COMPETITION TRIBUNAL (Established by the Competition Act No. 89 of 1998) The Competition Tribunal was established in terms of the Competition Act No. 89 of 1998. It is responsible for adjudicating prohibited practice and merger cases. In terms of section 35 of the Competition Act, 1998, the Chairperson of the Competition Tribunal hereby invites applications for the following position in the Tribunal (Pretoria).
CHIEF OPERATING OFFICER Total Cost to Company Annual Salary starting at R2 061 363. 00 Reporting to the Chairperson of the Tribunal, the Chief Operating Officer performs a key operational role across all departments in the Tribunal and is integral to service delivery, ethical culture and the effectiveness of the organisation. The successful candidate must be a senior, multi-talented professional with the correct strategic fit and the ability to provide leadership that drives result-based outcomes. The candidate is expected to embrace the values of the institution and be committed to public service. Direct reports to this position are: Head of Case Management, Head of Registry, Head of IT, Head of Corporate Services. We are looking for a dynamic, hardworking and committed individual who meets the following requirements: Qualifications and experience Master’s degrees in Law, Economics or Business Administration. At least 10 years executive leadership experience. The successful candidate must have Leadership and interpersonal skills. Proven track record with interacting with senior management and managing stakeholder relationships. Ability to work strategically and collaboratively across departments. The main responsibilities of the incumbent will, inter alia, include: Assisting the Chairperson with coordinating Executive Committee (“Exco”) of the Tribunal in relation to both the core and non-core business of the Competition Tribunal. Assisting the Chairperson with developing strategy, including the preparation of the Medium-Term Expenditure Framework, Strategic Plan, Annual Performance Plan, Quarterly and Annual Reports. Assist to improve co-ordination across cross functional teams and to operationalize the vision. Assisting the Chairperson in facilitating effective decision-making relevant to the office of the Chairperson. Co-ordinating the execution of strategic initiatives and projects on behalf of the Chairperson. Assessing inquiries directed to the Chairperson, determine the proper course of action and delegate to the relevant officials to address. Representing the Chairperson at appropriate forums, when requested, including the Department of Trade Industry & Competition, National Treasury, Audit and Risk Committees. Overseeing the design and implementation of proper corporate governance and best practice. Assisting the Chairperson to ensure the policy universe is updated, relevant and is being properly implemented. Assisting to craft, implement and monitor the system of delegations for the Chairperson. Designing an early warning system and dashboard for the Chairperson in relation to the strategic risks and the control environment of the organisation. Keeping the Chairperson abreast of the progress with internal and external audits undertaken within the organisation. Assisting the Chairperson with service delivery and ensuring compliance with turnaround times in core and non-core aspects of the Tribunal’s functions. Assisting the Chairperson to promote an ethical culture in the organisation. Assisting the Chairperson with appropriate internal and external communication. SENIOR CASE MANAGER Five-year contract Annual Total Cost to Company Starting at R1 192 703.00 Reporting to the Head of Case Management, the incumbent will be required to work closely with other Case Managers, Registry and Tribunal Members in facilitating the adjudicative role of the Competition Tribunal and the management of Tribunal cases allocated to the case manager. The role shall include the following: Key Responsibilities Researching specific legal, procedural, jurisdictional matters and broader competition law issues. Liaising with external parties including lawyers, trade unions and other stakeholders in preparation for hearings. Ensure that Tribunal Members are informed of developments in competition law and public policy in other jurisdictions and in scholarly publications. Assist Tribunal panel members by providing pre- and post-hearing briefings on cases. Conduct case specific background research to facilitate Tribunal hearings. Assist Tribunal panel members in drafting Reasons. Assist Head of Case Management in updating the Tribunal electronic database and jurisprudence. Assist Head of Case Management in preparing and delivering seminars on new developments from cases. Qualifications, Skills and experience The applicant must have a minimum of an LLB degree. A Masters degree will be an added advantage. Admitted as an Attorney/Advocate of the High Court. Knowledge of the Competition Act 89 of 1998 is essential. Research experience using electronic media is required. Working experience of minimum 6 years in competition law is essential. Other work experience in related fields will serve as an advantage. Excellent verbal and written communication skills. Planning, organising and time management skills. Ability to work under pressure. Computer skills with proficiency in MS Office.
