KWAZULU NATAL LIQUOR AUTHORITY CALL FOR NOMINATIONS: LOCAL COMMITTEE MEMBERS FOR KWAZULU NATAL LIQUOR AUTHORITY In terms of Section 33(1)(a) of the KwaZulu- Natal Liquor Licensing Act 2010 (Act 6 of 2010) as amended, the responsible Member of the Executive Council (MEC) is calling for interested parties to submit nominations for the positions within the area / location of a District or a Metropolitan Municipality Cluster to serve as Local Committee members for the Kwazulu-Natal Liquor Authority. Only nominees for the positions as per the table below in the province of KwaZulu Natal will qualify. CLUSTERS: CLUSTER 1 Districts: UMkhanyakude, Zululand, Uthungulu Positions on Local Committee: Legal Representative x 1 Organised Business Representative x 1 Civil Society Representative x 2 CLUSTERS: CLUSTER 2 Districts: EThekwini, ILembe Positions on Local Committee: Legal Representative x 1 Organised Business Representative x 1 Civil Society Representative x 2 CLUSTERS: CLUSTER 3 Districts: Harry Gwala, UGu, uMgungundlovu Positions on Local Committee: Legal Representative x 1 Organised Business Representative x 1 Civil Society Representative x 2 CLUSTERS: CLUSTER 4 Districts: uMzinyathi, uThukela, Amajuba Positions on Local Committee: Legal Representative x 1 Organised Business Representative x 1 Civil Society Representative x 2 The Composition of the Local Committees: Each local committee consists of eight members, being fit and proper persons. In terms of Section 32(2)of the KZN Liquor Act no 06 of 2010 as amended, the following category of persons are hereby required viz - 1) Section 32(2)(a) - One person who is in a possession of a legal qualification with a least five years’ experience in the legal profession or the administration of justice; 2) Section 32(2)(b) - One person representing an Organised Commerce Body who has knowledge of the liquor industry but has no direct vested intxerest in the liquor industry, for the area in which the local committee is established. Candidates with a legal background will be preferable; and 3) Section 32(2)(d) - Two representatives appointed from the community in the area of the Local Committee, appointed by reason of their knowledge in the field of welfare or socio-economic development, social services or health. Candidates with a legal background will be preferable. We are currently seeking these professional individuals with the relevant experience to serve in the Local Committees for a period of 3 years or suchshorter period as may be determined by the responsible MEC with effect from date of appointment The responsible MEC shall designate from amongst the members of each Local Committee one member as a Chairperson and another member as a Deputy Chairperson from amongst those members who meets the requirements in terms of the Act respectively. Powers and functions of the Local Committees are to: 1. Deal with and consider all applications for licences made in terms of the Act. 2. Make recommendations in respect of all applications to the Liquor Authority after considerations of the applications. 3. Advise the Liquor Authority or furnish a report or recommendations on any matter referred to it by the Liquor Authority for consideration and arising from the application of the Act. 4. Perform such other functions as may be assigned to it in terms of the Act. Criteria for selection All nominees’ experience and background in accordance with the category for which such nomination is made, will be considered to determine the most suitable candidates. A nominee may not be appointed as a member of the Local Committee if that person: 1. Is not a South African citizen and a resident in the Province. 2. Is an un-rehabilitated insolvent. 3. Is subject to an order of a court declaring such person to be mentally ill. 4. Has at any time been convicted of any offence involving dishonesty – provided that a disqualification ended three years after the sentence has been served. 5. Has at any time been removed from an office of trust on account of misconduct? 6. Has a direct or indirect financial interest in the liquor industry, or whose spouse, life partner or close relative has a direct or indirect financial interest in the liquor industry, where such relationship in the opinion of the responsible MEC constitutes a conflict or potential conflict of interest. Nomination procedure Your nomination should include the following: • Completed Nomination Form obtainable from the offices of the Department of Economic Development Tourism and Environmental Affairs (EDTEA) and from our website: www.kznedtea.gov.za. • A motivational letter (Max. 3 pages) giving details why you are nominating the individual for the position. • The motivational letter should also include the following information, which will be used in considering the nominee for the committee:
a) The relevant organised commerce body in terms of section 32 (2) (b) b) The relevant community structure in terms of Section 32 (2) (d) of the Act. • Written and signed confirmation from the Nominee of his/her willingness to have their name put forward as a potential member of the Local Committee. • Certified copy of the Nominee’s Identity Document. • Affidavit from the nominee confirming the candidate is not disqualified for such appointment in terms of section 32(5) of the Act. • Nominee's curriculum vitae (maximum of 5 pages) with certified copies of academic qualifications. Applications must be submitted ONLY via email to Lcnom@kznedtea.gov.za or dropped into a specially marked box at the Head office of the Department of Economic Development, Tourism and Environmental Affairs at 270 Jabu Ndlovu Street, Pietermaritzburg. Deadline for all application submissions is on 08 March 2024. No late submissions will be considered. No Nomination Forms are to be posted.
