MPUMALANGA ECONOMIC REGULATOR (MER) The Mpumalanga Economic Regulator (MER) is a Schedule 3C Public Entity, established in terms of the Mpumalanga Economic Regulator Act, 2017 (Act No 2 of 2017), responsible for gambling and liquor regulation in the Province. EXECUTIVE MANAGER – COMPLIANCE Reporting to the Chief Executive Officer, the Executive Manager Compliance will be responsible for the strategic management of the Compliance Department. Key Responsibilities: includes, inter alia, the following: · Strategic leadership and direction of the Compliance Department. · Oversee inspections of all gambling and liquor establishments to ensure compliance with all legal and regulatory requirements. · Keeping abreast of regulatory developments within the industry as well as evolving best practices in compliance control. · Resolve any compliance-related issues or disputes. · Manage the evaluation and analysis of new and operational gambling equipment, systems and software, data analysis and the maintenance of accurate information systems and databases. · Conduct gambling and liquor blitz inspections in consultation with the SAPS, other relevant law enforcement agencies as and when required. · Maintain accurate records of all legal and compliance activities and decisions. · Develop and maintain relationships with relevant regulatory bodies and industry organisations. · Recommendations and advice to Management and Board on gambling and liquor regulation and resolution of disputes in the industry. Essential qualifications, skills and experience: include the following: · A Bachelor’s Degree in Finance, Business or Law. A post graduate degree will be an added advantage. · A minimum of 10 years Executive Management experience. · Experience in the evaluation and analysis of gambling equipment, systems and software, design, implementation, monitoring and reporting of compliance inspection programs and procedures. · Excellent knowledge of the compliance requirements of the gambling and liquor industry. The successful candidate will be remunerated on the TCOE salary package and be based in White River. Key Responsibilities: includes, inter alia, the following: · Strategic leadership and direction of the Legal Services Department. · Recommendations and advice to Management and Board on gambling and liquor legislation and other legislation that may impact on the business of the MER. · Legal support and well researched legal opinions and interpretations on matters emanating from the operations and support departments. · Draft and develop contracts and legal documents. · Legal risk assessment, monitoring and management thereof. · Facilitate amendments to the Mpumalanga Gambling legislation and the Mpumalanga Economic Regulator legislation (Acts, Regulations and Rules). · Keep abreast of new legislation and regulatory changes and facilitate industry comments. · Briefing, instructing and managing external Counsel on litigation matters. · Management of the Board Secretariat services including all activities of the Board and its Committees, arrangement of meetings and compilation of minutes and resolutions of meetings. Essential qualifications, skills and experience: include the following: · A Bachelor of Law degree (LLB). A post graduate degree will be an added advantage. · Admission as an Attorney or Advocate in the High Court of South Africa. · A minimum of 10 years Executive Management experience in an in-house legal department of a corporate entity with excellent managerial, leadership and strategic planning skills. · Extensive knowledge and experience of the Legislative and Regulatory Framework in which the MER operates. · Excellent legal research skills and legal advisory experience.
