Purpose of the job The Films and Publications Amendment Act, 2019 (Act No. 11 of 2019) which has ushered in the FPB as a regulator of content transitioning from its previous guise as a classification authority. The mandate of the FPB is significantly expanded with legitimate powers to issue and grant licences and enforce prescribed regulations, by imposing penalties for non-compliance with the law and the requisite regulations. The newly introduced enforcement committee will strengthen compliance. The capacity of FPB as online content regulator also lies in its legitimacy to perform its functions as accorded by the legislation and the robustness and clarity of the instruments it uses to regulate the sector, including enforcement. This therefore requires adequate, clear, and robust regulatory frameworks and procedures and instruments for efficient management of its regulatory environment. This priority therefore will be driven by the market intelligence and trends analysis research which will be a major support function towards this priority area. Key Outputs: The successful candidate will report to the FPB CEO and their responsibilities will include: ● Strategic Planning – Develops medium-term performance plans based on the FPB strategic mandate and ensure successful execution thereof● Regulatory instruments Develop the regulatory tools and instruments aligned to the expanded mandate of the FPB; ● Enforcement Registrar Investigate and launch proceedings before the Enforcement Committee in instances where non-compliance has been identified and persists ● Research – Conduct Research to guide decision-making within the organization, ● Legal and Compliance - Ensures that all operational activities of the Authority are compliant with relevant legislation and codes of good governance ● Management and Administration – Provides general oversight of Programme’s activities, manages the day-to-day operations, and assures a smoothly functioning, efficient organisation ● Governance – Works with the Council/Chairperson to enable the Council to fulfil its governance functions and facilitates optimum performance by the Council, its committees and individual Council members ● Human Capital – Ensures the implementation of a human capital strategic and policy framework that meets the needs of the Authority ● Finance – Promotes programmes and services that are produced in a cost-effective manner and kept within budget while maintaining an acceptable level of quality, and compliance to the Public Finance Management Act. ● Public Complaints – receive and oversee the management of the public complaints referred to him/her pursuant to section 18C of the Films & Publications Act and ensure that they are tabled before the enforcement committee. Qualification and Experience: Relevant NQF8 Qualification in Social science, Legal, Compliance, Enforcement and relevant qualification. 8 years’ experience serving at Executive and Senior Management level ● Proven track record in building and leading highly successful and motivated teams ● Good understanding of the FPB’s legislative mandate and operational environment. ● Solid Project Management Skills ● Solid and Demonstrable experience in policy/regulatory development, compliance, and enforcement, Solid regulatory in the ICT sector acumen ● Solid legal approach ● Good knowledge of change management and stakeholder management.
