lotteries Commission (NLC), a Scheduled 3A entity in terms of the Public Finance Management Act (PFMA), is a statutory body established in terms of the Lotteries Act (Act 57 of 1997), as amended with the purpose of regulating South African Lotteries and administering the National Lottery Distribution Trust Fund (NLDTF). LEGAL SERVICES DIVISION EXECUTIVE MANAGER: LEGAL SERVICES MAIN PURPOSE OF THE JOB: The Executive Manager Legal Services will be responsible for the effective and efficient management of the Legal Division. Provide legal support and advisory services to the National Lotteries Commission in executing its functions as detailed in legislation and, to manage legal and contractual risks. SALARY SCALE: • Commensurate with qualifications and experience • A five (5) year fixed term contract REQUIRED QUALIFICATIONS • Bachelor of Law Degree or equivalent. • Postgraduate qualification in management required. • At least 10 years post admission experience as an Attorney or Advocate of the High Court required. REQUIRED WORK EXPERIENCE • A minimum of 10 years’ legal experience, with 5 years at a senior management level. • More than 5 years in funding and/or regulatory environment will serve as an advantage. • Proven track record of building and leading a successful legal department. • Litigation and Contract Management Experience • Risk Management experience • Knowledge of laws and Regulations relevant to the NLC in general and the Lotteries Act 57 of 1997 (as amended) including its Regulations in particular. • Understanding of the gaming and lottery sector will serve as an advantage. KEY DELIVERABLES • Provide strategic direction in the Legal Division • Develop contract management policy and procedures • Develop Legal services framework • Develop Debt Recovery strategic plan • Provide a comprehensive legal service to deal with legal issues including legal advice, litigation, opinions, commercial and contract law, and other judicial processes • Effective litigation management • To serves as the legal representative for the organisation (license to operate, contractual arrangements, litigation, corporate transactions, intellectual property etc.) • Advise the Commissioner and Executives in all corporate legal, and the Lotteries Act legislation. • Analyse and identify legal and liability risks, implications and assist in the development of mitigating strategies. • Collaborating with external legal service providers and counsel for litigation support • Develop sound contract management strategies, policies, practices and systems to minimize the risks exposure; oversight and vetting of all legal contracts and obligations. • Provide support in ensuring that the organisation responds adequately and complies with all regulatory and legal prescripts. • Ensuring that the organisation conforms to principles of Corporate Governance which include among others, effective Board functioning, accountability, transparency, honest reporting, responsibility, fairness and ethical conduct and oversee the content of Legal information disseminated externally. LEGAL OFFICER X2 MAIN PURPOSE OF THE JOB Responsible for drafting and managing grant agreements and other contracts in respect of the National Lottery Distribution Trust Fund (NLDTF). REGULATORY COMPLIANCE DIVISON SENIOR MANAGER: REGULATORY COMPLIANCE & ENFORCEMENT MAIN PURPOSE OF THE JOB The Senior Manager Regulatory Compliance and Enforcement will ensure the employment of strategies, policies and procedures to verify and enforce compliance of lotteries and sports pools with regulatory requirements and to combat illegal lotteries and related activities.
